When not suffering from "mercury poisoning," Jeremy Piven likes to show off his raw and shaved smooth pecs and stomach in Malibu.

The 44-year-old "Entourage" star has been working out his California rolls.

An arbiter has finally ruled in the never-ending saga that was Sushi-Gate -- and agreed that Jeremy Piven did not violate his contract when he bailed on his Broadway play.
In case you forgot -- Piven dropped out of "Speed the Plow" after he was diagnosed with "mercury poisoning," which he claims was caused by eating too much raw fish.
Producers thought it was just plain fishy and filed a grievance.
Lesson here: Ari Gold always wins.

No one believed him before, so now Jeremy Piven is dragging Barack Obama into his war over the "mercury poisoning" excuse he used to get out of a Broadway play a few months ago.

With today's announcement that there will be an arbitration hearing over the matter in June, Piven's peeps just released a statement saying:
"Mr. Piven is looking forward to testifying in Arbitration along with his doctors so that the truth comes out about the very serious health risks caused by Mercury exposure, which the Obama administration has recently described as the world's gravest chemical problem."
Well, if Obama thinks it's a problem -- people have no choice but to believe him now, right?

The adorable 4-year-old resurfaced at a mall in L.A. this weekend with her uncle Jeremy Piven.

Piven's sister is married to Pearl's dad, Adam McKay, who started FunnyOrDie.com with Ferrell.

Jeremy Piven went to Dr. Tea's Tea Garden on Melrose yesterday, home to the "finest quality Asian teas" and herbal products. One thing they don't serve -- Sushi.

Adam Pascal -- "Roger" from the original cast of "RENT," now at the Pantages in L.A. -- put Jeremy Piven on blast last night for using sushi to bail on his Broadway play, calling Piv's excuse "crap" and total bull.

Jeremy Piven -- now famous for bailing on Broadway -- made it a spectator sport last night ... and ran smack into one of the co-stars who was also a victim of too much mercury.

Piven was mum as he left Will Ferrell's show -- ditto for former "Speed-the-Plow" co-star (and "Mad Men" cast member) Elisabeth Moss.

Jeremy Piven's reps have just come out swinging, boasting that during the grievance hearing over his aborted Broadway play, the actor's union sided with him. And Jeremy's reps want you to know, a doctor with connections to two hoity-toity colleges backs him up.
Producers for "Speed-the-Plow" will have to now convince an arbitrator Jeremy's doctor's note claiming mercury poisoning was bogus. In the statement, Jeremy's rep says Piven was so sick he could have had a heart attack if he didn't drop out of the play. So Jeremy did, despite "glowing reviews."
Piven's rep says Jeremy was examined by a "Harvard-educated cardiologist affiliated with Yale." End of story!
And there's this. Piven says he is "pleased with the Obama administration" for seeking an international treaty to reduce Mercury pollution.

The Actors' Equity Association could not reach a ruling today in the hearing involving Jeremy Piven, so now it looks like they might be headed to arbitration.
Piven and the producers were battling over his abrupt sushi-related departure from the Broadway play "Speed-the-plow."
Story developing ...

If Jeremy Piven needs backup when he takes on the official grievance filed by the producers of his Broadway show, then consider Kevin Connolly's statement on Sushi-gate yesterday Exhibit A.

TMZ has learned Jeremy Piven's mercury-poisoning story isn't holding water with the producers of his show -- and they've filed an official grievance with Actors' Equity, the union that handles Broadway stars.
In a statement, one of the the show's producers, Jeffrey Richards, announced, "The producers of SPEED-THE-PLOW have officially filed a grievance with Actors' Equity re: Jeremy Piven's departure. A date for these proceedings is to be determined."
As we first reported, Piv ditched the show two months early, claiming he was suffering from a sushi-induced "mercury poisoning."
We know he was examined by another set of doctors for a second opinion. The results of that exam aren't yet known.
UPDATE -- Jeremy's rep tells TMZ, "The claims made by the producers of Speed-the-Plow are absurd and outrageous. Mr. Piven's serious medical condition has been well documented by multiple physicians. He withdrew from the play due to medical necessity on the advice of his doctors, after he was hospitalized and warned by his physicians that enforced rest was necessary in order to avoid serious medical problems, including a heart attack.
"His symptoms included extreme fatigue, spacial problems, difficulty remembering his lines, difficulty maintaining his balance, and an alarmingly low resting heart rate. Mr. Piven followed his doctors' advice, although his forced withdrawal from the show was an enormous personal disappointment since it was a life-long dream to perform on Broadway."

This is another one of those "celebs get to do whatever they want" situations. Any regular idiot who rushes the stage at a club to keep the beat with the band usually ends up getting beat by the bouncers. Not Jeremy Piven.

The Piv and his natural, beatiful hair hopped onstage last Thursday at the 205 Club in NYC and jammed out with the band -- led by one of the Tommy Hilfiger's boys -- to an AC/DC tune.

Hey Jeremy, go ahead and take as many ladies from the club as you want -- just be sure to leave the open bottle of beer inside next time!
Piven's friend moronically flaunted an open Stella Artois bottle in the passenger seat of Jer's car this weekend outside STK. Not wise: An open container is considered a moving violation and is punishable by a $270 fine.
