The preliminary hearing for the people accused of fueling Anna Nicole Smith with drugs kicks off today... and Larry Birkhead faces an almost impossible situation.
We're told Birkhead will testify either Thursday or Friday. Prosecutors will ask Anna's baby daddy about various comments he made about Howard K. Stern allegedly fueling Anna's drug habit.
But here's the problem ... Birkhead made these comments to TMZ and other media outlets during the time he was at war with Howard over Dannielynn.
Birkhead and Stern have not only settled their custody dispute and other differences ... they actually work together in handling all matters Anna Nicole.
So Birkhead is in an awkward position ... how does he back off his statements? Even more awkward, perhaps ... the prosecution is calling a witness who probably will not own the statements they're calling him to the stand to make.
The three defendants -- Howard K. Stern and two of Anna's doctors, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich -- have all pled not guilty to a grand total of 23 felonies.

Howard K. Stern has just been arraigned on 11 felony counts related to Anna Nicole Smith's prescription drug use.
The additional charges includes allegations Stern helped Anna score opiate prescriptions using aliases.
Dr. Khristine Eroshevich and Dr. Sandeep Kapoor were each arraigned on 6 felonies as well.
All 3 defendants just pled not guilty.

Howard K. Stern and two doctors, Khristine Eroshevich and Sandeep Kapoor, just pled not guilty to a pile of charges in the Anna Nicole Smith drug case.
The dynamic trio have each been charged with 6 felonies -- after a massive investigation that led prosecutors to charge that they funneled drugs to Smith in the years leading up to her death.
All three defendants had no problem with giving the D.A. handwriting samples that cops could use in determining who signed what prescriptions.

California Attorney General Jerry Brown played defense on Tuesday after Howard K. Stern's court hearing in the Anna Nicole Smith drug case, insisting he didn't abuse his power by gunning for H.K.S.
Stern's lawyer, Steve Sadow, lashed out at Brown, essentially calling him a demagogue who was aching to win the next Governor's race, using Stern as his stepping stone.
Brown said there was nothing wrong with devoting a boatload of money and resources to investigating Stern and Anna's two docs. He didn't exactly answer our question -- Would he have devoted the same resources if Anna Nicole wasn't the "victim?"

Dr. Khristine Eroshevich, the psychiatrist accused of conspiring to fuel Anna Nicole Smith with illegal prescription drugs, also just arrived.

How many times can a guy say he didn't have sex with another guy?
Larry Birkhead was deposed for ten hours (yes, we counted!) yesterday in the defamation lawsuit filed by Howard K. Stern against Rita Cosby.
In a book Cosby wrote last year, she claimed Anna Nicole Smith had a video of Stern and Birkhead having sex.

Anna Nicole Smith's estate lawyer and onetime lover, Howard K. Stern, appeared on "Larry King Live" last night, talking about the constant controversy surrounding his life -- and Smith's death in a Florida hotel last February at age 39.
A somber Stern answered King's questions regarding the loss of Anna Nicole, inheritance, prescription drug use and Rita Cosby's claim of a sexual relationship between Howard and Larry Birkhead -- which he patently denied.
Virgie Arthur, Anna's mother, has filed a libel and defamation lawsuit against Stern in a Texas court.
It was Kim's first time -- on the catwalk. Ms. Kardashian strutted her stuff at Christian Audigier's Sexpensive show during Fashion Week in Los Angeles.
If at first you don't succeed ... Hyde will deny again. Just ask Shauna Sand. Perhaps Shauna should befriend Paris. She always gets in.

Donald Trump might actually hate someone more than Rosie O'Donnell. Who'da thunk it?
The Donald called-in to the Don Imus Show on MSNBC this morning, as the body of his "friend" Anna Nicole Smith was being transported from Broward Country Morgue to Miami International Airport. After recounting her "terrible" life, Trump unleashed a verbal tirade aimed squarely at Howard K. Stern, calling him a "total loser" and a "hanger-on."
"There's something more to him than meets the eye," said Trump, adding, "the baby has got about a less than one percent chance of being his."
Looks like Rosie might be in the clear ... for now.

Virgie Arthur, Larry Birkhead, and Howard K. Stern are all over at the Broward County Medical Examiner's Office during the lunch break from court proceedings in the Anna Nicole Smith case, "EXTRA" is reporting. The case has been in recess since just after Noon EST, and is not scheduled to be in session until 2.30 PM EST.
Medical Examiner Joshua Perper called directly into the bench this morning to inform the court that the body was in "very good" condition, but repeated his assertion from Tuesday afternoon, that Smith's body is decomposing more rapidly than originally expected. He added that a decision would be better made within the week as to the future disposition of the body, in order to give it a proper burial.

The police in the Bahamas are in a tricky situation with two investigations - allegations that Howard K. Stern may have contributed to Daniel's death by fueling him with methadone, and an allegation that the owners of Anna Nicole's house broke-in after her death.
Howard K. Stern filed a police report accusing Ford Shelly, son-in-law of G. Ben Thompson (who owns the house), of breaking into the home and changing the locks. Police sources confirm with TMZ that the breaking and entering investigation is still "active." Aside from the fact that the allegation is tenuous, police are now faced with an embarrassing situation. "Victim" Howard K. Stern is looking increasingly like a man who stoked Anna's addiction to drugs in the later months of her pregnancy -- recording it on tape and gleefully saying the video would become a cash cow.

The judge in the Anna Nicole Smith baby dispute has ordered Smith to complete all DNA testing no later than Jan. 23.
Larry Birkhead, Smith's ex-boyfriend who claims to be Dannielynn's father, went to court last fall to ask a Los Angeles County Superior Court judge to order both Smith and her baby to undergo DNA testing.
Today Judge Robert Schnider set the Jan. 23 deadline. Under the terms of the order, Smith and Birkhead can each choose the lab of their choice. We're told Birkhead's lawyer, Debra Opri informed the judge that her lab -- based in the U.S. -- would send reps down to the Bahamas directly to Smith's front door. Opri tells TMZ "all she has to do is get out of bed, put on a 
robe and answer the front door."
Smith maintains her lawyer, Howard K. Stern, is the father.
