MJ's Mom 'Seriously Considering' Suing Murray

Katherine Jackson's attorney tells TMZ Michael Jackson's mom is "seriously considering" filing a wrongful death lawsuit against Dr. Conrad Murray.

Adam Streisand, who scored a victory for Katherine last week in the estate case, tells TMZ the case would be filed on behalf of Katherine and Michael's three children. But Streisand adds, the biggest factor against filing suit is that Murray is asset-challenged -- i.e., he can't even pay his child support.

Streisand said he's actually rooting for Dr. Murray to file a claim for wages against AEG, adding "At least then we'd have some money to take from him."

As we first reported, Murray may sue AEG for $300,000 for the two months he "treated" MJ.

DJ AM -- Wrongful Death Suit Over Drugs

DJ AMA pretty incredible twist in the death of DJ AM (aka Adam Goldstein) ... The company that chartered the plane carrying DJ AM that crashed in South Carolina is now being sued for wrongful death because "the crash ultimately caused Adam Goldstein's death."

The amended suit in L.A. County Superior Court notes DJ AM was forced to take various drugs as a result of the burns he suffered, along with the emotional distress.

In addition to Clay Lacy Aviation, DJ AM's estate is suing the travel service, Goodyear Tire, Learjet and the estates of the two pilots who were killed in the crash.

Ultimately DJ AM's death was caused by a combination of various prescription drugs, along with cocaine.

The upshot ... the drugs were the direct result of the crash.

We also know DJ AM became intensely fearful of flying and began taking drugs to calm his nerves when he flew.

UPDATE: A Clay Lacy Aviation rep just told TMZ, "...Clay Lacy Aviation did not own or operate the aircraft involved." Translation -- not our fault.

Michael Jacksons -- Problems With Wrongful Death SuitVarious members of Michael Jackson's family tell TMZ they are already talking about lawyers who might rep them in a wrongful death lawsuit against Dr. Conrad Murray and others ... but Jackson's death may prove to be such an economic bonanza that it could torpedo a lawsuit.

In California, Jackson's immediate family could sue for the economic loss they have suffered by Jackson's death -- e.g., the financial support Jackson could have provided had he lived. Here's the problem -- Jackson's death may actually be an economic gain.

It's already becoming clear Michael Jackson is more profitable in death than he was in the last years of his life. Therefore, even if lawyers proved Dr. Murray and others were responsible for Jackson's death ... they could still come up with goose eggs.

The family could also recover for non-economic damages such as loss of companionship and love. The problem -- in California, if the lawsuit is based on malpractice against a medical provider, these damages would be limited to $250,000 total.

The final possibility -- if the family could prove the defendants acted with malice, they could get punitive damages. "Malice" includes proof of "despicable conduct." The family could also win punitive damages if the defendant is convicted of felony homicide. But in California, punitive damages have to bear some relationship to damages for economic or non-economic losses. Typically punitives are limited to nine times those damages.

It ain't as easy as it seems.
