When Michael Lohan returns home from his trip to Boston this weekend, he'll have a present waiting for him -- courtesy of the lawyers at TLC.
Lohan tells TMZ he has been subpoenaed to testify in TLC's breach of contract lawsuit against Jon Gosselin. Lohan says he was contacted by a process server on Friday. He says he told the process server he was out of town, but that he accepts the papers and that she can leave them at his house.
Michael says he hasn't seen the papers yet.
TLC is suing Gosselin, claiming he broke his deal with TLC when he began taking money to appear on other shows and talking about "Jon & Kate" without proper permission.
UPDATE 2:20 PM ET -- A TLC official tells TMZ the Heene family approached the network "months ago" with a reality show idea, but the network passed.
TMZ has learned the Heene family has been pitching a reality show about the wacky family, as one TV source put it, "all over town."
We're told Richard Heene pitched a series to Relativity Real, as well as RDF Productions. RDF produces "Wife Swap," on which the family appeared back in March.
We're also told the Heene's have made the rounds at the networks, including TLC. Of course, TLC produced "Jon & Kate Plus 8."
So is balloon boy the ultimate reality show pitch?
TLC is dropping the legal hammer on Jon Gosselin -- filing a lawsuit against the guy for breaching his contract on "Jon & Kate Plus 8."
In the suit, filed Friday in Maryland, the network claims Jon was contracted to be an "exclusive" employee -- but broke his deal when he began taking money to appear on other shows and talking about "Jon & Kate" without proper permission.
Jon has appeared as a guest on all sorts of shows lately -- most recently appearing on "Entertainment Tonight."
We're told Jon & Kate Gosselin aren't living hand to mouth, but the $200,000 account that Jon raided was the only real source of living income.
There's a report out that the couple is saddled with a $720,000 mortgage on their $1.12 million house. There was talk that TLC bought the house for them outright but we've learned that is not true. TLC paid them a salary and that's it.
We're told Jon and Kate have established a trust fund for their kids and it's well into the 6 figures, but they have significant debt. They still haven't been able to sell their first house and they owe a mortgage on it.
The reality is ..."Jon & Kate Plus 8" is good for the 8 but Jon and Kate are kinda strapped.
We've learned the judge in the Kate Gosselin vs. Jon Gosselin case (formerly known as ("Jon & Kate Plus 8") will hold a conference call between the battling lawyers in the next half hour, and there could be an order forcing Jon to return several hundred thousand dollars back to their joint account.
It will be interesting if the judge lets Jon's lawyer, Mark Heller, on the call -- he's not licensed to practice in PA.
It took a few tries, but Jon Gosselin finally managed to post a sign outside his home in Pennsylvania that had all the words spelled correctly -- including his own name.
The only possible explanation for the first sign ... one of the kids made it.

As TMZ previously reported, Jon wants the kids off the show permanently, so goodbye paycheck.
TLC isn't the only one calling Jon Gosselin "opportunistic" -- now his estranged wife is joining in on the fun.
Kate just released the following statement:
"It appears that Jon's priority is Jon and his interests ... I'm saddened and confused by Jon's public media statements. Jon has never expressed any concerns to me about our children being involved in the show and, in fact, is on the record as saying he believes the show benefits our children." As TMZ previously reported, production has been suspended on "Kate Plus 8" while Jon and the network hash out a deal.

Sources on both sides tell us Jon Gosselin has been asking for his exit papers from the show for several months. Production sources say they were willing to continue giving Jon a full paycheck and not put him on the show, but there was one string attached -- that he couldn't do any other show without the permission of TLC. BTW, that's a standard condition in TV-land.
Production sources say Jon's lawyer was demanding that TLC let Jon do any show he wanted but TLC wouldn't budge. Production sources say Jon's lawyer then threatened to shut down production by claiming the show wasn't good for the kids, and that's just what happened.
But sources connected with Jon tell us Jon had been complaining for months about his kids being on the show and that the kids themselves were complaining. These sources say Jon was blindsided when TLC released a statement that the show would be called "Kate Plus 8" and that the result would be that the kids would have to be on camera a lot more.
Production sources say no way would the kids be on the camera more because it's just "Kate Plus 8."
TLC has come out swinging, calling Jon Gosselin's antics "opportunistic." Ya think so?
Gosselin has found God after getting dumped from "Jon & Kate Plus 8" and is now demanding that TLC stop production for the sake of his kids.
TLC says it is "deeply disappointed" at Jon's "erratic behavior," calling Jon's latest salvo "grossly inaccurate, without merit and...clearly opportunistic."
TLC adds, "Despite Jon Gosselin's repeated self-destructive and unprofessional actions, he remains under an exclusive contract with TLC."
But Jon may have TLC over a barrel, because it has suspended production while they hash it out with the concerned father of 8.
Jon Gosselin has finally found religion for his children -- but it's a little late.
TMZ's confirmed Jon has sent a letter to TLC demanding they halt production of "Jon & Kate Plus 8" or any other show with his children STAT.
Gosselin now claims the filming is detrimental to his kids and he's now determined to bring in police if that's what it takes to stop the production.
So coincidence? Jon was just 86'd from the show -- which will be relaunched as "Kate Plus 8" in November -- and a day later he's suddenly worried about the kids he sporadically sees. A source connected with the production says Jon had no problem shooting the show as recently as last Friday ... but since he was essentially fired from the show this week, he's suddenly worried about his children.
FYI ... whoever put up the sign misspelled "penelty" and "Johnathon."
It may be difficult for a porcupine-haired woman with "an obscene amount of stretch marks" and "eight fatherless kids who live in crooked houses" to get a date -- which is why Kate Gosselin* has hit up Match.com in an effort to replace Jon.
