Tom Sizemore just won a gargantuan victory in court ... not only did his lawyer prove he did NOT violate his probation, the judge actually ended Tom's probation more than a year early, because he's doing so well.
Tom was arrested last month because neither he nor his lawyer presented timely proof that he completed his community service in Tom's battery case.
But today ... Tom's new lawyer,
Kent Schaffer, went back to the judge and explained that the old lawyer just dropped the ball, and that Tom had completed all of his community service, and then some.
So the judge praised Tom, and then terminated probation a year and a half early.
Tom Sizemore tells TMZ ... he was arrested last night because a guy he barely knows stole a car -- and cops followed the trail right back to him.
According to Tom, the car jacker was a friend of a friend -- and when the guy got arrested recently ... he told cops he lived at the address where Tom resides.
As
we previously reported, police came a-knockin' soon after -- ran Tom's license and discovered he had an outstanding battery warrant ... so they arrested him.
Tom tells us, the warrant is the result of a clerical error -- claiming someone at the courthouse failed to log his community service hours stemming from the actor's 2009
spousal battery arrest.
There's an explanation for everything ... right?

Tom Sizemore is back in a familiar spot this morning -- a jail cell ... after getting busted for a battery warrant.
Law enforcement sources tell us Sizemore was arrested by LAPD officers last night while they were conducting a narcotics investigation at an apartment. It was not Sizemore's apartment.
We're told Sizemore did not have any drugs on him, but police did discover he had an outstanding warrant for misdemeanor battery ... and arrested him.
He is currently in jail ... held on $26,000 bail.
Megan Wren, the missing girlfriend of actor
Tom Sizemore, has been found ... TMZ has learned.

Wren had been missing since March 31 -- and, as TMZ first reported, Sizemore was
questioned by law enforcement as part of the investigation into her disappearance.
We're told Wren is with her father at the moment.
Sizemore tells TMZ, "I am relived and happy Megan is safe and sound. It is unfortunate that she did not come forward immediately as this has caused me a lot of concern. However, I am pleased no harm has come to Megan and I wish her and her family the best and I am putting this matter behind me."
Sizemore's manager tells TMZ the Tom and the girl were never together romantically, they were just neighbors.
Tom Sizemore's girlfriend went missing over a month ago -- and TMZ has learned, the actor was recently questioned in connection with the case.

Law enforcement sources tell TMZ, there is an active investigation into the disappearance of 25-year-old
Megan Wren -- who had been living with Sizemore for six months prior to her disappearance on March 31st.
Law enforcement sources confirm ... Tom was questioned recently and has "been very cooperative" -- but they wouldn't comment on whether he was considered a suspect.
According to law enforcement, multiple witnesses claim Megan was last seen with Sizemore.
We spoke to one of Megan's family members -- who told us, she last spoke with Megan about a month ago ... and she "sounded like she was in a bad place."
We're told the family has made several attempts to reach out to Sizemore for help -- but he's been blowing them off. Calls to Sizemore weren't returned.
Tom Sizemore's baby mama claims the troubled actor beat her so badly last month that her "ear started bleeding" ... this according to the request for a restraining order she just filed against him.

In the docs, filed on June 30 in L.A. County Superior Court,
Jinele McIntire -- the mother of Tom's two children -- claims Tom invited her over to his home on June 22 to chat about their children and
his child support problems ... when all hell broke loose.
Jinele claims after she went to the bathroom, Tom suddenly "punched me in the face and head repeatedly. My ear started bleeding." Jinele claims Tom then "punched me in the stomach with such great force, it took my breath away."
Jinele also claims Tom "threw a long knife (it looked like a kitchen knife) on the floor of the bathroom." The temporary restraining order was granted by the judge the day it was filed.
A rep for Tom tells TMZ the allegations are "100% untrue" and were "completely fabricated and made in the attempt to discredit Tom Sizemore ... because [Jinele] thought Tom was plotting to take the children."
Tom Sizemore's ex-girlfriend says the actor knocked her up with twins then left the three of 'em to fend for themselves -- because he allegedly bailed on a massive amount of child support.
According to a lawsuit filed last week in L.A. Superior Court, Sizemore owes babymama
Jinele McIntire $58,800 in child support for the couple's two boys, who were born in 2005.
In the first line of the lawsuit, Jinele makes her point clear, "TOM SIZEMORE is a
DEAD BEAT DAD."
Jinele says because of Tom's non-payment, she's been forced to live with a friend while the kids stay with her brother in Texas. She adds Sizemore "has made no attempt to see them there."
Jinele also claims Tom last saw the boys when he was taping "
Sober House" -- a gig Jinele says paid $200,000. She also claims Tom made another $200,000 for "
Celebrity Rehab."
Besides the overdue child support, McIntire is also seeking health insurance coverage for the kids and $50,000 for attorney's fees.
Tom Sizemore has been charged with one count of spousal battery over an allegedly violent incident with his girlfriend earlier this month.
As TMZ first reported, the former "
Saving Private Ryan" actor was arrested in L.A. on August 6th after a verbal argument allegedly turned physical and someone called 911.
If Sizemore is found guilty of the misdemeanor charge, he could do up to a year in jail and face a maximum $2,000 fine.

TMZ has learned the former "
Black Hawk Down" star was arrested in L.A. late last night after an argument with a woman allegedly became physical.
Sizemore was taken into custody and booked for misdemeanor domestic violence. His bail was set at $20,000.
As of now, he's still in custody.
Tom is no stranger to domestic violence -- back in 2003 he was convicted of hitting then-girlfriend
Heidi Fleiss.

Tom Sizemore, who
was arrested early Thursday morning on an outstanding warrant, checked into Dr. Drew's house on Friday to begin taping the third season of the show.
Making the addition of Sizemore particularly interesting is that one of his fellow castmates is
Heidi Fleiss -- Sizemore's ex-girlfriend whom he was convicted of assaulting back in 2003. Awk-ward!
We're told Fleiss didn't take too kindly to Sizemore appearing on the show, and she didn't come out of her room for sometime after he showed up.
