Michael Lohan could wind up behind bars for his despicable decision to release secret recordings of his family's phone conversations -- because it appears MiLo wasn't legally allowed to be on the calls in the first place.
It's all over a protective order Dina obtained in Nassau County, New York back in 2005, which bans Michael from communicating with Dina by email or phone until 2011.
Now, the release of the tapes, one of which was reportedly made in 2008, could be a smoking gun, proving Michael broke the rules of the protective order -- and, if convicted, it could score Michael some quality time in prison.
TMZ has learned attorneys for Dina Lohan have already contacted the Nassau County District Attorney in connection with the audio tapes.
Unfortunately for Lindsay -- who was granted a one-year protective order against Michael back in 2004 -- there are no laws against being an insensitive, fame-hungry, backstabbing father.

Dina Lohan just called into TMZ Live with Harvey and Mike and ripped ex-husband Michael Lohan a new one ... for secretly recording and then releasing old phone conversations he had with Lindsay, Dina and others. Dina says Michael's betrayal has devastated her family and thinks Michael could end up in jail for it.

Lindsay Lohan is not trying to get a restraining order against her dad ... but we've learned mama Dina is angling to do just that.
Our sources say Dina Lohan has been contacting Lindsay's lawyer, the effervescent Shawn Chapman Holley, ever since LiLo's last court appearance last month.
We're told Dina has asked S.C.H. to go to court on Lindsay's behalf and get an order keeping dad away from daughter. We're told Chapman Holley made it clear ... Lindsay is an adult and can apply for a restraining order if she wants, but Dina has no business in Lindsay's business.
Shawn Chapman Holley told TMZ Lindsay has not -- repeat NOT -- asked her to get a restraining order.
It's pretty clear -- Lindsay can't stand her dad ... at least for now. But she's not taking it to court.

Dina Lohan is steamin' mad at TMZ -- claiming we wrongly crowned her the "Worst Mother Ever" back in April.
For the record -- Dina earned the title from our readers, who overwhelmingly agreed that her decision to drive her substance abusing daughter Lindsay to a Hollywood BAR -- months after she finished up a stint at REHAB -- was one of the worst parenting moves of all time.
After the incident, more than 70,000 people voted Dina the "Worst Mother Ever" ... but that was soooo 5 months ago.
Just for kicks, let's take the poll again.

Drawing on her years of experience under Dina Lohan's tutelage, Lindsay Lohan tapped into her maternal instincts and held a baby while out shopping in L.A. the other day.
But unlike Dina, LiLo did not hit up the Hollywood club scene with the kid.

Like a mother dropping her kid off at soccer practice, Dina Lohan dropped Lindsay off last night at ... wait for it ... a bar.
The Mother of the Year gave her daughter a ride to Bardot -- the perfect place for a rehab grad --who affirmed to our photog "I don't drink ... a**hole."

In today's economy, buying a tax lien off of a small Long Island town doesn't sound like the shrewdest of investments. But if that's your thing, perhaps you'd like to purchase Dina Lohan's?
According to a public notice that ran today in the Merrick Life newspaper, unless DiLo forks over the $11,485.74 she owes Nassau County in taxes by tomorrow, the tax lien placed against her home will go up for auction next week. Should you choose to purchase the lien, you can collect 10% interest on one of the most famous mothers in Hollywood.
Usually, it's her collecting the 10% ... off her kids.

Michael Lohan in NYC looked to make a few things clear -- his daughter Ali's boob job is bogus and that stingy paternity test is still pending.
But the best news -- Michael says he hasn't been approached to be in the second season of "Living Lohan." Which hopefully means -- we will never see a second season of "Living Lohan."

Lindsay Lohan had her '80s prom themed b-day last night -- and by the looks of Sam's strapping ensemble, Ronson was her date. Sam in a dress? Bitch, please!
Linds had din din at Magnolia followed by a low-key party at Teddy's in the Roosevelt Hotel, where our spies inside tell us the Birthday Girl looked sober all night, pigging out on cupcakes. The only celeb we heard about was Chris Brown -- and that guy left early.
Mama Dina was there too -- but no sign of Michael. He must have been too busy taking paternity tests.

Lindsay Lohan's 22nd birthday throw down is toned down from what it was supposed to be -- 'memba this? -- but that doesn't mean it won't be a wild affair.
We're told her full sister Ali and loony mom Dina are flying in for the private party. It's being held tonight at Teddy's inside the Roosevelt Hotel -- where LiLo has several suites lined up. There won't be a sponsor, but word is it will be a celeb-infested soiree. Sam Ronson won't be working the gig -- the two pals wanna be able to spend some precious time together.
And don't think about crashing the celebration -- sources tell us that security is so tight, everyone entering the party must be cleared by La Lohan herself.
We called Mike Heller from Talent Resources -- the marketing firm that tried to put her original bday bash together -- he had no comment.

If hell seems a little chillier today, here's why: Michael and Dina Lohan wouldn't actually talk about their divorce and their kids in front of cameras and microphones.
We're told that in their brief hearing this morning in Family Court in Long Island, the ex-couple agreed to button up about their matrimonial melee and deal with their issues in private -- except Sunday nights on Dina's reality show.

No wonder these kids are so screwed up: Just a day before Dina Lohan sold out her children for public consumption, Michael Lohan was squiring a pretty young thing he introduced to us as "Lindsay's future stepmom" to Kim K's classy Hamptons party at White House.
We tried getting confirmation from Mike that he and the lucky lady are in fact engaged, but haven't heard back.
