The preliminary hearing for the people accused of fueling Anna Nicole Smith with drugs kicks off today... and Larry Birkhead faces an almost impossible situation.
We're told Birkhead will testify either Thursday or Friday. Prosecutors will ask Anna's baby daddy about various comments he made about Howard K. Stern allegedly fueling Anna's drug habit.
But here's the problem ... Birkhead made these comments to TMZ and other media outlets during the time he was at war with Howard over Dannielynn.
Birkhead and Stern have not only settled their custody dispute and other differences ... they actually work together in handling all matters Anna Nicole.
So Birkhead is in an awkward position ... how does he back off his statements? Even more awkward, perhaps ... the prosecution is calling a witness who probably will not own the statements they're calling him to the stand to make.
The three defendants -- Howard K. Stern and two of Anna's doctors, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich -- have all pled not guilty to a grand total of 23 felonies.

Howard K. Stern's attorney, Steve Sadow, just spoke to the media outside of court, calling the charges against his client "BS."
Sadow said Anna Nicole Smith was "not an addict" -- adding Anna's health was Howard's "main concern."
Howard was arraigned on 11 felonies today -- Dr. Khristine Eroshevich and Dr. Sandeep Kapoor were both arraigned on six.

Howard K. Stern has just been arraigned on 11 felony counts related to Anna Nicole Smith's prescription drug use.
The additional charges includes allegations Stern helped Anna score opiate prescriptions using aliases.
Dr. Khristine Eroshevich and Dr. Sandeep Kapoor were each arraigned on 6 felonies as well.
All 3 defendants just pled not guilty.

A pharmacist told Anna Nicole Smith the drugs her internist prescribed to cope with her son's death were "pharmaceutical suicide," according to just released documents.
And, in a stunning turn, the court papers filed by the State of California claim psychiatrist Khristine Eroshevich and internist Sandeep Kapoor -- both being prosecuted for their prescribing practices in the Smith case -- crossed the line by having sexual contact with Anna Nicole.
According to the document, obtained by the L.A. Times, three pharmacists refused to fill the prescriptions Eroshevich and Kapoor had written. One of the pharmacists claims he reacted by saying to himself, "They are going to kill her with this."
According to the documents, five days after her son, Daniel, died Eroshevich asked for two sedatives, 300 tablets of methadone, a muscle relaxer, an anti-inflammatory drug and 4 bottles of a painkiller.
As for the alleged improper sexual contact, authorities found photos of Anna Nicole and Eroshevich naked and embracing in a bathtub. As for Kapoor, authorities cite a video showing a shirtless Kapoor "kissing and nuzzling" Anna Nicole.
Ellyn Garofalo, the attorney for Dr. Kapoor, says "There's been a misreading of the medical records." She adds, "When all the facts are disclosed, they will show that Dr. Kapoor's treatment of Anna Nicole Smith was in good faith and consistent with good medical practice."

Howard K. Stern and two doctors, Khristine Eroshevich and Sandeep Kapoor, have arrived at L.A. County Criminal Court for their arraignment in the Anna Nicole Smith drug case.

Howard K. Stern and Khristine Eroshevich did not enter pleas today in L.A. County Criminal Court -- their arraignment in the Anna Nicole Smith drug case was delayed until May 13.
Stern's lawyer, Steve Sadow, told the media after the arraignment that "[Howard] is innocent. Let me repeat that, he is innocent."
Sadow reiterated what we first reported -- Stern plans to fight these charges to the end, because he believes he did absolutely nothing wrong.
Sadow excoriated California Attorney General Jerry Brown, saying he should be "ashamed of himself" for using Anna Nicole to further his career.

TMZ has learned Dr. Khristine Eroshevich, the psychiatrist accused of conspiring to fuel Anna Nicole Smith with illegal prescription drugs, is officially behind bars.
The doc was booked at Van Nuys Jail at 11:11 AM PT. Her bail was set at the same price as Howard K. Stern's -- $20,000.
UPDATE -- She was released at 1:58 PM PT.
