Decked out in an Amish man's hat, a librarian's cardigan, a red satin nightgown and a pair of open-toed brown hoof heels, Suri Cruise's mother Katie Holmes looked like she was late for class holding a binder and two thermoses in Manhattan on Tuesday.

Suri should really school her on fashion.

Katie Holmes' driver was pulled over yesterday in Beverly Hills -- with Katie inside -- but the driver was able to escape with just a warning ... TMZ has learned.

Law enforcement sources tell TMZ the driver was spotted doing a major no-no ... driving while talking on his cell phone. But when cops pulled them over (the black Mercedes, pictured above), we're told the driver escaped without getting ticketed.

Maybe the cop was a big "Dawson's Creek" fan?

Cops swarmed Tom Cruise and Katie Holmes' block in Beverly Hills yesterday -- armed with a full arsenal of heavy artillery, including assault rifles -- and we're told ... it was all over some missing tools.

Law enforcement sources tell TMZ, cops were called for an alleged burglary at a nearby construction site -- on the same block as T&K -- and police descended in full force.

We're told cops paid a visit to the surrounding homes -- including the Cruises' -- but came up empty.

It's unclear how much was stolen in the heist -- or whether Tom and Katie were home at the time of the search.

Tom Cruise really put the squeeze on his wife Katie Holmes last weekend in L.A. -- copping a SNEAKY feel of her ass at a Katy Perry concert -- and TMZ has obtained the hands-on footage.

Katie got the pat-down Sunday night at Nokia Theater -- and we're told, Tom's hand remained steadfast for most of KP's performance.

Side note: never invite Tom and Katie to your party ... we're told the couple's entrance delayed the concert a solid 15 minutes.

And watch closely -- standing next to the touchy-feely couple is none other than Katy Perry's hubby ... Russell Brand. What a handful.

Star Magazine just issued a MASSIVE mea culpa to Katie Holmes -- publishing an apology on the COVER of its latest issue ... after the tabloid printed a headline suggesting Katie was a drug addict.


Katie filed a $50 million defamation lawsuit against the magazine last month, claiming Star's January headline -- "ADDICTION NIGHTMARE! Katie DRUG SHOCKER! -- was "untrue, unethical and unlawful."



Katie's rep tells TMZ, the lawsuit is now water under the bridge ... that it's been settled ... and Star's publisher American Media even made a "substantial" donation to Katie's charity.

As for Star's in-mag apology -- it reads in part, “Star did not intend to suggest that Ms. Holmes was a drug addict or was undergoing treatment for a drug addiction.  Star apologizes to Ms. Holmes for any misperception ..."

Katie released her own statement today, saying, “I’m pleased that this lawsuit could be resolved amicably and accept American Media’s apology.”

Little 4-year-old Suri Cruise is living the life of someone 7 times her age -- watching plays, making late night meal runs ... and of course, snacking on Gummie Penises. Ahh ... to be young again.

Katie Holmes just filed a $50 million libel lawsuit against the publishers of “Star” magazine after a recent cover insinuated she's a drug addict.



The centerpiece of the lawsuit is the headline, “ADDICTION NIGHTMARE - Katie DRUG SHOCKER! – The Real Reason She Can’t Leave Tom”  -- while the actual article does NOT allege any drug use by Katie we’re told she feels the suggestive cover is deliberately defamatory and is libelous on its own.

The lawsuit states, "[Katie] has no intention of leaving her husband, and is not prevented from doing so by any drug addiction."

Holmes' attorney tells TMZ, "Star Magazine's malicious claims about Katie are untrue, unethical and unlawful.  Not only do they cruelly defame Katie, they play a cheap trick on the public, making ridiculously false claims on the cover unsupported by anything inside."

And, the attorney adds, "Someone should bring a class action to get all buyers their money back."

Holmes is seeking $50 million in damages from American Media Inc.

Tom Cruise, Kelly Ripa and Gwyneth Paltrow could have been spinning in their graves ...  because TMZ has learned, the locker room in their NYC gym just got shut down over safety concerns.


City inspectors issued a vacate order this afternoon for the basement of the SoulCycle spinning gym in Union Square due to "hazardous conditions."

According to the order, the cellar has no functioning secondary means of exit ... and also fails to meet the building's fire code -- two serious violations.

The City also tells us, SoulCycle has been operating without several required permits -- including operating as a gym without proper City approval.

Suri Cruise is growing up with a very unique friend born around the same time as her ... and while TMZ's not nearly as cute as Tom Cruise and Katie Holmes' little girl -- we've got the gift of song.
