TMZ has learned Nicole Richie and Joel Madden are not married, despite what was said in court today.
Mark Geragos, Nicole's lawyer, asked his client during the restraining order hearing this afternoon, "Did you call your husband?" Nicole answered, "Yes."
Sources connected with the case tell us Geragos misspoke and Nicole didn't correct him, but Nicole and Joel are not married. As a result, the restraining order does not cover Joel, though it will cover the kids.

We just got hold of the birth certificate for Nicole Richie's 5-week-old son, but one word was suspiciously missing: Richie.
The newborn boy's full name is listed as Sparrow James Midnight Madden -- no big deal, until you remember Joel Madden and Nicole aren't married ... and their daughter Harlow's last name is Richie Madden.
What's another six letters on an already-mouthful-of-a-name?

Which last name screams "emo punk brothers" more -- Combs or Madden?
Joel and Benji Madden weren't actually Joel and Benji Madden until a few weeks ago -- they were legally known as Joel and Benji COMBS.
According to some court documents, the Good Charlotte twins have officially changed their last name to Madden -- Joel on April 14 and Benji on May 1.

Twins in matching outfits are barely cute when they're babies -- but at 30, it's just offensive.
Coordinating fedoras, guyliner and faux-rocker leather jackets, identical twins Joel and Benji Madden made it impossible to tell them apart yesterday at LAX ... not that anyone cared to anyway.

The DUI Sisterhood of Paris and Nicole used to raise hell whenever they went out together -- then the Brothers Madden came along.
