Bobby Shmurda Less Jail Time On Table In Prison Shank Case

12/7/2016 2:02 PM PST BY TMZ STAFF

1207-Bobby-Shmurda-tmzBobby Shmurda's lawyer just pulled a legal rabbit out of the hat -- the rapper has a new opportunity to reduce his prison time.

Shmurda was in court Tuesday with attorney Alex Spiro for allegedly getting caught with a shank behind bars. We're told prosecutors are offering Bobby the chance to plead guilty to a reduced charge of "attempted promoting prison contraband." If he does he could get 1 to 4 years.

Bobby's already serving 7 years for his murder conspiracy case, but if he takes the plea deal for the shank ... the sentence will run concurrently.

Sources close to Bobby say his friends, family and lawyers are all pushing him to take the deal. They're concerned because he's been a loose cannon in court lately.

One of Bobby's counterparts was sentenced to 98 years back in May ... so the possibility of him getting out in anything less than 10 is some damn good deal. Shmurda can think over his decision on the plea until a January 7 hearing.

We reached out to Spiro ... but he had no comment.

Oakland Fire Brawls and Death Threats Alleged Involving Commune Leader

12/6/2016 2:49 PM PST BY TMZ STAFF

1206-derick-almena-warehouse-fire-composite-art-NBC-OAKLAND-GHOSTSHIP-01Derick Ion Almena's Oakland art commune had a ton of problems before the tragic fire ... including brawls and death threats, according to docs -- hardly the rosy picture Almena's tried to paint.

In docs, obtained by TMZ, 2 men tried to get restraining orders against Almena in 2015. They accused him of ordering commune staffers to beat the crap out of them for allegedly trashing the place after a gig there. They say Almena was pissed because his son found a condom in the building.

Right after the alleged run-in the men gave a blow-by-blow on camera. The video was submitted in the case.

A couple weeks later, Derick was busted for having a stolen Airstream trailer on the Oakland property. He was arrested for felony possession of stolen property and pled no contest in January 2016. As we reported ... he's currently on probation for about 2 more years.

Derick tried to get a restraining order against a 55-year-old woman in February 2015 ... claiming she threatened to have her sons come over and "blow my f****** head off." According to docs, the woman was living at the commune without paying rent. Almena accused her of squatting, stealing his property and threatening his entire family.

All the restraining orders were denied when the parties failed to show up in court.

Almena told Matt Lauer the space was his dream home, which hosted up-and-coming artists. He obviously left out a ton of other details.

'Django Unchained' Actress Leaking Audio Was Unethical ... Commission Rules

Breaking News

1206_daniele-watts_jim_parker_brian_james_lucas_facebook-3The cop who cited a "Django Unchained" actress for having sex in public has been called out for leaking audio of the incident, and it's gonna cost him some dough.

The L.A. Ethics Commission ruled Tuesday former LAPD Sergeant Jim Parker broke city rules by releasing the audio to TMZ following the 2014 incident with Daniele Watts, who Parker busted for having sex with her BF in their car in broad daylight.

The Commission said Parker was sharing confidential info related to the case when he released it, so he'll now have to pay a $500 fine ... instead of the max $10,000 he was facing.

1206_daniele-watts-scene-tmz-swipeYou'll recall ... when Parker and his partner responded to the scene, Watts played the race card big time. She later apologized to the officers, and pled no contest to the charges.

Gasser's lawyer just filed a motion claiming there's no probable cause for his client's arrest. He's asking the court for the earliest available hearing ... so he can show a judge why Gasser should get out of jail.

Gasser was arrested Monday night and is being held on a $500,000 bond.

At the very least, his attorney's asking the bond be reduced.

Joe McKnight Case Sheriff Drops N-Bomb, F-Bomb In Bizarre News Conference

12/6/2016 8:44 AM PST BY TMZ STAFF

Sheriff Newell Normand is firing back at the people who have criticized him for the way he's handling the Joe McKnight shooting investigation ... and just read OUT LOUD some of the hateful comments he and other leaders have received, including the n-word and the f-word.

Sheriff Normand says he and other leaders have received letters using various racial and homophobic slurs. He did not water down the language.

When asked why he decided to read the hateful language out loud, Normand says he wanted to show people how "crazy" things have gotten ... where people are getting harassed for doing their jobs.

The conversation turned racial and Normand says black people are more likely to be killed by black people in his community.

Oakland Rave Fire Ex 'Ghost Ship' Worker Warned ... It Was Primed for Disaster

12/4/2016 4:16 PM PST BY TMZ STAFF

The Oakland fire was 100% avoidable in the eyes of a woman who worked in the building ... and claims she warned the boss about safety dangers for years.

Danielle Bourdeaux volunteered at the so-called Oakland Ghost Ship art collective until 2015, and says she was friends with its director, Derick Ion, and his family. However, she paints a very vivid picture of "dangerous, disheveled" -- conditions she says she warned Ion about multiple times.

She believes Ion is a "hoarder" who blew off her concerns, and added ... that infamous cargo pallet stairway in the building was more like a "treehouse staircase." She revealed there was a more legit one, but explained why it wouldn't have helped first time visitors.

Bourdeaux says she left the collective after a falling out with Ion over his kids. Basically, she felt it was unsafe for them to live in the building, and she claims he disagreed.

We've reached out to Ion, but haven't heard back. Cops have not named any suspects, but say criminal charges are a possibility. They continue searching, and the death toll is now at least 33.

Oakland Rave Fire Commune Leader Whines About Losing Stuff ... Internet Lashing Out

12/4/2016 7:50 AM PST BY TMZ STAFF
Exclusive Details

1204-derick-icon-oakland-fire-facebook-status-FACEBOOK-01The new wave of outrage in Oakland's tragic warehouse fire is against Derick Ion -- the guy who ran the art commune that turned into a death trap ... and TMZ has learned he's already had legal troubles.

Ion wrote a Facebook post saying the the fire -- which most likely killed more than 50 people -- has left him "standing now in poverty of self worth." He was grateful his wife and kids were safe, but his focus seemed to be mostly on losing stuff he "worked so hard for"... and now he's getting blasted.

Just a taste of the responses: "What a disgusting piece of s***!" ... "I hope you get charged with manslaughter" ... and "There is a special place in Hell for people like you!!!!!!!"

Ion organized the artists working in the building which was known as the Ghost Ship Collective.

We did some digging, and according to Alameda County court records ... Ion's currently on probation for receiving stolen property. He plead guilty to the misdemeanor in January, and got sentenced to 36 months probation.

The sheriff's department has said criminal charges for the fire are possible, but no suspects have been named yet.
