Jared Fogle Shut Down By Judge In Bid for Early Release

Jared Fogle got no love from the judge who sentenced him to 15 years in prison ... ruling his legal arguments were BS.

Fogle had filed legal docs he prepared himself in the prison library, claiming Judge Tanya Pratt had no jurisdiction to even hear the criminal case because the sex crime charges required proof he traveled from one state to another to engage in sex acts with minors ... and he says everything was done in 1 state.

Judge Pratt begged to differ, repeatedly calling Fogle's argument "frivolous," saying federal law specifically covers his crimes.  

The judge invited him to appeal to a higher court, but made it clear ... that dog don't hunt. 

Abby Lee Miller I'm Feeling Lighter For My Early Prison Release

What a load off Abby Lee Miller -- she's reportedly getting out of federal prison next month, and she'll be way lighter when she does it.

Abby posted a pic of herself and some friends -- looks like they were visiting her at the federal pen in Victorville, CA -- and her weight loss is obvious in the shot. There are reports she's lost about 100 pounds since entering prison in July.

You'll recall, she'd had gastric bypass surgery in April.

Abby's reportedly getting out on Feb. 20, and will immediately report to halfway house in Los Angeles. She says the dates aren't set yet, but says she's been a model citizen in prison, and she's looking forward to her new life on the outside. Prison officials tell us ... as of now, Abby is still scheduled to be released on June 21.

The Notorious B.I.G. Looking Down On His Murder Scene

The marketing team behind "Unsolved: The Murders of Tupac and The Notorious B.I.G" found a brilliant spot to promote the series ... right above Biggie's actual murder scene.

B.I.G. was gunned down March 9, 1997 as he left L.A.'s Petersen Automotive Museum -- on the corner of South Fairfax & Wilshire. Now, a huge billboard right above that intersection shows his face with the tagline "20 Years. Still Unsolved."  

The true crime scripted series also covers Tupac's murder, which happened 6 months before Biggie's. There is no billboard up at the Vegas intersection where 'Pac was killed. Not yet, anyway.

The show premieres February 27.

Yung Berg Wanted Man Again!! ... For Missing Court Date

Yung Berg apparently loves to learn the hard way -- not showing up to court is asking for trouble.

The 'Love & Hip Hop' star is a wanted man in Miami after missing ANOTHER court date following a weed bust. TMZ broke the story ... cops were called following an altercation in his hotel room back in October and they found 2 blunts on him. Normally, not a big deal but Berg had a 9-year-old warrant, so they arrested his ass.

He was later released, but was supposed to appear in court for his arraignment in the weed case on January 11 but -- you know how Berg's favorite game goes -- he never showed.

It's called Google Calendar, Berg.

Harvey Weinstein Too Low to Spoof Even For Porn Execs

Harvey Weinstein won't be parodied by the porn industry because the allegations made against him are just too nasty.

We talked to a bunch of porn execs who tell us straight-up ... they feel Harvey's alleged conduct was  disgusting ... so he won't get the Tiger Woods' spoof treatment .

WoodRocket is the premiere porn spoof company. They've done a ton, including "Ten Inch Mutant Ninja Turtles." WoodRocket producer Lee Roy Myers tells us, "WoodRocket.com" would never do a parody of somebody or something that hurt people."

As we've reported ... scores of women have accused Harvey of sexual misconduct, harassment or rape. That's all the reason porn execs needed to nix a Weinstein parody.

Joanna Angel -- founder of BurningAngel.com -- tells TMZ, "There are certain aesthetic standards for today's male performers, and there is no one who remotely comes close to looking like Harvey Weinstein, nor should there be."

Manson Family Killer CA Gov Blocks Van Houten's Parole

Manson family killer Leslie Van Houten's slight whiff of freedom just got snuffed out by Cali Gov. Jerry Brown.

Gov. Brown kept his streak going, and once again reversed the parole board's recommendation Van Houten be released. Back in September the board ruled Van Houten was suitable for parole, but just as he did in 2016 ... Brown blocked that decision.

68-year-old Van Houten has claimed she was an immature 19-years-old -- the youngest member of the Manson family -- when Charles Manson brainwashed her into commiting the LaBianca murders in 1969.

In his decision, Brown said Van Houten is still downplaying her "central role" in the murders. He said rather than accepting full responsibility, Van Houten continues to push blame off on Manson.

She'll continue serving her life sentence.

Too Short Sued for Multiple Sexual Batteries

Too Short is being accused of sexual battery ... TMZ has learned.

The rap legend is facing a lawsuit ... filed Friday in Los Angeles by a woman named Teana Louis. According to docs, obtained by TMZ, Teana says Too Short sexually assaulted her on multiple occasions ... between June and October of 2016.

In the suit, she says the attacks included forced oral sex, vaginal sex and sodomy.

Teana says she and Short met in December 2015, and eventually produced a song together in April 2016. She claims that's when he made the first unwanted advances. She claims the first assault went down in June when they went to a hotel room in Downtown L.A.

According to the docs, Too Short threw her onto the bed, held her down, undressed her and began performing oral sex on her. She claims subsequent incidents happened in hotel rooms or the studio. She claims on one occasion he told her, "I'm just going to put the tip in" ... and, although she said, "No, please no" ... he continued. In the suit, she says he held her down during vaginal sex -- she was left bleeding -- and then "brutally sodomized" her.

She's suing for sexual battery, sexual harassment, gender violence, gender discrimination and false imprisonment.

'The Situation' Prosecutors Urge Judge Go Easy on da Guy!

More good news for Mike "The Situation" Sorrentino -- prosecutors in his tax evasion case are pushing for the judge to give him a lighter sentence.

As we reported ... Mike entered a guilty plea as expected Friday, and the judge okay'd him to travel to Florida to shoot a "Jersey Shore" reunion.

Still, the Sitch's looking at up to 5 years in prison. According to new docs, prosecutors believe he played a minor role in the tax evasion, and point out he's accepted responsibility for his actions. They're making a case for leniency when the judge issues his sentence in April. 

On the money front, the docs say Mike has to fork out $123,913 in restitution to the IRS. The judge could also tack on a hefty fine at sentencing. 

Las Vegas Shooting New Pics of Paddock's Room Show Dead Body, Hidden Cams and So Many Guns

Las Vegas Police released new photos of mass murderer Stephen Paddock's room -- including of his dead body -- and they also show how he hid cameras, broke the window, and had countless guns and weapons.

The pics from the October 1 shooting reveal Paddock hid a camera in a food cart outside his hotel room, and also mounted one on the door's peephole ... confirming he was trying to keep an eye out for anyone trying to enter his room.

A close-up shot of the broken window through which Paddock shot his assault rifles is also included in the new photos, along with shots of guns and ammo strewn about his room.

As we reported ... 58 people were killed in the Mandalay Bay shooting.

Mike 'The Situation' Pleads Guilty to Tax Fraud ... 'Jersey Shore' Trip OK'd

10:10 AM PT -- Situation's attorneys, Henry E. Klingeman and Kristen M. Santillo, released a statement making a push for leniency in sentencing, saying, "The plea terms call for a balance between punishing the wrong committed and conditions that facilitate Mike living a productive, law-abiding life moving forward. Following through on this plea agreement, Michael intends to pay restitution before sentencing."  

Mike "The Situation" Sorrentino just entered a guilty plea in his tax evasion case ... but his situation Friday morning in court ain't ALL bad news.

The "Jersey Shore" star walked into the Newark court with his girlfriend, Lauren Pesce, and entered his guilty plea as expected. During the hearing, the judge approved Sitch to travel to Florida to shoot a "Jersey Shore" reunion.

Situation, however, faces up to 5 years in prison and up to a $250k fine. He'll be sentenced April 25. He initially entered a not guilty plea and faced up to 15 years in prison. But as we reported ... the U.S. Attorney's Office filed docs informing the judge it had struck plea agreements with Mike and his brother.

We broke the story ... Mike allegedly failed to pay his full tax bill on nearly $9 million in earnings made between 2010 and 2012.

Naya Rivera Police Photos of Husband's Alleged Injuries

Naya Rivera doesn't pack a punch ... at least that's the way it seems from police pics of her estranged husband.

As we reported, Naya was arrested Thanksgiving weekend after allegedly attacking Ryan Dorsey in West Virginia ... over an argument involving their child.

Ryan told cops Naya struck him in the middle of his lower lip and the back right side of his head, but the pics don't show any real injuries.

Naya, who has since filed for divorce, told cops she had been emotional because of her menstrual cycle.

Charges against Naya were dropped this week after Dorsey said he did not want to press charges.

Kodak Black Arrested in Florida Hit With 7 Charges

Kodak Black was just arrested in Florida on a slew of charges including grand theft of firearm, possession of marijuana and neglecting a child.

Details of the arrest are currently unclear, but the rapper was hit with 7 charges in total.

-Grand theft of firearm.

-2 charges of possession of weapon or ammo by a felon.

-Possession of marijuana over 20 grams.

-Neglect child without great bodily harm.

-2 probation violation charges.

Kodak has had numerous run-ins with the cops over the years ... he was released from jail back in June after serving 97 days of a 364-day sentence. Black's early release stemmed from the completion of a voluntary life skills course behind bars.

Kodak's in the middle of serving a one year house arrest sentence where he needed permission from his probation officer and the court before traveling anywhere. If the new charges stick, it appears he will be serving some serious time.

The rapper was also indicted on sexual conduct charges last year ... that case is ongoing.

We reached out to Kodak's attorney who had no comment.

Gianni Versace Real Crime Scene Less Chaotic ... Than Portrayed on 'American Crime Story'

Gianni Versace's crime scene wasn't nearly as chaotic as FX's 'American Crime Story' portrayed.

Carlos Noriega -- a former lieutenant in charge of the Violent Crimes Unit for Miami Beach PD -- tells us he was the 4th person to arrive on the scene back in 1997.

He says contrary to what 'ACS' portrayed on Wednesday night's premiere episode, a tourist did NOT sneak past an officer to dip a Versace magazine ad into his fresh blood ... and then get off scot-free. Noriega says that would never happen ... and, frankly, couldn't have.

Instead of taping off a tiny perimeter around the crime scene like 'ACS' depicts, Noriega says cops taped off a much wider area around Ocean Blvd. -- and any people standing around were quite far away. He also says there weren't that many spectators on day 1.

FX had a disclaimer on the show telling viewers the series was based on true events, but that some of their depictions were "combined or imagined for dramatic and interpretive purposes."

BTW ... the whole magazine ad thing was reported in a Newsweek article back then -- an account that was never confirmed.
