UPDATE: 7:16 PM ET We just got the papers Mel's lawyer filed with the court, in which he said Mel believes he "cannot have a fair and impartial trial or hearing before Judge Ongkeko." The case has now been removed to Judge Frederick Shaller, but expect the whole case to be handled by a "private judge" -- and that should happen soon.
Mel Gibson already has issues with his divorce -- at least his lawyer does.
We've learned ... Bob Kaufman, Mel's attorney, filed legal papers yesterday to boot the judge from the case -- Hon. Rafael Ongkeko. Each side is entitled to ding a judge from hearing the case, but that can only be done in the first 10 days. Your move Laura Wasser.
Here's the reality. The chances that a judge in the L.A. County Courthouse will actually hear Mel's divorce case are slim to none. That's because both Kaufman and Wasser almost always get a "private" judge to hear their high-profile cases, away from the public glare.

There have been reports that Mel Gibson was having an affair with a Russian singer and that it played a part in the break up of his marriage -- Mel has denied it, and now the singer is sounding off too.
TMZ spoke with a rep for Oksana Kolesnikova, who gave us the following statement: "Sorry to hear about Mel Gibson's divorce. Somehow Oksana is being linked to Mr. Gibson, but there are no emotional ties between the two that I am aware of.
Oksana has in the past entertained Mr. Gibson with her piano music as he dined at the Polo Lounge at the Beverly Hills Hotel.
Yes, I definitely welcome the opportunity to set the record straight, our Oksana is not romantically involved with Mr. Gibson."
There it is -- you buyin' it?

Mel Gibson has filed his response to wife Robyn's divorce petition -- and it only took a matter of hours.

Gibson, unlike his wife, gives a specific date of separation -- the papers say the date is August 26, 2006. The date is hugely significant -- Mel's infamous DUI arrest was less than a month earlier -- July 28, 2006. Gibson cited irreconcilable differences.
As we reported, Robyn and Mel grew apart after the arrest. The date Gibson lists for separation confirms this.
Gibson also lists "irreconcilable differences" as the reason for the divorce.
Gibson is repped by prominent divorce lawyer Robert Kaufman, whose celeb clients include Jennifer Aniston, Jessica Simpson and Reese Witherspoon.

We've learned Mel Gibson's wife Robyn has just filed legal papers to divorce Mel Gibson, her husband of 28 years, citing "irreconcilable differences." Pretty ironic -- Robyn signed the papers the day before Good Friday.

Sources tell us there is no prenuptial agreement -- they were married in 1980, before Mel Gibson amassed a fortune estimated at $900 million back in 2006. Under the laws of California, community property -- which includes earnings -- is divided 50/50.
The Gibsons have 7 children, but only one -- Tom, who turns 10 tomorrow -- is a minor. In Robyn's legal papers, filed this morning in L.A. County Superior Court, she seeks joint physical and legal custody of Tom.
Robyn is also asking for spousal support and attorneys fees.
Robyn lists the date of separation as "to be determined." This is important, because earnings generally cease to be community property when the couple separates. There could be a skirmish over this. We're told the couple grew increasingly apart over the last few years, especially since Mel's drunk driving arrest in 2006.
There have been reports that Mel has been involved with another woman, which the actor denies, but we're told the reasons for the divorce go beyond any third party.
If there is a fight, Robyn is in good hands -- she's repped by disso-queen Laura Wasser, who has handled divorces for the likes of Angelina Jolie, Britney Spears and Stevie Wonder.
UPDATE: Robyn and Mel Gibson just issued a statement: "Throughout our marriage and separation we have always strived to maintain the privacy and integrity of our family and will continue to do so."
Sources tell TMZ the couple has been separated for more than 2 1/2 years. We'll see if Robyn agrees. Again, the separation date is important in dividing assets.

TMZ has learned the Los Angeles County Sheriff's Department has gone after the deputy who arrested Mel Gibson with a vengeance. At the same time, it appears little has been done to determine if top brass gave Gibson special treatment and deceived the media.

Sheriff's sources confirm to TMZ that the Department obtained a search warrant and raided the home of Deputy James Mee on September 13th. We're told deputies went inside and took Mee's computer, phone records and other documents. Sheriff's Department sources say the Department got the warrant because officials believed Deputy Mee leaked four pages of the original arrest report to TMZ. The Sheriff's Department claims it's a crime for a law enforcement officer to leak confidential documents.
The warrant is still sealed and the results of the search have not been made public.
TMZ contacted Mee's lawyer, Richard Shinee, who would not comment on the warrant.
Meanwhile, the Sheriff's Department claims it is still investigating charges that Department officials gave Gibson special treatment and lied to the media the day of the arrest.
The day Gibson was busted, Sheriff's officials told TMZ and other media that the arrest occurred "without incident." Nothing could be further from the truth. Gibson acknowledged his out-of-control behavior on today's "Good Morning America."
Also on the day of the arrest, Sheriff's officials told TMZ that the story it was about to publish documenting Gibson's anti-Semitic remarks and vulgar conduct was "absolutely false." Only after TMZ obtained portions of the arrest report did the Department change its story, ultimately telling TMZ the entire report would be submitted to the D.A.
As of today, no one from the Sheriff's Department has contacted TMZ to ask questions about the website's interactions with top Sheriff's brass on the day in question. By contrast, a Sheriff's official did contact TMZ's Managing Editor Harvey Levin to ask about the leak. Levin refused to give the deputy any information.
Sheriff's spokesperson Steve Whitmore told TMZ that everything is being done to make sure that the L.A. County Sheriff's Department is doing "everything which is right."
Michael Gennaco, Chief Attorney for the Office of Independent Review, the oversight panel for the Department, tells TMZ the Sheriff's Department cannot do a "complete and robust" investigation into the way the Department handled the case until the criminal investigation into the leak is resolved.
