Big news in the Daniel Smith inquest -- the magistrate in the case will not be giving the jury the option to rule his death a homicide.

In a Bahamian court today, the parties discussed four possible options as the cause of death -- accident, "misadventure," non-dependent drug use and an "open verdict."
We're told the magistrate will instruct the jury on those options on March 31.
No one, including Virgie Arthur's lawyer, suggested that homicide was an option.
As for the options, "misadventure" is defined as "a hazardous course of action which ended fatally." An open verdict means the jury can't decide the specific cause of death.

Daniel Smith had a stunning combination of seven drugs, including multiple anti-depressants and cold medicines, in his system when he died on Sept. 10 in the Bahamas, according to toxicology reports, four more than had been previously reported. Dr. Cyril Wecht confirmed the reports Wednesday on Court TV's "Catherine Crier Live" after he was confronted with the new information by reporter Michel Bryant. According to Wecht, the son of Anna Nicole Smith had the antidepressant Amitriptyline as well as two over-the-counter cold medications in his body along with the methadone, Lexapro, and Zoloft that had previously been found. Another source tells People that a mild over-the-counter sedative was also present in his body. Wecht thinks that the newly discovered medications are "insignificant and they don't mean a thing. They're of no consequence."
Borat's Fair-Weathered Friend
Sacha Baron Cohen's Borat character might make audiences roll in the aisles with laughter when he bumbles into theaters later today, but there's at least one person who doesn't think the faux-Kazahki journalist is such a gas. TV news producer Dharma Arthur is claiming that Baron Cohen's wacky antics cost her her job – and sent her into a deep depression.

via FOX News), Borat appears on a live noon-hour news show on WAPT in Jackson, Miss., and proceeds to do his usual havoc-wreaking schtick with the anchorman and the weather guy, mixing in plenty of sex and toilet humor and disrupting the weather report. Arthur was the producer who booked Borat – and was subsequently let go as a result. "Because of [Baron Cohen], my boss lost faith in my abilities and second-guessed everything I did thereafter," she writes in Newsweek. "I spiraled into depression, and before I could recover I was released from my contract early."
The Next Bob Barker? Name Your Price
Start rolling out the punny headlines – CBS "Early Show" weatherman Dave Price is being touted as the replacement for "Price is Right" host Bob Barker, who just announced his imminent retirement on Tuesday.
Page Six speculates that CBS chief Les Moonves had to pay Barker off to retire, because, as one former co-worker put it, "Bob always swore he would die on that show. He had a unique contract where it was for life – and if he left unwillingly, the show had to go dark for a year effectively killing it." Plus, Moonves apparently loves wacky weatherguy Price, who had been threatening to jump ship to Fox, which he left to come to CBS. Indeed, in September, reports the New York Daily News, Price was trying out Barker's job in a run-through at the "Price is Right's" production company's studio. And well-placed TMZ spies tell us that Price has just inked a long-term contract with the network so Moonves can place Price on "Price" with no problem. And we're further told Price is "chomping at the bit" for the gig.
Leno Puts Fat Foot in Mouth at Gala
Jay Leno's supposedly comic material at the Carousel of Hope gala – a benefit for juvenile diabetes – raised eyebrows, as the funnyman made fat jokes to a crowd trying to fight a disease tied closely to obesity, and with Jason Davis, the rather, um, robust grandson (and brother of Brandon) of the hostess, Barbara Davis, sitting in the front row.
As the Los Angeles Times notes, Leno made jokes about Dairy Queen, Domino's Pizza, and this instant non-classic – "Scientists now believe obesity is caused by a virus. Does that mean you can now call in fat to work? 'Sorry boss. I can't make it today. My ass is as big as a house.'" – that elicited loud groans from the high-roller crowd.

What happened to Danny and Melinda from "The Real World"?
Danny and Melinda are still going strong, Carissa. They are enjoying their engagement and living together in Boston. While they decided to air their proposal on MTV for the world to see, Danny doesn't seem to care for the idea of broadcasting their wedding or their lives after the ceremony. (And with the whole MTV curse, who can blame him? Shanna and Travis, Carmen and Dave, Nick and Jess...)

TMZ has obtained a copy of the death certificate for the late son of Anna Nicole Smith.

While the certificate says an official cause for death is still "pending chemical analysis" for 20-year-old Daniel Wayne Smith, two separate sources close to the official Bahamian investigation confirmed the existence of three separate drugs in Daniel's bloodstream -- the same drugs found last week by Anna Nicole's private pathologist Dr. Cyril Wecht.
Daniel Smith died in the Bahamas on September 10 while visiting his mother who had just given birth to a baby girl.

TMZ spoke to celebrity photographer Larry Birkhead today, and he flatly rejects lawyer Howard K. Stern's assertion last night on CNN's "Larry King Live" that he is the father of Dannielynn Hope, the daughter born to Anna Nicole Smith on September 7.
Birkhead was either so disgusted or so unconcerned by Stern's appearance on King's show that, according to a TMZ witness, he left to spend the evening in the company of Janet Jackson at her record release party in New York while Howard K. Stern was on the air. Birkhead also posted a note on his website www.larrybirkhead.net saying, "I AM THE PROUD FATHER." "The whole thing is laughable," says Birkhead. "It was obvious that even Larry King didn't believe what Howard K. Stern was saying."
Back in June, when TMZ first confirmed that Anna Nicole was in fact pregnant with the child, Birkhead and Stern clashed over the baby's paternity. Said Birkhead, "I have seen the ultrasound and have spoken to doctors ... Howard needs to get past his own jealousy about the relationship between myself and his only client." Stern shot back in a conversation with TMZ, "Anna wants that guy completely out of her life and obviously he is having trouble dealing with it."
At that point, however, even while he was denying Birkhead's paternity claims, Stern did not make any claim to be the father of the child, despite repeated chances to do so.

For the first time, an official in the death of Anna Nicole Smith's son has gone on the record, stating that drugs may have killed Daniel Smith.
Dr. Cyril Wecht, a pathologist and former coroner who was hired by Anna Nicole and signed Daniel's death certificate, tells TMZ, "It could be a drug-related death of an accidental nature."
An official connected with the investigation, who wished to remain anonymous, told TMZ that the drugs in question "were prescription, not illegal." The source added that Daniel had "a combination" of anti-depressants and other prescriptions in his system.
"It could be a drug-related death of an accidental nature."
Dr. Wecht, however, bitterly disagrees with the Coroner of the Bahamas who claims the cause of death has been established to a certainty.
Dr. Wecht says he and another pathologist, Dr. Golinda Raju, both have determined that Daniel's cause of death is unknown, pending the final toxicology report. In sharp contrast, Coroner Linda Virgill tells TMZ, "I stand firm that the cause of death is known."
Dr. Wecht went after Virgill, telling TMZ, "Do you want to believe the two pathologists or a non-physician. I don't know what she's talking about." He reiterated, "I'm telling you I don't know the cause of death. I don't know." Dr. Wecht, who was clearly upset over Virgill's comments, peppered his comments to TMZ with expletives.
Virgill would not reveal the specific cause of death, though she insists it was firmly established last week. She did, however, tell TMZ, "The toxicology report is very important here," buttressing Dr. Wecht's comments that Daniel's death may have been drug-related.

TMZ was able to obtain raw footage of Cyril Wecht, the pathologist hired by the family of Anna Nicole Smith, giving his assessment of the current status on the autopsy of her son Daniel.
"The cause of death is listed as pending or reserved. Those two words being used synonymously," Wecht says. He also states that at this point in his investigation, he was not able to "find anything that would cause me to believe that there is something suspicious here in terms of traumatic injury having been inflicted."

NASSAU, Bahamas (AP) -- Anna Nicole Smith's lawyer has been authorized to bring in a private pathologist to perform a second autopsy on her son, the head coroner in the Bahamas said Friday.
The reality TV star and former Playboy playmate found her 20-year-old son Daniel Wayne Smith unresponsive Sept. 10 in her hospital room, three days after she gave birth to a daughter. She called for help but doctors were unable to revive him.
The Bahamas coroner's office has termed Daniel Smith's death to be "suspicious." The term, however, meant the cause was not
immediately apparent and did not necessarily imply foul play, head coroner Linda Virgill said Thursday.
The family's pathologist will arrive from the United States on Saturday and will perform the autopsy on Sunday, Virgill said. She said Smith's family requested it but did not specify which of her relatives did so. "It is nothing unusual for families to want their own pathologist to confirm or look for something that may have been overlooked" in the autopsy by the coroner's office, Virgill said. The results of the official autopsy, which was done Tuesday, have not been released. Virgill said a toxicology test would be completed next week.

TMZ has gathered further details in the tragic death of Anna Nicole Smith's son Daniel in the Bahamas yesterday morning. According to police, Smith herself found Daniel in her hospital room yesterday around 9:00 am, thinking that he was asleep. She then tried to wake him up and, after he didn't respond, immediately called for help. At that point, doctors and staff were not able to revive 20-year-old Daniel. Anna Nicole had just given birth three days earlier in the same hospital to a baby daughter.
The police continue to maintain that there were no signs of visible injury on the body, and that there were no signs of violence in the room. Police add that they haven't deemed the death a homicide, and do not suspect foul play.
Sources cited by the local newspaper Nassau Guardian have suggested that the cause of death was a "massive heart attack," but neither doctors nor the local coroner has confirmed this. And the Guardian adds that Daniel Smith arrived in Nassau on Saturday, after his mother had given birth.

UPDATE 12:20pm: Reginald Ferguson QPM, Assistant Commissioner for the Royal Bahamas Police Force, tells TMZ that whenever there is a sudden death in the Bahamas, the police have a duty to look into the death. Concerning the death of Daniel Smith, Ferguson says that "there were no signs of physical injury or violence" evident in the hospital room where Smith died, and there are "no reports of drugs, legal or illegal, on [Smith's] person at this time." Moreover, says Ferguson, "Nothing is ruled out. There are no signs of suicide, and police are waiting for pathology reports to make further determinations."
Former Playboy model Anna Nicole Smith gave birth to a baby girl on Thursday in the Bahamas, three days before her son Daniel Smith, 20, died suddenly, on Sunday.
According to a statement posted on Smith's website annanicole.com, "On September 7th Anna Nicole gave birth to a healthy 6 pound, 9 ounce baby girl. Her son Daniel was in the Bahamas with her to share in the joy of his baby sister when he passed away suddenly on the morning of September 10th. We have yet to learn the cause of death but do not believe that drugs or alcohol were a factor."
Daniel Smith appeared frequently in his mother's E! network reality series "The Anna Nicole Show." Smith, per her statement, is "absolutely devastated by the loss of her son. He was her pride and joy and an amazing human being."
Smith has not revealed who the father of her child is, and earlier this year won a US Supreme Court decision to collect her stake in her late husband J. Marshall Howard's fortune.
