Brooke Mueller checked into a sober living facility yesterday in Los Angeles ... sources tell TMZ.

Sources close to Mueller tell TMZ it was Kathy Hilton who took her to the sober living house.
We're told Mueller made the decision herself, telling people close to her she "felt weak" and thought she needed professional counseling. According to our sources ... her two kids with
Charlie Sheen, are currently staying with Mueller's parents.
As TMZ first reported, Mueller
spent Thanksgiving in a sober living facility after what sources called a night of heavy partying in a Los Angeles hotel.
Mueller's lawyer,
Yale Galanter, tells TMZ Brooke did indeed check into the sober living house, and insists she did not have a relapse and is free to come and go as she pleases.
Galanter says she is doing it to "maintain her health."
Brooke Mueller spent a lovely evening at Dan Tana's steakhouse in West Hollywood last night, looking a lot better than she did on Thanksgiving morning.

As TMZ first reported,
a disheveled Mueller (
below) left the
Farmer's Daughter Hotel in L.A. Thursday at around 10:00 AM and was escorted to a sober living facility in Bev Hills.
Brooke's lawyer,
Yale Galanter, told TMZ she was at the hotel to shoot something for her reality show. Galanter acknowledged a rep from the sober living facility is in the picture TMZ posted and that she went to the sober house after leaving the hotel, but says it was all part of her ongoing treatment.
Brooke went to Dan Tana's with
Rick and
Kathy Hilton. Kathy is one of the big wigs behind the reality show which, of course, also features daughter
Paris.
New York detectives have made contact with
Charlie Sheen's rep, asking for an interview with the famous Plaza Hotel guest.

We're told detectives contacted Charlie's manager,
Mark Burg, and asked for the interview in connection with the criminal complaint filed by Capri Anderson.
Charlie's lawyer,
Yale Galanter, would not comment on whether he will make Charlie available. Galanter did tell TMZ ... after detectives reached out to Burg, he called detectives back and gave them some info on the case.
Galanter says he'll be speaking with cops again after Thanksgiving and will then make a decision on whether he, Charlie, or a combination thereof will fly to NYC for an interview.

GMA -- where he said
Capri Anderson was hired to be Charlie's "entertainment" for a night ... but not for sex.

Galanter says there "was never a sexual encounter or money exchanged for sexual acts" between Charlie and Capri on the night of the alleged incident at the
Plaza Hotel.
Mirroring
Charlie's lawsuit against Capri, Galanter also says that Capri and her lawyer said they would go on TV and "lie about what occurred that night in the Plaza" if Sheen didn't cough up a 7-figure sum.
He says that he's "confident" the NYPD will see Capri's claims as a "complete shakedown."
TMZ has learned ...
Charlie Sheen is not formally checking into his rehab facility today to fulfill his 30-day jail sentence ... because, in effect, he's been completing the terms of that sentence for weeks.

TMZ broke the story ... Charlie
plea bargained his domestic violence case in Aspen earlier this month ... and agreed to a 30-day jail sentence. But under the terms, engineered by attorney
Yale Galanter, Promises rehab facility in Malibu is responsible for
administering the sentence -- in other words, the time served is at Promises and not in jail.
We've learned ... although the plan was for Charlie to formally check into Promises today for his sentence, that's not going to happen. We're told the way Promises sees it ... Charlie has been getting aftercare for months, sometimes even sleeping at the facility.
There will be no formal check-in. As one source says, "It's an ongoing process for Charlie." We're told when the case is back in court in November, Charlie will be able to show he's completed the 30-day sentence many times over.
There will be three more seasons of "Lost," and most likely, three more "Spider-Man" movies. But here at the Z List, we're much more intrigued by the fact that Eddie Murphy is
now working on a big screen version of "Fantasy Island" -- with the screenwriters responsible for "Norbit." Da Pain! Da Pain!

Tom Sizemore: The actor was in Bakersfield, CA to film the low-budget "American Graffiti" knockoff "American Son," and he decided to take a detour on Tuesday for a lost episode of his VH1 reality TV series, "Shooting Sizemore." After film co-star and parolee Jason Salcido
challenged a hotel desk clerk to a fight, Sizemore was caught allegedly in possession of two small bags of crystal meth and a smoking pipe, leading to an on-location booking scene at the downtown slammer.
