The busboy who is suing Lindsay Lohan -- alleging she was drunk when she crashed her Mercedes into his van back in 2005 -- may have found the proof he needs. TMZ got a hold of Lindsay's bill from the Ivy restaurant, where the now-rehabbed had been dining with chums. The bill clearly shows that the party of five ordered four Ivy Gimlets -- a strong vodka/mint drink, but there's no way of knowing if Lindsay, who was 19 at the time, partook of the tasty cocktails. 
LiLo claims that the police report makes it clear that alcohol was not a factor.

A large police force responded to a threat against popular celeb-stop Robertson Blvd. Friday, and while the bomb squad conducted their investigation, eatery the Ivy -- which was directly across the street -- didn't miss a beat. Their food must be da bomb!
Police cars blocked off the boulevard, while a legion of officers in protective outfits searched around Robertson Plaza. Meanwhile, the Ivy stayed busy, making sure food was served to their undaunted customers.
The LAPD had no information available as to why the bomb squad was at the scene.

It's more bad legal news for La Lohan ... can't a rehabbing actress catch a break?
TMZ was in court this morning when L.A. Superior County Judge Michael L. Stern gave busboy Raymundo Ortega the green light to proceed with his civil lawsuit against LiLo. Ortega claims Lohan was driving intoxicated while trying to avoid paparazzi on Robertson Blvd., when her black Mercedes smashed into his van in 2005.
Ortega's attorney, Robert G. Klein, says he spoke to several potential witnesses in the case, including a person who spoke to an employee of the Ivy who allegedly indicated booze was served to a then 19-year-old Lindsay. CHP's investigation concluded that Lohan was not drunk, and found Ortega at fault for making an illegal U-turn. "This is a bogus claim. Mr. Ortega is 100% at fault and Lindsay shouldn't have to pay anything," said Lohan's attorney, David J. Ozeran.
Ortega is seeking compensation for his pain and suffering -- in excess of $200,000, and other damages and medical bills. A jury trial is set to start April 7 of next year.

Larry Birkhead went on a shopping spree to decorate 6-month-old Dannielynn's nursery yesterday.
After leaving court, Larry had lunch at The Ivy on Robertson Blvd., but instead of hitting up the celebrity retail haunt Kitson, located up the street from the eatery, Birkhead shopped at Babies "R" Us -- in Van Nuys!
TMZ has learned that Larry purchased tons of pink clothes, toys and baby supplies at Babies "R" Us, then went to a nearby baby furniture store where he picked up an antique white baby crib, changing table, white furniture and baby gates.
While a hearing in the Bahamas is scheduled in the next few days, it looks like Larry believes he's got a lock on Dannielynn's paternity.

In this naughtycal ensemble, it looks like one of the Blues Brothers hooked up with Popeye and had a baby. Avast!
