Heather Locklear surfaced for the first time since her 911 emergency two weeks ago, and she says she's feeling fine.

Freelance photogs talked to her in the San Fernando Valley Tuesday. One photog asked if she had a problem with alcohol and prescription drugs. Heather was mum. 

TMZ broke the story ... Heather was rushed to the hospital after her sister called 911 because Heather had taken a dangerous mixture of prescription drugs and alcohol.

As we first reported, Heather's family is trying to get her into a treatment facility, but she's having none of it.

By the way, she's not wearing makeup, and she looks great.

A smiling Jack Wagner left a gym this morning as a photog asked about his blowout fight with Heather Locklear ... but Jack wasn't talking.

It's the first time we've seen Wagner since the fight in December -- a fight that got so bad the cops were called.  As we first reported, both Jack and Heather have a date with prosecutors in a few weeks, to determine if the matter should be dropped or if misdemeanor battery charges should be filed.

The photog from the agency that shot the video asked if he thought Heather needed professional help.  We know her family thinks she does, but so far Heather is ensconced at home with no intention of seeking treatment.

Heather Locklear and Jack Wagner have been ordered to appear at the L.A. City Attorney's Office for a hearing ... which will determine if either or both get charged with criminal battery after a blow-out fight.

Law enforcement sources tell TMZ ... the LAPD has prepared a file on the fight between Heather and Jack that occurred in late December at Jack's San Fernando Valley home. We're told cops were called to the home after Heather and Jack allegedly got physical with each other during a heated argument. As one law enforcement source said, "She lost it on him and he retaliated."

When cops arrived ... neither Heather nor Jack wanted to press charges ... but the file was still sent over to the City Attorney for review.

Heather and Jack now must go to an office hearing ... an informal talk in which prosecutors hear out both sides and then decide if the matter should be dropped or prosecuted. We're told the hearing will be held by the end of the month.

The City Attorney could decide to file misdemeanor battery charges against Heather, Jack or both, but our sources say it's almost certain the matter will be dropped after the hearing.

Heather Locklear is digging in her heels ... continuing to defy family members who are pleading with her to check into a rehab program.

Sources tell us Heather is recovering at home after a dangerous mixture of prescription pills and booze landed her in the ICU last week with intense stomach pains.  But family ... including Heather's parents ... are still pushing for her to get professional help.

As TMZ first reported -- Heather's family is pushing for her to get treatment at UCLA Medical Center.

So far, Heather's not budging.

TMZ has obtained the 911 call placed January 12 by Heather Locklear's sister ... the tape is heavily redacted because of patient confidentiality, but TMZ has learned the nature of the emergency.

Law enforcement sources tell TMZ ... Heather's sister told the dispatcher Heather was having intense stomach pains and was in severe distress.  When paramedics arrived they performed some tests and quickly decided her condition was so serious Heather needed to be transported to a hospital and placed in ICU immediately.

It's her second drug-related emergency in the last couple years -- Heather was hospitalized back in 2008 for what the 911 operator described as a "suicide attempt" ... after her doctor became concerned Heather may have OD'd on prescription pills. It turned out to be a false alarm.

Heather Locklear is out of the hospital, but we've learned her family wants her back in -- at UCLA Hospital.

As we first reported, Heather went to rehab last October in her battle with prescription drug addiction ... and it wasn't her first time.

Sources tell us the family wants her in a hospital setting this time around -- not a boutique rehab place -- and UCLA has one of the best facilities in the country.

You may recall, Lindsay Lohan spent time at UCLA's Stewart and Lynn Reskick Neuropsychiatric Hospital in August 2010, but she was released early.

As of yesterday, we're told Heather did not want to go to rehab again ... period.

Heather Locklear has been discharged from the hospital where she was being treated in the ICU ... this according to a hospital spokesperson.

According to the spokesperson, Heather was released to the care of her family around 5PM this afternoon after doctors decided she was in good enough shape to be sent home.

The spokesperson claims Heather was in good spirits upon her discharge -- smiling and talkative.

TMZ broke the story ... Heather was hospitalized yesterday after downing a dangerous combination of alcohol and drugs. The hospital spokesperson has said it was NOT a suicide attempt.

Heather Locklear's family wants her to check in to a medical rehab facility as soon as she's released from the hospital ... but Heather is resisting ... TMZ has learned.

Sources directly connected with Heather's family tell TMZ ... yesterday was not an isolated incident.  Heather has been struggling with prescription drugs for a long time.  In fact, sources say Heather checked in to an L.A. area rehab facility last October and stayed 2 weeks.

We're told Heather's family wants her to go to a medical facility this time around -- not a rehab center.

But so far ... Heather is resisting.

As we first reported, Heather's sister called 911 Thursday just after 2 PM PT and said she had taken a dangerous mixture of prescription drugs and alcohol.  She was hospitalized in serious condition. 

Heather is currently in the ICU of the hospital in stable condition -- and earlier today, she got a visit from her sister.

Heather Locklear is currently being treated in an intensive care unit -- this according to a spokesperson for the hospital where Heather is staying.

According to the spokesperson, Heather is in good condition and she is medically stable. Heather is currently getting one-on-one care.

According to the spokesperson, she is not currently receiving visitors. Heather is currently being clinically evaluated and will continuously be throughout the day.

The spokesperson said Heather was brought in yesterday in "serious condition" -- and as of now, the time and date of Heather's discharge is unknown.


3:10 PM PST -- The spokeserson just made another announcement, claiming Heather has been upgraded to "good" condition ... but is still in the ICU. According to the spokesperson, Heather has been spending most of the day sleeping, but when she was awake, the actress was "chatty."

The spokesperson claimed Heather was in an "agitated" state upon her arrival to the hospital -- and she "was not speaking in coherent terms."

The spokesperson insisted the situation was NOT a suicide attempt.

8:00 PM PT: A hospital spokesperson tells TMZ, Heather was awake and responsive when she arrived today -- and she is currently responding well to treatment. According to the spokesperson, Heather is doing much better now and doctors are hopeful she will be released tomorrow.

We're also told Heather's parents are currently with the actress inside the hospital.

Heather Locklear was taken to the hospital by ambulance Thursday afternoon after taking a dangerous mix of prescription drugs and alcohol ... law enforcement sources tell TMZ.

We've learned ... Locklear's sister called 911 at 2:05 PM PT fearing Heather was in danger.

The fire department, along with the Ventura County Sheriff's Department responded. Paramedics examined Heather and determined she needed to be hospitalized.

This is not the first time Locklear has had a medical emergency where 911 responded. In 2008, her doctor was concerned she may have overdosed on prescription meds. He called 911 and the operator described the situation as a "suicide attempt." It turned out to be a false alarm.

Locklear recently called off her engagement to Jack Wagner.

Heather was at the Lakers game Tuesday night ... hanging with a friend, who was playfully trying to take away her beverage. It's unclear if the drink contained alcohol.
