TMZ has learned Nicole Richie and Joel Madden are not married, despite what was said in court today.

Mark Geragos, Nicole's lawyer, asked his client during the restraining order hearing this afternoon, "Did you call your husband?" Nicole answered, "Yes."
Sources connected with the case tell us Geragos misspoke and Nicole didn't correct him, but Nicole and Joel are not married. As a result, the restraining order does not cover Joel, though it will cover the kids.

Nicole Richie's lawyer has just gone to court seeking a restraining order against the paparazzo who struck her car earlier this month.

The pap -- who ironically goes by Bam Bam -- was arrested after the crash.
As we first reported, famed P.I. Scott Ross paid a visit to Nicole's house after the crash, along with a lawyer from Mark Geragos' law firm.

Looks like Nicole Richie may be lawyering up after her car crash yesterday -- and the lawyer is none other than Mark Geragos.

We got this shot of Tamar Arminak -- a lawyer in Geragos' firm -- and master P.I. Scott Ross entering Nicole Richie's property about an hour ago. Ross works for Geragos and the two of them have handled a bunch of celeb cases, including most recently People vs. Chris Brown.
We're told Richie is angry at the photog and may sue him -- she thinks he intentionally rear-ended her to create some drama.

Chris Brown met with probation officials in late June, and he told them he was "ashamed and embarrassed" over the Rihanna beating.
In documents released today by the court, Brown met at the law office of his attorney, Mark Geragos. Brown's mom and probation officers were also present.
During the meeting, Brown said he wanted to plead guilty immediately, but his attorney would not let him. Brown says he also wanted to undergo counseling before he started his probation but Geragos wouldn't let him.
Brown said when he was growing up he saw violence in his own household and didn't want to "carry on that cycle."
Brown told the probation people he wanted to attend domestic violence counseling and wanted to "do it right."
And there's this... Brown says he has already apologized to Rihanna "on a few different occasions." He added he was "uncertain" of the status of their relationship. Note, this interview was June 26, 2009, more than 4 months after the beating.

Famed celebrity attorney Mark Geragos says he turned down a chance to join the legal team of embattled Michael Jackson physician Dr. Conrad Murray -- but the good doctor says he never asked him.
Geragos, who famously repped Jackson during his 2004 child-molestation trial, told E!, "I've been approached ... I represented Michael and I would not want to be in a position where I was deprecating Michael in any way, shape or form."
But Murray sees it differently. His current attorney, Ed Chernoff, released a statement saying, "Although Mr. Geragos would make a fine addition to any legal team, neither Dr. Murray nor anyone associated with him has approached Mr. Geragos for any reason, legal or otherwise. He no doubt meant that as a hypothetical, and was unfortunately misquoted."
He's tellin' the story.

UPDATE: Geragos has just left the courthouse.

With Chris Brown's preliminary hearing just hours away, we're hearing there's a possibility the case could be plea bargained and announced later today.
Brown's lawyer, Mark Geragos, is currently in chambers with the prosecutor and the judge.
Our sources say nothing will happen before the hearing at 1:30 PT. But get ready -- it's possible they could announce a deal then.

Rihanna has a big date with Chris Brown today ... along with a judge, a few lawyers and a courtroom full of onlookers.
RiRi is set to take the stand as a witness against Chris Brown in his preliminary hearing, which begins at 1:45 PM PT.
Rihanna's testimony is hugely important. Will she stick to the story she told cops the night of the beating? Rihanna said Brown had beaten her before and the violence was escalating.
One big question -- will Brown's lawyer, Mark Geragos, cross-examine Rihanna? We're told if the case goes to trial Geragos will make a big point that Rihanna was the initial aggressor, repeatedly hitting him before he began pounding on her.
Also hugely important ... the photos of Rihanna's battered face. We've published one pic graphically showing the brutality of the beating. But we're told that photo pales by comparison to photos taken the next day after the bruising and swelling settled. Those photos will almost certainly be introduced into evidence during the prelim.
The judge has rejected TV or livestream coverage. We'll have constant updates.

Chris Brown's lawyer went to the California appeals court asking to put Brown's preliminary hearing on ice -- but we've learned the appeals court told him to pound sand.
Mark Geragos wants a hold on the case because of the leaks. The trial judge shut him down. So the prelim in the Rihanna beating is still on for June 22.

Rihanna's lawyer just said the D.A. told him his client will be subpoenaed at the next court hearing.
Donald Etra said Rihanna will be called to the stand to testify at Chris Brown's preliminary hearing on June 22.
Etra says his client will cooperate and take the stand. It's not at all unexpected that the alleged victim would be called to the stand in a prelim.
Also today, the judge rejected a motion made by Chris Brown's lawyer, Mark Geragos, asking for an order requiring the LAPD to ante up info regarding leaks in the case.

We've now obtained the discovery motions filed by Chris Brown's lawyer, Mark Geragos, asking for all written statements and reports from the LAPD regarding the photo of Rihanna posted on TMZ.
Geragos believes the photo was leaked by an LAPD officer -- He writes, "...this highly prejudicial photograph was sold by an LAPD officer to the entertainment website, Thirty Mile Zone (TMZ). The photograph was immediately viewed by hundreds of thousands of viewers and was plastered on every news channel for the following weeks."
Geragos wants notes from the Internal Affairs investigation, along with police officer notes and other documents, stating, "I intend to use such evidence at the preliminary hearing to attack their credibility. The defense intends to prove and argue that the afore-mentioned officers are not credible and that the Court should not believe some of their statements."
Geragos adds, if the court has questions about the credibility of officers in the case, "I believe there is a reasonable likelihood that the case will be dismissed at the preliminary hearing."

Chris Brown's lawyer, Mark Geragos, has just filed legal papers asking the LAPD to ante up info on leaks in the case.

Geragos wants the information so he can decide whether to file a motion to dismiss the case against Brown, on grounds of misconduct by law enforcement.
One of the items Geragos wants to know about -- how TMZ got the photo of a battered Rihanna.

Chris Brown's high-powered lawyer, Mark Geragos, told TMZ on his way out of the courtroom this morning he may want the Rihanna case against his client dismissed because of leaks in the case.
Geragos told us, "Leaks can form the basis for a motion to dismiss the case in regard to outrageous governmental misconduct." Geragos is asking for discovery -- in other words, he wants the LAPD to ante up whatever info they have on info about the case that has gotten out.

Rihanna's jewelry is going to be free!
As you probably know, she was wearing $1.4 mil in borrowed jewelry when she was allegedly beaten by Chris Brown. She was supposed to give it back to the jeweler a while back -- but it's been held by the cops since Brown's arrest.
Today the judge ruled the jewels can go back to their rightful owner. The LAPD will take photos of the bling in case it's used as evidence in the trial. But expect a plea bargain.
Brown's lawyer, Mark Geragos, also asked the judge to order the LAPD to turn over the investigative reports on the leaked photo.

Pretty stunning ... Rihanna's lawyer just spoke to reporters, as if he is somehow speaking on behalf of the man who allegedly beat his client -- aka Chris Brown.

Donald Etra just said Rihanna would be pleased "if it [the case] were over quickly" -- as in plea bargain. Etra was asked what kind of deal would she want -- he said she recognized it wasn't up to her. He acknowledged there were efforts underway to resolve the case -- so he knows...
As we first reported, Brown's lawyer, Mark Geragos, and the prosecutor are in the throws of plea bargain negotiations and one source says a deal is "close." Rihanna has made it clear -- she does not want to go to court, although Etra says she will cooperate if ordered to do so.
If you're wondering why Mark Geragos didn't speak -- we have no doubt prosecutors would be pissed off if he stepped in front of the mic during negotiations ... so its all the more intriguing that Rihanna's lawyer answered all of the questions.

Chris Brown's lawyer and the prosecutor in the Rihanna case have been engaged in "serious" plea bargain negotiations and according to one source, a "deal is close."
We know Brown will plead not guilty today, however the plea may just be a formality.
Sources say Rihanna has made it clear she does not want to testify in the case and wants Brown to cop a plea. We're told one of the reasons she's in Barbados right now is because "she wants to be as far away from this case as possible."
As we first reported, Brown was inclined to plead either guilty or no contest to a misdemeanor, provided he got no jail time -- but since we broke that story, the D.A. and Mark Geragos, Brown's lawyer, have gotten down to the nitty gritty.
We do not know if Brown changed his view and would accept jail time to avoid a trial. Brown will be in court today for the arraignment.
