UPDATE: 7:16 PM ET We just got the papers Mel's lawyer filed with the court, in which he said Mel believes he "cannot have a fair and impartial trial or hearing before Judge Ongkeko." The case has now been removed to Judge Frederick Shaller, but expect the whole case to be handled by a "private judge" -- and that should happen soon.
Mel Gibson already has issues with his divorce -- at least his lawyer does.
We've learned ... Bob Kaufman, Mel's attorney, filed legal papers yesterday to boot the judge from the case -- Hon. Rafael Ongkeko. Each side is entitled to ding a judge from hearing the case, but that can only be done in the first 10 days. Your move Laura Wasser.
Here's the reality. The chances that a judge in the L.A. County Courthouse will actually hear Mel's divorce case are slim to none. That's because both Kaufman and Wasser almost always get a "private" judge to hear their high-profile cases, away from the public glare.

Mel Gibson has filed his response to wife Robyn's divorce petition -- and it only took a matter of hours.

Gibson, unlike his wife, gives a specific date of separation -- the papers say the date is August 26, 2006. The date is hugely significant -- Mel's infamous DUI arrest was less than a month earlier -- July 28, 2006. Gibson cited irreconcilable differences.
As we reported, Robyn and Mel grew apart after the arrest. The date Gibson lists for separation confirms this.
Gibson also lists "irreconcilable differences" as the reason for the divorce.
Gibson is repped by prominent divorce lawyer Robert Kaufman, whose celeb clients include Jennifer Aniston, Jessica Simpson and Reese Witherspoon.

We've learned Mel Gibson's wife Robyn has just filed legal papers to divorce Mel Gibson, her husband of 28 years, citing "irreconcilable differences." Pretty ironic -- Robyn signed the papers the day before Good Friday.

Sources tell us there is no prenuptial agreement -- they were married in 1980, before Mel Gibson amassed a fortune estimated at $900 million back in 2006. Under the laws of California, community property -- which includes earnings -- is divided 50/50.
The Gibsons have 7 children, but only one -- Tom, who turns 10 tomorrow -- is a minor. In Robyn's legal papers, filed this morning in L.A. County Superior Court, she seeks joint physical and legal custody of Tom.
Robyn is also asking for spousal support and attorneys fees.
Robyn lists the date of separation as "to be determined." This is important, because earnings generally cease to be community property when the couple separates. There could be a skirmish over this. We're told the couple grew increasingly apart over the last few years, especially since Mel's drunk driving arrest in 2006.
There have been reports that Mel has been involved with another woman, which the actor denies, but we're told the reasons for the divorce go beyond any third party.
If there is a fight, Robyn is in good hands -- she's repped by disso-queen Laura Wasser, who has handled divorces for the likes of Angelina Jolie, Britney Spears and Stevie Wonder.
UPDATE: Robyn and Mel Gibson just issued a statement: "Throughout our marriage and separation we have always strived to maintain the privacy and integrity of our family and will continue to do so."
Sources tell TMZ the couple has been separated for more than 2 1/2 years. We'll see if Robyn agrees. Again, the separation date is important in dividing assets.

Bill Murray isn't the only Murray who gets lit and lets it out on the kids -- allegedly.
Murray's wife Jennifer Butler-Murray was pinched by the po-po in South Carolina on March 17 after allegedly getting drunk -- and then violent with her kids, according to a report filed with the Sullivan's Island Police. A witness caught Jennifer yelling at one of the couple's kids, and the cop who cornered her wrote that she was "very impaired."
Butler-Murray's been blabbing in a divorce filing that Bill was addicted to booze and drugs, abused, abandoned, and once said she was "lucky he didn't kill her."

Bill Murray's wife says he's no joke -- she's filed for divorce, alleging he's a sex and drug addict, he abandoned her, cheated and physically abused her.

Jennifer Butler Murray, Bill's wife of ten years, filed court documents on May 12 in a Charleston, S.C. family court. The couple has a home in the area.
In documents obtained by the Charleston Post & Courier, Jennifer is asking a judge to issue a restraining order that will keep Bill away from her home.
According to court docs, Jennifer and the couple's four children moved out of the family home in 2006 because of what she says was her husband's "adultery, addiction to marijuana and alcohol, abusive behavior, physical abuse, sexual addictions and frequent abandonment." The docs also say the star "hit his wife in the face and then told her she was 'lucky he didn't kill her' " and that this happened more than once during their marriage. Holy Groundhog Day!
UPDATE: A statement released by his lawyer says, "Bill Murray is deeply saddened by the dissolution of his marriage to Jennifer. Mr. and Mrs. Murray remain loving parents, committed to the best interests of their children. Mr. Murray asks that the public respect his family's privacy at this difficult time."

Dylan McDermott, better known as, "oh yeah, that guy," from "The Practice" and a bunch of other canceled shows, has officially pulled the plug on his marriage.

McDermott and actress wife Shiva Rose were married for nearly 12 years before separating in March of 2007. The couple, who cited irreconcilable differences for the split, has two kids together -- Dylan is asking for joint custody.

TMZ has learned that Chris Rock has begun divorce proceedings against his wife of nearly 10 years, Malaak Compton-Rock. TMZ is told that the comedian has hired a high-powered divorce attorney to represent him.
The couple, married in November of 1996, has two daughters -- 4 year-old Lola and 2 year-old Zahra. Malaak is the Founder and Executive Director of StyleWORKS; a non-profit, full-service salon that provides free services for women leaving welfare and entering the workforce.
When contacted, Rock's rep would only say "I cannot comment at this time."
Chris, best known for his stand-up comedy as well as for a controversial turn as the host of the 2005 Oscar telecast, once told NBC's Stone Phillips that marriage was "beautiful" but added, "If you're a guy, [your individual self] is dead. Get rid of you. Take yourself to the door and wave. Hey, see you later. It sounds horrible. I'm happier than I've ever been now that I've shot myself in the head."
Rock is currently in post-production for the film "I Think I Love My Wife."

TMZ has learned that Reese Witherspoon's fortune is fair game as her marriage to Ryan Phillippe comes to an end-- specifically, there is no prenup.
The financial consequences are enormous. Witherspoon now commands $20 million a movie. In 2005, Witherspoon raked in a total of $30 million for two movies, "Just Like Heaven" and "Walk the Line."
Phillippe has been commanding around $2.5 million a film, making him bankable, but clearly not in his estranged wife's league.
Under California law, without a prenup, earnings during a marriage are divided up 50/50.
Connected sources also tell TMZ on a scale of one to ten, one being a peaceful breakup and ten being Hasselhoff, the Witherspoon/Phillippe split is a three. And, we're told, it will almost certainly stay peaceful, partly because of the children and partly because of the couple's personalities.
We're told there is no talk of reconciliation and that divorce papers are merely a matter of time.

Reese Witherspoon and Ryan Phillippe have separated. The couple's rep released a statement to TMZ Monday morning that says "We are saddened to announce that Reese & Ryan have decided to formally separate. They remain committed to their family and we ask that you please respect their privacy and the safety of their children at this time."
Sources tell TMZ Witherspoon has contacted celebrity divorce lawyer Robert Kaufman, who has represented Jennifer Aniston, Roseanne and Lisa Marie Presley.
Sources say Witherspoon spoke with Kaufman about divorcing Ryan Phillippe, her husband of seven years. The couple has two children. They met at Witherspoon's 21st birthday party.
As for why Witherspoon contacted Kaufman, we're told it was not triggered by one event. Rather, one connected source says it was "cumulative."
Divorce papers have not yet been filed.

'Twin Peaks' director David Lynch filed for divorce this week, Hollywood-style.
Lynch filed to divorce wife Mary Sweeney on June 12 -- two days after the couple separated and only a month after they were married, according to the petition filed in LA County Superior Court. The timing is unusual, considering that the pair have a 14-year-old son together.
In the filing, Lynch cites "irreconcilable differences" for the divorce.
In addition to having a child together, Lynch and Sweeney also have worked together for years, with Sweeney working on Lynch projects like 'Blue Velvet' and the upcoming 'Inland Empire.'
