Eric Dane and Rebecca Gayheart are looking to settle the score with the website that published their naked non-sex threesome tape.
Dane and Gayheart filed a lawsuit today in L.A. County Superior Court, claiming Gawker.com had not only unlawfully posted almost 4 minutes of the private video that was shot behind closed doors, but "maliciously" distributed the video and included nude shots of the fabulous threesome -- the third wheel was former beauty queen Kari Ann Peniche.
Dane and Gayheart want more than $1 million in damages. Their lawyer -- legal pit bull Marty Singer -- is also asking for an injunction to pull the plug on the video.
UPDATE: 5:30 PM ET: Gawker's publisher, Nick Denton, just twittered his response to the lawsuit: "To quote the great Marty Singer -- Eric Dane's lawyer -- if you don't want a sex tape on the internet, 'don't make one!'"

A memorial was held for DJ AM last night at the Palladium in Hollywood -- and a random array of stars showed up to pay their respects.
Robert Downey Jr., John Mayer, Lindsay Lohan, Samantha Ronson, Scott Caan, Tom Arnold, Dr. Drew and director Jon Favreau were all seen making their way into the venue.
Also there: Eric Dane and Rebecca Gayheart, making their first public appearance together since their "naked" tape leaked last month.

Fully dressed and not recording his wife in a tub with another chick, Eric Dane emerged from his home for the first time since that nude threesome video hit the Internet and went to the gym in L.A. yesterday.
The 36-year-old "Grey's Anatomy" star has to keep his body in shape for his next home video movie.

He's only a puppy -- but Kari Ann Peniche's 18-month-old doggie may have already had a dangerous brush with cocaine.
It all went down back in July -- back before Kari Ann's naked threesome tape surfaced with Eric Dane and Rebecca Gayheart. Peniche's house sitter noticed her Pekingese puppy "Buster" began to vomit, experience diarrhea, and twitch uncontrollably.
Kari Ann had a house sitter because she was shooting Dr. Drew's "Sober House" at the time. When she found out her pooch was in distress, she immediately left the rehab facility and rushed home to take him to the vet .
According to the veterinary report obtained by TMZ, Kari Ann told the doc Buster may have been exposed to Xanax, cocaine, methamphetamine or other unknown drugs.
So how would Kari Ann know about Buster's exposure to drugs? It's a mystery. What we do know is that Mindy McCready was living in the house at the time. Mindy told us, "I've never hurt an animal and I don't do any drugs." For the record, Mindy pled guilty in 2004 for using a fake prescription to buy OxyContin.
After the vet ran tests, it was determined Buster was suffering from "unknown toxin/drug exposure." But don't worry, Buster was treated and eventually recovered.

The other girl in the bizarro 3-person naked romp vid with Eric Dane and Rebecca Gayheart wants everyone to know she was "just having fun with my friends."
Last night at a gas station in West Hollywood, a clothed Kari Ann Peniche told us she's unsure if she'll be taking legal action against her former roommate/singer Mindy McCready -- who Peniche claims stole the tape from their apartment after a dispute over money.
As TMZ first reported, Dane owns the rights to the video and is planning to sue anyone who publishes it.

Eric Dane and Rebecca Gayheart did not have sex with Kari Ann Peniche -- but according to Peniche, they had plenty of fun.
Kari Ann -- a dethroned Miss United States Teen -- tells TMZ the video featuring the whacked-out naked trio was shot more than two years ago in her apartment. Kari Ann insists there was absolutely no sex involved -- they played dress up and the two women then soaked together in a bathtub as Eric called "action" behind the camera.
In the video, Gayheart says her "alter-ego" name is "Nina," Kari's is "Fifi" and Dane goes by "Peter," "Cocaine Manor," "Tristan Daily," and "Tuff Hedeman," a famous bull rider.
Kari Ann says the video was stored on the hard drive of her computer, but stolen by Mindy McCready, who was her roommate after the two completed a stint on the TV show "Celebrity Rehab." Kari Ann says she got into an argument with McCready over money and believes the singer took her hard drive when she moved out. Kari Ann freaked out about certain personal information about her on the hard drive and filed a stolen property report with the LAPD.
Last month there was a summit between Eric, Rebecca, Kari Ann and Mindy. Their reps hammered out a deal as to who got what on the hard drive. Eric got full rights to the video and everyone assumed that was that ... until the tape surfaced on the Internet yesterday.
So a little song, a little dance a little betrayal down your pants.

It didn't take long -- TMZ has learned there's already a legal war raging over the Eric Dane, Rebecca Gayheart naked threesome tape.
Legal pit bull Marty Singer, who reps Dane and Gayheart, tells us he will sue anyone who publishes the video, which he calls "a private, confidential tape."
Singer says he just spoke with third wheel Kari Ann Peniche and asked how the tape got leaked. Her response: "I have no idea. I had nothing to do with it."
As for reports there's a full-blown, uncensored sex version of the tape, Singer said, "From what I've seen it's a naked tape, not a sex tape." Singer added, "At most it's 3 people maybe wanting to have sex."
And that's why we love Marty Singer.

The newest celebrity XXX tape has already hit the Internet -- a threesome -- this one featuring "Grey's Anatomy" star Eric Dane, his wife Rebecca Gayheart and a former beauty queen//Hollywood madam named Kari Ann Peniche.
In the video -- which was first posted by Gawker.com, Gayheart and Dane take turns filming as the naked trio hangs out in Peniche's Southern California apt. It appears they are all seriously inebriated in some way -- at one point Rebecca can be heard saying she needs to lay down because she's so high.
At the end of the tape, Gayheart and Peniche are nude in a bathtub together, while Eric films them. According to Gawker, the 3-minute clip is cut down from roughly 12 minutes of footage.
So far, no statements from anyone's reps.

Car drama seems to follow Rebecca Gayheart wherever she goes.
Although "car issues" almost kept Rebecca and her "McSteamy" husband, Eric Dane, from getting to the SAG Awards last night, luckily -- it was just the battery that died.

It was a hodgepodge of celebs at the opening of Intermix last night -- with the guest list comprised of everyone from Kanye West, who gave the thumbs up to 50 Cent, to hapless Rebecca Gayheart.
TMZ was outside of the opening bash for the clothing store, where a sloppy Pauly Shore was looking for free goods, Jamie-Lynn Sigler was looking fierce, and Perez Hilton was just looking for attention.
Also there: a belly-baring Kim Kardashian, the always fashionable Justine Bateman, and former "Dancing" star Stacy Keibler. Standing out in the mix, TMZ's very own lip-smackin' reblondered, Arby's lovin' hottie, Gillian Sheldon. Sorry boys, she's engaged!

Rebecca Gayheart fell in love with hubby Eric Dane all over again -- and felt him up -- during their recent romantic Italian rendezvous.
The "Grey's Anatomy" star and his wife Rebecca chartered a yacht and went diving during their vacation in Porto Cervo, and cuddled up while on board. Gayheart conducted an extensive physical exam of Dr. McSteamy, with a special emphasis on his private parts. Frisky!
Later, a topless Gayheart took snaps of her happy hubby.

Lindsay Lohan can get anyone into a club -- but her new boytoy Calum Best can't get out without LiLo!
TMZ spotted the couple at Bungalow 8 in Manhattan, where they got the VIP treatment -- whisked right into the club. Calum then faced the Wrath of the Doorman when he turned back to try to get his buddies inside. The door guard quickly grabbed Calum's arm, pushed him back in the club, eliciting a "What the f**k?" face from Best, as the guard slammed the door in his face -- leaving Best's pals stranded outside!
Other couples spotted in New York last night: McSteamy Eric Dane and wife Rebecca Gayheart, Charlie Sheen with girlfriend Brooke Mueller and an unknown blonde, and Ed Burns with supermodel wife Christy Turlington.

TMZ brings you the Chinese New Year installment of Star Catcher!
Comedian Katt Williams got the day started by exiting Newsroom Cafe with his entourage. Come nightfall, Mr. Chow was the place to be, as tennis great Serena Williams, comedian Pauly Shore and "Lost" guest star Bai Ling celebrated Chinese New Year with chopsticks at the popular Beverly Hills eatery.
Nightcrawler Michelle Trachtenberg battled crowds entering new hotspot Winston's, while Nicky Hilton left the lounge through a back exit. "X-Men" director Brett Ratner got hounded by a fan outside of Chateau Marmont, while his former girlfriend, Rebecca Gayheart, made a getaway with a friend in tow.
