The Los Angeles Dodgers have gone on record in the "War of the Roses" divorce between Frank and Jamie McCourt, claiming the family court should butt out of Dodger business. And, for good measure, the Dodgers claim Jamie was fired for allegedly having an affair with a subordinate ... and the team goes into detail.
In legal papers filed with the family law judge, the Dodgers organization is asking to be heard as a friend of the court, opposing Jamie's bid to be reinstated as CEO of the operation.
The Dodgers organization claims, "Simply stated, this Court has no jurisdiction to order the Dodgers to do anything because it is a non-party to these proceedings."
According to the legal docs, obtained by TMZ, the Dodgers claim Jamie "has been paid her $2,000,000 a year salary in full through December 31, 2009. She was an at-will employee. The marital dissolution should not be used to interfere with the lawful control and management of the Dodgers."
And get this ... the legal papers state, "Given the dysfunction which was caused by the Petitioner's prior employment, her inappropriate relationship with a subordinate employee and the clear acrimonious relationship between her and Mr. Court (sic), if she were reinstated by order of this Court it would no doubt lead to this Court being called upon to oversee the day to day management of the Dodgers."
The Dodgers allege Jamie was fired "for having an inappropriate relationship with a subordinate employee, Mr. Jeff Fuller, her self-described '24 hour driver' and '24 hour security.'"
The Dodgers grouse that Jamie wants the Dodgers to reinstate her as well as Fuller -- "Translation: She wants the Dodgers to pay her live in boyfriend for his companionship" while working for the organization.

Looks like Jon Gosselin won the birthday battle against Kate -- because instead of leaving at 6pm, he just told us he'll be staying 'til he can "put my kids to bed."
After the celebration, Jon came out to get some face time with his BFFs, the paps -- saying he and Kate made it "cordial" for the twins on their birthday ... and there's no way he'd be spending the night.
Probably a wise decision.

Robin Wright Penn just filed for divorce from Sean Penn ... again ... making it the third time the couple has attempted to split thus far.
Robin filed the papers in Marin County, California on August 12, in which she explains that the couple has already decided to "share custody" of their 16-year-old son Hopper Jack.
According to the documents, obtained by People.com, Robin cites "irreconcilable differences" for the split -- even though they've already reconciled twice before.
The papers also explain, "the estranged couple have already agreed to division of all property."
Sean and Robin were married in 1996.

They've split and Kate Gosselin says she holds no hope of getting back with Jon -- but this morning on "Today" she was still wearing a suspicious piece of jewelry: her wedding ring.
Kate says she wears it because she doesn't "want to upset" the kids. Scroll to the four-minute mark for the waterworks.

TMZ has learned Kelis has finally given birth to her son with estranged hubby Nas -- and this time, he was allowed into the hospital to see 'em.
After nearly three days of labor, Kelis gave birth to son Knight Jones last night -- and while Nas was not in the delivery room, he was outside and he did get to see his baby.
As we first reported, Nas had tried to visit Kelis in the hospital while she was in labor the night before -- but was turned away because he was too wasted.

Tameka Foster, the woman who Usher seems bent on divorcing, will not let a little thing like divorce papers get in the way of her marriage. Exhibit A: She's still wearing her wedding ring.
We got the shot at LaGuardia Airport in New York yesterday. Usher seems more than ready to cut ties. We got him at LAX this week minus his wedding band.

Fresh from looking at apartments at Trump Place in NYC, Jon Gosselin was spotted outside his Pennsylvania home on Friday ... wearing his wedding ring.
Think he'll still have it on after that big announcement on Monday's "Jon & Kate plus 8"?!

Sean Penn has filed for legal separation from his wife, Robin Wright Penn -- again, and he's not about to start fronting her legal bills.
According to papers filed last week in Marin County Superior Court, Penn cites "irreconcilable differences." The couple was married 13 years and has two minor children.
Penn wants each party to pay for their own lawyers. And, he checked the box saying he wants the judge to terminate the court's power to award spousal support.
The couple announced they were divorcing in December 2007 -- but recanted four months later after changing their minds.
They list two minor children -- but Dylan Francis Penn just turned 18, so she's not a kid anymore. Just trying to be helpful....

Britney's back, and the newest bachelorette is popping up (and out) everywhere. It started with her drive-by appearance on Letterman on the night before filing divorce papers. The very next night, she was caught at a New York City Gap store shopping for cotton thong panties and clothes for an evening of ice skating at Rockefeller Center with an old friend ...
That old friend was her former manager, Larry Rudolph, the man who transformed Britney from former Mouseketeer into America's reigning Pop Princess. His relationship with Brit was solid until K-Fed came along. Kevin reportedly had a problem with Larry, and Brit chose Fed over Rudolph. Just one night after she left K-Fed, she reunited with Rudolph; it appears they were in talks before Brit's split.
Now, old television commercials for Britney's fragrances have begun popping up in time for the holidays, and rumors of musical collaborations with the likes of Pharrell, and a surprise appearance at last night's AMAs, are signs that the hard-working Britney Spears is definitely back. One thing she's retained from her K-Fed days; that awful gum-chewing. At least she tucked her gum to one side of her mouth while she presented the AMA to Mary J. Blige. Classy.
Meanwhile, there are rumors of a surprise superstar appearance at Los Angeles radio station 102.7 KIIS FM's annual concert, Jingle Ball. Our guess: It's gonna be Brit.

Britney Spears showed up to Sony Music Studios late last night with her security detail and her, um, two closest friends in tow.
She pulled up in a stretch limo and waited inside the car until security was prepared to open the doors to let her in the building. One member of security can be seen on the phone calling for someone to let them in, warning the paparazzi, "No one stops our feet, OK?!"
Britney emerged from the car wearing an extremely revealing collared shirt, and rushed passed photogs as they yelled, "Britney, you look gorgeous." We concur.
Photogs spotted Britney earlier in the week wearing a gazonga-revealing outfit. Splitting with K-Fed has done wonders for the girl(s).

It doesn't seem like Heather Locklear is having trouble moving on from her reported split from David Spade. In fact, the blonde beauty was all smiles as she left Mastro's steakhouse in Beverly Hills Friday night, arm in arm with a new mystery man.
According to several media reports, Heather and David called it quits last week after a rumored six-month romance. However, a source tells People magazine, "Heather is still going through a lot with Denise (Richards) and Richie. It's just too soon for her to get serious. They are still friends. It's not ugly."
Update 5:53PM ET: The mystery man has been revealed to be realtor Bill Small of Aspen, Colo. Small specializes in selling high-end, exclusive residential properties. Bill is no dummy either. Heather's arm candy is a member of the United States Supreme Court Bar association and holds a Juris Doctorate degree from Seattle University School of Law as well as a BA from the University of Maine.
Is Heather in the market for a new house or a new relationship??

Cute as they may have been, Mandy Moore and Zach Braff have decided to call an end to their year and a half relationship. Citing a nine year age difference as one of the factors, the pair ended things on friendly terms. Mandy made appearances on "Scrubs" earlier this year alongside then boyfriend Zach.
