Mike Tyson's explosive run-in with a paparazzo at LAX last week is now in the hands of L.A. prosecutors ... sources tell TMZ.
We've learned the LAPD sent the case to the Los Angeles City Attorney this morning. We're told the City Attorney has conducted a preliminary investigation but has not decided whether to charge Tyson and/or the papper, Tony Echevarria, with criminal battery.
We're told the City Attorney wants to see the video the photog shot when the fight broke out.
Both Tyson and Echevarria were arrested. Tyson says the photog made contact with the stroller carrying his baby and he struck the dude in self defense.

The photographer who ended up on the wrong end of Mike Tyson's fist says Mike got in 4 good punches and blood was gushing "like a water fountain."


Pap Tony Echevarria claims:
- He wasn't disrespectful or aggressive
- Mike was initially in a good mood but turned sour when the pap asked about his wife
- Tyson became more agitated when he couldn't find a bathroom and saw the photog shooting him
As we previously reported, Tyson and the photographer were both busted for battery.

This is what it looks like when Mike Tyson punches you in the face.

Paparazzo Tony Echevarria got into it with Tyson yesterday afternoon at LAX. Both men were arrested. Tyson was taken to the police station ... Echevarria went to the hospital.
Tyson's lawyer, David Chesnoff, claims the photog was harassing Tyson, his wife and kid. Chesnoff claims some photogs followed the ex-champ into the bathroom, though he didn't say if Echevarria was one of them.
The photog got 5 stitches.
Pretty ironic -- his t-shirt says, "Live Long."

Kanye West got swift justice this AM -- thanks in part to TMZ -- and the judge in his LAX vandalism case said he'll dismiss all 3 misdemeanors against him after Kanye gets a dose of community service.
West's lawyer, Blair Berk, delivered a blistering attack on the paparazzi, scolding them for inciting celebs, going to churches for intrusive shots ... pretty much claiming they're responsible for all the wars in the world.
Berk says both Kanye and co-defendant Don Crowley (Kanye's manager) are "remorseful" for their conduct and have submitted to anger management counseling -- this, after breaking two cameras in a fit of anger at the airport.
Berk says this matter was "wildly overcharged" as a battery and vandalism case.
Deputy L.A. City Attorney Felton Newell disputed the notion the case was overcharged, claiming the defendants acted with "reckless disregard," adding the video shows "an intent to commit a felony."
Berk appeared without her client and noted that TMZ had settled its beef with Kanye because West paid for the camera he broke at LAX on Sept. 11, 2008. The judge agreed -- saying if TMZ didn't want to press charges, it didn't make a lot of sense to carry on with the case.
And speaking of Sept. 11th...the two lawyers got into a fight over whether the prosecutor was exploiting the date by saying it elevated the seriousness of the offense -- i.e., going nuts at a major airport.
In the end, the judge felt since the defendants enrolled in an anger management program, he said he'll dismiss the charges when they both serve 50 hours of community service. But he added Kanye's conduct was not acceptable.

Sean Penn went ballistic on a paparazzo this afternoon -- and we've learned the photog just filed a police report against the actor.
The cameraman -- Jordan Dawes (not a TMZ guy) -- is accusing Penn of battery after a confrontation near the Brentwood Country Mart in Los Angeles, where Sean had just eaten lunch.
Penn was seen kicking and hitting the photographer on a side-street multiple times before leaving.
Sean's rep had no comment.

Kanye West is feeling the legal heat over his VMA rant ... because there was a quiet, clever move last week to keep his criminal case out of court until all the hubbub dies down.
Kanye is being prosecuted for breaking a paparazzi camera at LAX on September 11, 2008. The L.A. City Attorney has charged him with 3 misdemeanors -- vandalism, theft and battery.
We've learned last Friday, Kanye's lawyer, Blair Berk, went to the judge and won a delay -- a pre-trial hearing was set for this month but it's now pushed back until October 23 -- hopefully for Kanye, when attention deficit disorder sets in and the public moves on to another celebrity meltdown.
Here's the problem ... even the mighty Blair Berk can't stop Kanye. The question: Can she contain him?

The guy who allegedly choked Ryan Seacrest's bodyguard outside of the Children's Hospital in Orange County on Tuesday just pled guilty to three misdemeanors.

Chidi Uzomah -- who appeared in Orange County Superior Court today via a television feed -- pled guilty to battery, assault and possession of a switchblade.
He was put on three years probation and must "destroy" all weapons he owns. He was sentenced to 15 days in jail with 4 days credit for time already spent behind bars. But if he messes up, then he could get six months in jail or a $1,000 fine.
The judge said he must stay away from the Children's Hospital and Ryan Seacrest.

A former WCW Tag Team Champion was arrested this weekend after he allegedly put the wrong person in a choke hold ... his girlfriend.
Sean Haire -- aka Sean O'Haire -- was arrested early Sunday morning for battery and criminal trespassing after his girlfriend told cops he violently attacked her at her home in Savannah, GA.
According to the police report, the woman claims Haire -- who's now a 6'6" tall, 270 lbs MMA fighter -- stormed downstairs unprovoked and "started screaming and throwing items around her."
Moments later, Haire's girlfriend claims he "began to choke her while calling her a bitch and a whore."
According to the report, Haire's girlfriend said she "does not know what caused the sudden attack, but that it has happened in the past on several occasions."
The woman eventually ran outside and called the cops -- and Haire was arrested and thrown into the Chatham County Detention Center ... where he had the opportunity to pick on someone his own size.
We're told he was released on $4,600 bail.

Tom Sizemore has been charged with one count of spousal battery over an allegedly violent incident with his girlfriend earlier this month.
As TMZ first reported, the former "Saving Private Ryan" actor was arrested in L.A. on August 6th after a verbal argument allegedly turned physical and someone called 911.
If Sizemore is found guilty of the misdemeanor charge, he could do up to a year in jail and face a maximum $2,000 fine.

The court has released the officer's report from the night Chris Brown beat up Rihanna -- describing the entire incident in graphic detail.
According to the report, cops responded to a "screaming woman" -- and when they arrived, they noticed a "very upset and crying" Rihanna seated in the driver's seat of a parked vehicle.

Rihanna told the officer she got into an argument with Chris Brown over something that had occurred at an event they were at earlier in the evening.
"The victim said she became enraged and slammed both of her fists against the dashboard on the passenger side of the car they were in. She reported that the defendant then pulled the vehicle over and reached over her with his right hand. He opened the car door and tried to force the victim out."
According to the report, Brown was unable to shove Rihanna out of the car because she was wearing a seatbelt.

***** THE JUDGE JUST SAID SHE IS AWARE OF THE "CHATTER" ON THE AIRWAVES -- SHE IS CLEARLY REFERRING TO THE TALK THAT BROWN HAS BEEN IN TOUCH WITH RIHANNA. SHE SAYS SHE MEANS BUSINESS AND WILL VIOLATE HIS PROBATION IF HE DARES VIOLATE THE TERMS.
UPDATE, TERMS OF SENTENCE. The judge placed Brown on felony probation for 60 months -- 5 years. He must obey all laws. He must report to probation within 72 hours. Brown can perform community labor in Virginia. She wants reports from the domestic violence program in Richmond, VA. Brown must keep in touch with the Probation Department. He is subject to search and seizure 24/7 for the next 5 years. He can't own any dangerous weapon, including guns or knives.
The judge will issue a protective order ... staying away from Rihanna. He must provide DNA samples as requested by authorities.
He must complete a 52 week domestic violence program sponsored by the Commonwealth Catholic Charities.
Brown must personally come to court every 3 months during his probation. The first appearance will be November 19.
Brown must perform 180 days of community labor. He must also pay $2,500 in restitution. He'll have to pay another $2,500 in probation expenses. He must also pay a $30 criminal conviction fee --BARGAIN! He must also pay $400 that goes into a domestic violence fund.
The judge issued a protective order. Brown is ordered not to harass, assault, threaten, molest, threaten, etc. Rihanna. He must surrender all firearms within 24 hours. He can't have any contact with Rihanna, even on the phone or through a 3rd person. He must stay 100 yards away from her, unless there's an entertainment-related event, in which he must stay 10 yards away. The protective order lasts 5 years.
Brown must get prior approval before leaving the country.
Brown jumped the gun and said he accepted the terms of probation, even before the judge finished her sentence
UPDATE: The judge just said she wanted to reiterate that she wanted him to do hard time ... like washing cars, grafitti removal, etc.
UPDATE: Mark Geragos just said the name of the community service program in which Brown will be enrolling. It's Commonwealth Catholic Charities, where Brown will be enrolling in a 52 week domestic violence program.
UPDATE: Chris Brown is in court, wearing a 3-piece pinstriped suit, looking very serious.

He was hungry for some pizza -- but a man who happened to be dining at the same restaurant as NBA star Zach Randolph last year says the basketball star dished out an asskicking! But wait! According to Zach, it could be a shake down. Or a Shakey Down.
A guy named Gary Ferguson has filed a lawsuit against Randolph, claiming the former Los Angeles Clipper beat the crap out of him on a night when the Clips got beat down on the court.
It all went down inside Berri's Pizza Cafe in L..A. -- where Randolph allegedly "verbally and physically threatened" Gary before "attacking" the guy.
Gary's lawyer claims his client walked away with damaged teeth, a messed up neck and back, a knee injury that will require surgery, and scars on his face.
As for Zach -- his lawyer, Raymond Brothers, tells us he met with Gary's lawyer who first demanded $250,000, then $200,000 and finally $25,000.
Brothers says Gary's own lawyer said Gary was "out of control" and just wanted a quick payout. Brothers says it was a shake down and he walked out, only to get a call from Gary's star witness, who said the case would go away quick if he coughed up some dough. Brothers told her to pound sand.

The Game's cousin wants the rapper to be coffin' up some serious cash -- and it's all over an alleged beat down that occurred at a freakin' funeral last year.
Robert Kirkwood just filed a lawsuit in L.A. County Superior Court, claiming the The Game and four others assaulted him at his sister's funeral in July of '08.
The suit says the throwdown -- straight out of a Jerry Springer Halloween Special -- started when Robert confronted The Game because the rich rapper wouldn't pay for a part of the funeral costs.
Robert -- who hilariously refers to The Game in the suit as someone who "fashions himself as some kind of rapper, gangster and/or celebrity" -- says he suffered "severe and permanent injuries" during the alleged fight.
Robert is suing The Game -- along with the four other people he claims took part in the fight -- for medical expenses, loss of income and general damages.

This is a photo of the guy Mel Gibson allegedly went off on last night -- after the actor reportedly ripped apart his t-shirt for trying to snap a pic of him and his GF Oksana Grigorieva.

As we previously reported,the "victim" went to LAPD Hollywood Division and filed a battery report against Gibson.
We're told Gibson allegedly ripped the shirt after telling the dude and his friend to please walk away and not take pictures.
Law enforcement tells us the "victim" suffered no injuries ... the whole thing is over a torn shirt. This looks like a small claims court case if we've ever seen one.

TMZ has just obtained this shot of Mel Gibson with GF Oksana Grigorieva inside Playhouse in Hollywood last night -- before he allegedly got too hands-on with a photographer who tried to take their picture.

Someone is at the LAPD's Hollywood Division right now filing a battery report against Mel -- who reportedly became irate at a photog and ripped the guy's shirt open.
Gibson -- who had an infamous DUI case in 2006 -- is currently in the midst of a pricey divorce with estranged wife, Robyn.
