As of yesterday, it is illegal in California to drive and talk on a cell phone without a hands-free device -- a law that Frankie is clearly breaking.

TMZ spotted Mr. Muniz on Robertson Blvd. yesterday, and he was in the company of a rather hot brunette who stayed mum while Frankie chatted with our photog. The "Malcolm in the Middle" star was asked about his New Year's Eve plans, but he said he didn't know what he was doing yet. Sure, Frankie! Perhaps he just didn't want to spill the beans in front of his flava of the day.
A playa never tells!
Lil' Frankie Muniz has made some big real estate deals in the past. Since he was a teen he's been buying and selling property, but TMZ is told that Muniz may not be a real estate prodigy in terms of making a profit. Life's unfair!
The "Malcolm in the Middle" star has just listed his 1,972 square foot, five bedroom and four bathroom Hollywood Hills home for sale -- and according to the LA Times it's going for a little under $3.9 million dollars. But property records indicate Muniz purchased the house in January of 2006 for almost $3.5 mil. According to TMZ's sources, Muniz did "extensive upgrades" on the home. Unless he was in the Home Depot do-it-yourself section, the gain from this property may not be as much as Frankie's pockets would like.
And by the way, he will still have to pay a real estate commission -- which could amount to several thousand dollars. Well, there's always that race car driving hobby -- that's more realistic!

Frankie, 22, did flash his mini-guns for our cameras, but unfortunately, he has the muscles of an 8-year-old. But a very cute and sweet 8-year-old!

Flitting around L.A.: "Dancing with the Stars" semi-celebs Maksim Chmerkovskiy and Cheryl Burke. A sans fat-suit John Travolta exited the stage door at the Hollywood Awards, holding two new mantel pieces, along with fitness freak Kirstie Alley and Janet "not as crazy as the rest of the family" Jackson.

With John Mayer out of the picture, Jessica Simpson found a new musician to fawn over -- Adam Levine. Again.
TMZ spotted Simpson hitting up the Maroon 5 show at the Troubadour on Saturday night, and while Jess and Levine were rumored to have hooked up in the past, the falsetto-voiced frontman was caught with a different blonde later that evening.
Porn king Ron Jeremy was having some fun with a few blondes of his own when cameras caught him signing the chests of some unlucky ladies on Friday.
Mr. Chow was packed this weekend -- with a somber Jessica Alba, Ryan Seacrest with some hot lady arm candy, the always sexy Kim Kardashian, a chatty Chris Tucker and "Coyote Ugly" hottie Izabella Miko all stopping by the Beverly Hills eatery. The one and only Diana Ross put her chopsticks to work as well, and ran as fast as she could from the autograph seekers who swarmed her on the way out of the restaurant.
Also out were a no-longer-"Hollywood" Frankie Muniz, James Blunt, Snoop Doog and Brandy, who has wisely avoided the club scene since her car crash back in December.

Tired of his 3800 sq. ft., $4 million bachelor pad in the Hollywood Hills, "Malcolm in the Middle" star Frankie Muniz has decided to upgrade his shack.
TMZ has obtained exclusive footage of 20-year-old Muniz on the hunt for his dream house, which would take him out of his star-studded neighborhood (Keanu Reeves, Tobey Maguire), and drop the syndie-rich elf into a $12 million cliffside property set high above Los Angeles.
With breathtaking views and ultra-lush landscaping, Frankie's potential palace comes pre-pimped. The 9000 sq. ft. property includes four gargantuan bedrooms, seven baths, a state-of-the-art gym, a garage the size of a church parking lot, and its own nightclub!
Frankie's current place isn't exactly shabby. The 4 bedroom, 4.5 bath pad has a fire-ringed Jacuzzi. Plus, he's already set up the master bedroom with a huge mirror above the bed. Hey, look at me, I'm shtupping!
Frankie's real estate adventure will debut on "Fabulous Life Presents: Really Rich Real Estate," premiering on VH1, November 13 at 10 PM.

TMZ's photo posse hit the streets of LA on Thursday night, which were filled with most of young Hollywood.
We started our night off at the celeb favorite Area and it was a chaotic scene as usual. Outside the club we caught up with "Simple Life" co-star Nicole Richie, rocker Travis Barker, playboy Dennis Rodman, "Girl next Door" cutie Elisha Cuthbert, former "Baywatch" beauty Nicole Eggert and up-and-coming rapper Won G, who stopped to give TMZ a quick shout out.
Next it was off to the newly re-opened Teddy's where the guest list was filled with young and old celebs. Frankie Muniz, former Playmate Traci Bingham, former Mr. J.Lo Cris Judd, Greasy Bear's brother Jason and former boy bander Joey McIntyre were all in attendance.
Our last stop was the Ed Hardy party on Melrose, where we saw MTV's Nick Cannon, Dennis Rodman (once again) and UFC contender, the Huntington Beach Bad Boy, Tito Ortiz who was with his lady friend, porn star Jenna Jameson.

Jesse McCartney is a teen idol -- a hot young singer. The 18-year-old is learning the perks of Hollywood -- that you can illegally enter a nightclub and drink, no questions asked.
This photo of McCartney was taken last Saturday night at Mood, one of the hottest clubs in Hollywood. Under California law, no one under 21 is permitted to enter the club, much less drink inside. But the Corona in Jesse's firm grip tells a very different story.
TMZ has video of other underage stars entering and leaving Mood -- 19-year-old Mary-Kate Olsen, 19-year-old Lindsay Lohan, 20-year-old Frankie Muniz, and the list goes on, though we don't know what they did when they were inside. How do they get away with it?
A Hollywood nightclub promoter, who asked to remain anonymous, was blunt: "Authorities know that there are underage celebrities inside drinking and if they don't care, why should we?" He added the obvious: "Celebrities help to make our clubs more exclusive."
