The never-ending auction for the badass DWI recliner-mobile has failed miserably for the second time -- and now the guy who says his winning bid was just a mistake has the Proctor City Attorney after his trigger-happy mouse finger.
Since the chair was being auctioned off by the Proctor Police Department to benefit taxpayers, the police chief emailed the winning bidder to let the guy know a $2,000 deposit on the chair was due ... but all the chief got back was this note:
"I did not mean to bid this amount, as well as I cannot afford this. I am truly sorry for the mix up and the wasted time."
The chief got pissed and called Proctor City Attorney John Bray to check it out. Bray tells us he's looking at the City of Proctor's "legal remedies" about the failed eBay bid ... but says the ideal situation would be for the bidder to cough up the dough.

Mere hours before bidding was scheduled to end on the infamous DUI La-Z-Boy-Mobile, the motorized recliner suddenly vanished from the auction -- and TMZ has learned it's all because of a battle over its name.
With the price at $43,100 and rising, eBay received a demand letter from the most unlikely of parties -- the La-Z-Boy corporation itself. We're told La-Z-Boy played the trademark card due to the title of the auction "La-Z-Boy DWI Chair" and eBay was forced to pull the auction.
Here's the worst part: the chair was being auctioned off by the Proctor Minnesota Police Department and all profits were to benefit the taxpayers.
We're told La-Z-Boy "felt bad" about stopping the auction -- but hey, business is business.
Fear not motorized chair enthusiasts -- we've learned the cops plan on re-listing the chair in just a few hours.

The dude who got a DUI on a converted La-Z-Boy was literally sitting on a goldmine and he didn't know it -- now his beloved recliner-mobile is currently fetching more than $43,000 in a police auction ... and he won't see a cent of it.
The bid for Dennis LeRoy's infamous La-Z-Boy-Mobile is currently at $43,100 -- and there's less than 24 hours to go.
Cops in Proctor, MN, made a deal with LeRoy to remove one of the DUI's from his record if they could sell the contraption -- but little did they know LeRoy's franken-chair could be worth as much as a brand new Audi A5.
For the record -- a regular, non-motorized recliner usually goes for around 700 bucks.
