Michael Phelps may not have been at fault for his car accident this week, but he wasn't exactly squeaky clean, either.
Phelps will be cited for driving with an expired license, which was from Michigan, the NY Post is reporting. Phelps will have to appear before a judge, though no date has been set so far.
Phelps also admitted to police he had a beer about an hour before the crash. He was not given a Breathalyzer test on scene.
Phelps was involved in a two-car accident in Baltimore on Thursday. It was ruled the other driver ran a red light, causing the wreck.

Simon Cowell saves his charm for when it counts -- he apparently talked his way out of a ticket!
This pic shows the "American Idol" judge in the clutches of a Beverly Hills cop this afternoon. The PD told us it was a "non-event traffic stop" and no citation was issued.
We're thinking the violation was for putting a 4th judge on the show. It really sucks.
UPDATE: TMZ has learned that Simon didn't have his license and wasn't wearing his seat belt while being stopped. He was not cited.

Now that's she has turned 37 16, Miley Cyrus has received her learners permit.
Hopefully she can avoid getting that next Hollywood starlet rite of passage ... a DUI.
