Homeless Man Shot and Killed by O.C. Sheriffs ... After Violent Confrontation

Two Orange County Sheriff's Deputies got into a physical confrontation with a homeless man who allegedly went after one of the deputies' guns. The homeless man was shot and killed, and it was all caught on video.

The incident went down Wednesday afternoon in San Clemente, in front of the Hotel Miramar. Cops were called after witnesses said they saw the homeless man walking in the middle of the street into oncoming traffic. Witnesses said cars honked and swerved to avoid hitting him.

According to the Orange County Sheriff's Department, when deputies from the homeless outreach team arrived, they got into a tense, physical confrontation with the man. As you see in the video ... the man appears to push the deputies. A physical encounter ensues and you can hear a deputy say, "He's got my gun" -- suddenly, 2 shots are fired.

The deputies performed CPR on the man, who died at the scene. The Sheriff's Department says surveillance video clearly shows the man trying to grab a deputy's gun.

The Dept. is investigating.

Vanessa Bryant Against Venue Change in Helicopter Suit ... Kobe Is Loved Everywhere

"There is no county line at which Kobe Bryant’s celebrity suddenly evaporates."

That's Vanessa Bryant's key argument as to why the court should REJECT a requested venue change in her wrongful death lawsuit -- claiming Kobe's legacy expands way beyond L.A.

As we previously reported, Island Express Helicopters and the estate for pilot Ara Zobayan had asked the court to move the case from L.A. to Orange County, arguing they couldn't get a fair trial in the city where the Lakers star played NBA ball for 20 years.

Now, Vanessa is firing back ... saying she lawfully selected L.A. as her venue because that's where the January 26th helicopter crash occurred -- and she's digging in her heels to keep it there.

Not only does Vanessa point out the Bryants have lived in Orange County for nearly 20 years and Kobe's "popularity there is just as strong as anywhere else" -- but she also claims it really doesn't matter where you go, Kobe is beloved all over the U.S.

"Defendant fails to acknowledge the extent to which Kobe Bryant’s legacy penetrates American culture," Vanessa's attorney states in new court docs obtained by TMZ Sports.

"There is no county line at which Kobe Bryant’s celebrity suddenly evaporates. Public esteem for Kobe Bryant is a fact of American life."

Vanessa is right about Kobe's popularity -- when he passed away back in January, tributes poured in from all over the world ... including Italy and Japan.

A massive Kobe mural even went up in Gradiška, Bosnia and Herzegovina!

As for the venue change, that's now up to a judge to decide.

Heidi Montag and Spencer Pratt are huge fans of Mischa Barton ... 'cause they say it's basically divine intervention she's joining them on the reboot of "The Hills."

We got Heidi and Spencer shopping Thursday at Couture Kids on Robertson and asked them about their newest cast member ... and Spencer says he's been praying for Mischa's presence for a loooong time.

It's interesting ... Heidi and Spencer say they never crossed paths with Mischa on the Hollywood party circuit. So, they can't wait to get started working with her on "The Hills: New Beginnings."

As for Mischa ... we got her Wednesday at Craig's in WeHo and she looked thrilled to be crossing over into reality TV.

For those bashing Mischa's career path, save it -- Spencer ain't havin' it!

OC Reunion Show At Parc?

The cast of "The OC" had a mini-reunion Saturday, with Adam Brody, Benjamin McKenzie and his on-screen, six-episode girlfriend Sadie aka Nikki Reed, all partying at Parc. While McKenzie was flying solo, Reed showed up with "Road Trip" star DJ Qualls, and Brody was spotted hanging out with singer Gavin DeGraw.

"Grindhouse" babe Rosario Dawson hit up Teddy's with one of the film's faux-trailer directors, Eli Roth, on Friday and while both saved a paparazzo from crashing into an R2-D2 mailbox, they remained quiet when asked about the rumored on-set romance between Robert Rodriguez and Rose McGowan.

Mr. Chow was also a hotspot over the weekend, with rehab graduates Brandon "Greasy Bear" Davis and Courtney Love stopping in (separately, relax!), along with visits from will.i.am and an autograph-gracious Anne Hathaway.

Orange Crushed -- FOX Cancels "The OC"

Like you didn't see this one coming down the 405?

After killing off their most famous character, turning Summer into a hippie, and forcing Ryan to fight just about everybody who looked at him the wrong way, the folks behind "The OC" have finally thrown in the beach towel.

"This feels like the best time to bring the show to its close," said Josh Schwartz, the show's creator and executive producer. According to FOX, on February 22 the struggling series will ride off into the California sunset one last time.

"The OC" was an overnight sensation when it first debuted in 2003. But darker plotlines led to a departure from what the show did best -- lighthearted comedy mixed with teen angst -- culminating in the death of Mischa Barton's character last season, and now the death of the series.

Since her character was killed off on the season finale of "The O.C." you probably won't be seeing Mischa Barton on the show anymore -- unless it was all a dream or her evil twin surfaces -- but you can still smell like her.

The hit teen melodrama has spawned a fragrance line called, appropriately enough, The O.C. for Her and The O.C. for Him.

The O.C. for Her has a fruity, floral scent perfect for the sexy girl next door who enjoys drunken benders in Tijuana or shooting her boyfriend's brother in the back.

With its aroma of amber and musk, The O.C. for Him is the must have cologne for the sensitive hipster who fakes their way into Brown or burns down a model home.

How to Save 'The OC'

With word coming down that FOX cut the episode order for "The OC" from 22 to 16 (and cancellation now looming heavily), we here at TMZ got to wondering: Are things so desperate that it's time to try and bring back Mischa Barton? How would they even do such a thing?

Here are a few ideas:

It was all a ... well, you know

But whose dream is it? Ryan's? Marissa's? Sandy's? Nope. It would be Ryan's brother Trey's dream.

Let's just assume Trey was in a coma after Marissa shot him at the end of season two. While in the coma, he has this dream about what would happen after he wakes up. He creates all this heartache for Marissa and even has her end up with another bad boy (Volchok). The fact that the bad boy relationship leads to Marissa dying makes Trey realize things never would have worked between them.

Rachel Bilson A TMZ Fan?

"Oh no... YOU guys!" said "The OC" star when TMZ ace cameraman Josh Levine caught up with her last night at a benefit for the LA Mission.

We were able to steal a moment from Miss Bilson were she touched on Father's Day, lamenting that she doesn't know what to get her dad, that her iPod is filled with Kelis (a guilty pleasure of hers) and that her cell ringtone is music from The Shins. Interestingly, in the middle of her interview Rachel stopped to check out boyfriend Adam Brody pose for photos on carpet, commenting "he's stealing my limelight!"

You'll be happy to know she did get a free TMZ t-shirt out of the deal.
