Chris Rock's brother Tony has been charged with drunk driving.
The Los Angeles City Attorney has filed two DUI charges -- driving under the influence and driving with a .08 blood alcohol level or higher.
After his arrest, Rock told TMZ he had been pounding Patron and then flooring it on the 101 Freeway.
Rock, also a comedian in his own right, made the stupid mistake of mocking his arrest and saying he would skip the alcohol ed course. Wrong, if he's convicted. He could also be sentenced to six months in the pokey.

Tony Rock made his second appearance in front of a TMZ camera yesterday outside a Hollywood club. The first appearance was hours before, after getting sprung from the hoosegow following an arrest for DUI the night before.
Tony had mentioned something about drinking a bottle of Patron and then flooring it on the 101. He was definitely drinking, but at least last night, he wasn't driving. Baby steps.

No joke -- on his way out of lockdown this afternoon, Tony Rock was actually crackin' jokes and braggin' about the type of liquor he chugged before getting in his car and selfishly endangering innocent people.

Tony Rock finally did something without his big brother's help -- dude got himself thrown in the clink.
The star of "The Tony Rock Project" is currently locked up in a Los Angeles cell after California Highway Patrol officers busted him for DUI around 2:40 this morning.
Rock was initially pulled over on the 101 Freeway for speeding, but cops say he showed signs of intoxication. After failing field sobriety tests, Tony was arrested and hauled off.
Tony has forked over the $5,000 bail and is about to leave.
