9:20 AM PT -- Gunplay tells TMZ, the first thing he's going to do now that the case is dismissed ... is roll a fat joint ... oh yeah, then spend time with his "loved ones."

He tells us, "Today I am grateful and blessed that the case was dismissed ... I plan on picking up where I left off with my music and making hits with my upcoming debut album ... The first thing I am going to do today is smoke a joint, relax, play video games, and just be with my loved ones."

Rapper Gunplay is officially off the hook for robbing his accountant at gunpoint ... despite damning surveillance video that captured the whole incident ... all because the victim refuses to cooperate with authorities, TMZ has learned.

The Miami-Dade State Attorney's Office tells TMZ, "Video alone is not enough to convict an individual of a crime beyond a reasonable doubt." The office continues, "Although the armed robbery is captured on the victim's surveillance system, the victim, Turron Woodside, is uncooperative of the prosecution of this defendant Richard Morales [Gunplay]."

Officials say they need Woodside to authenticate the footage so they can use it as evidence against Gunplay, who was accused of pulling a gun on Woodside and stealing a cell phone and gold chain during the incident last fall.

Gunplay was charged with armed robbery and aggravated assault.

The State Attorney's Office says the judge subpoenaed Woodside but prosecutors were unable to find him in order to serve him. Officials say Woodside's family and co-workers have told the court "he's out of town and/or coping with a family death" along with other excuses.

The judge made it clear ... without Woodside's testimony, prosecutors couldn't make their case, and they were forced to drop the charges.

Gunplay tells TMZ ... he's extremely excited to be out of jail and on house arrest -- where he can actually have sex with other people ... instead of being stuck with his right hand.

Gunplay -- a rapper who's signed to Def Jam-- was released from jail on $150,000 bond and placed on house arrest stemming from an April 13 incident in which he allegedly attacked and robbed his accountant in Florida.

"Being on house arrest really is a blessing for me," Gunplay tells us ... "This has helped me slow down and not want to do negative things anymore."

He adds, "This is a life-changing eye-opener for me that I need to just slow down and do right."

Gunplay -- who's still facing charges of aggravated assault and armed robbery with a firearm -- says he's passing the time by working on his album, playing video games and bangin' chicks ... which is a HUGE change from how he entertained himself while he was behind bars.

"One main difference from house arrest instead of jail is that I can still get sex ... which is a wonderful thing. Although in jail I was still f**king Corporal Mary Palmer and her five sisters."

Corporal Mary Palmer could not be reached for comment. Ditto for her five sisters.

101212_gunplay_launchRapper Gunplay PULLED A FIREARM on his accountant during a meeting in April in an explosive fit of rage ... and the entire incident was captured by surveillance cameras. 

Gunplay allegedly stole a cell phone and a gold chain during the incident ... and was later charged with armed robbery. He turned himself in to Miami-Dade Police earlier this week.

Gunplay -- real name Richard Morales Jr. -- also faces a second charge of aggravated assault with a firearm.

According to the rapper's attorney, Gunplay could face life in prison if convicted on both counts.

Turns Himself In to Jail
On Robbery Charge

Rick Ross protégé Gunplay turned himself in to a Miami jail moments ago after a warrant was issued for his arrest, stemming from an armed robbery -- Gunplay's attorney tells TMZ.

The warrant was issued in May, listing "robbery" as the offense. No other details about the alleged offense are listed.

Gunplay's attorney Mike Grieco tells us, "Gunplay voluntarily surrendered today without incident. There's been an open arrest warrant for armed robbery with a firearm."

You'll recall, Gunplay was involved in a massive brawl with 50 Cent and his crew two weeks ago. The two incidents are completely unrelated.

A rep for Gunplay tells TMZ, the rapper was advised to turn himself in by his attorney following the highly-publicized brawl, which likely drew police attention to the active warrant.

A video has surfaced showing rapper Gunplay getting his head slammed into a metal barricade outside the BET Awards Sunday night in Atlanta -- and it appears 50 Cent was part of the violent mob.

The clip shows 50 in the parking lot with his crew -- and out of nowhere, a massive brawl breaks out ... with rapper Gunplay on the receiving end of a ferocious attack.

Gunplay weathered the initial onslaught and managed to fight back, even though he was largely outnumbered.

It's hard to see in the shaky footage if 50 threw a punch -- or got involved at all -- but someone can be heard on camera saying, "That was 50 fighting too!" Gunplay called in to TMZ Live Monday, saying 50 Cent was involved in the action ... but was "hiding behind security."

We reached out to 50 for comment, so far no word back -- but G-Unit rapper Mike Knox (who appears in the clip) said in a radio interview this morning, "The only thing I can tell you is [Gunplay] was in the wrong place at the wrong time and he was acting a certain kinda way that he shouldn't have been actin' ... So, he got dealt with ... He got his ass kicked."

says he absolutely DID NOT fire a gun at the BET Awards ... but claims he DID beat up a member of 50 Cent's entourage ... and says he wants to "kill" everyone in the G-Unit crew. 

Gunplay -- a rapper who's signed to Def Jam -- just called in to TMZ Live to talk about the madness at the BET Awards in Atlanta on Saturday ... where multiple fights broke out behind the scenes.

Gunplay tells us ... he "had to fight off five dudes" who he believes were members of 50 Cent's camp.

Gunplay says things got violent with 50's group because, "I never liked them and always wanted to kick his ass ... and I finally got the opportunity."

The rapper says 50 Cent WAS involved in the action ... but was "hiding behind security." Gunplay says he was trying to "break his f*ckin' neck."

Gunplay says he did manage to beat down one of the guys in 50's entourage -- "kicked one of their fat-asses ... kicked them off in the dirt." Gunplay says cops then rushed in and sprayed him with mase.

Gunplay -- who's friends with Rick Ross -- says his fight had nothing to do with Rick's altercation with Young Jeezy's crew at the BET Awards ... but explains, "We just goin' at it with everybody ... let's go kill 'em all."

Doesn't sound like he was joking ... Gunplay told us, "If you're playin' with me, you're playin' with fire ... might get gunned down, ya never know."
