Kevin O'Leary Mum on Fatal Boat Crash ... Wife Gets Big Break in Case

Kevin O'Leary arrived in L.A. Monday night, and he has reason to breathe a sigh of relief, because prosecutors have backed off their claim his wife could be jailed over their fatal boat crash.

Kevin arrived at LAX and didn't want to talk about the case much -- where his boat slammed into another boat on a Canadian lake in total darkness. Two people in the other boat were killed. Prosecutors filed a charge against the driver of the other boat for not having its navigation lights on. Kevin's wife, Linda, was also cited for driving too fast.

Prosecutors have now admitted they were flat-out wrong when they told us Linda faced a maximum of 18 months in prison and a $1 million fine if convicted. We contacted prosecutors and said our reading of the law was different and clear ... that she only faced a $10,000 fine and no jail time. Now they've admitted, they were wrong -- the max is indeed a $10k fine.

Linda's in court Thursday. We're told she plans to fight the charge, claiming she was not going too fast.

1:39 PM PT -- Linda's lawyer, Brian Greenspan, tells TMZ, Canadian authorities have got it all wrong.  Greenspan says the penalty they're citing -- 18 months maximum in jail or a $1 million fine -- is for ocean-going vessels. The maximum penalty for pleasure craft, he says, is a $10,000 fine with NO jail time. Greenspan also says it's ridiculous to charge Linda when the cause of the crash was the other boat not having navigation lights on in the middle of a dark lake.

The wife of "Shark Tank" star Kevin O'Leary has been charged with driving their boat carelessly in the fatal boating accident last month, but the other driver was also charged with a crime.

TMZ has learned the Ontario Provincial Police (OPP) charged Linda O'Leary with "careless operation of a vessel." TMZ broke the story ... O'Leary's boat was on Lake Joseph August 24 when it slammed into another boat, killing 2 passengers.

Our sources say the OPP obtained 5 videos from cameras trained on the lake and they concluded she was driving 17 MPH at around 11:30 PM ... which police say was not a safe speed.

But, the OPP also charged the driver of the other boat, Richard Ruh. The OPP says he was driving without navigation lights. As we reported, this seemed to be the core of the case -- and our sources say the driver had insisted the lights were on, but police say the video shows otherwise.

We're told Linda is going to "vigorously fight the charge." OPP spokeswoman Carolle Dionne tells us Linda's alleged crime carries a maximum sentence of 18 months in jail or a $1 million fine.

Kevin was not charged with any offense, but he told us through his agent, UTA honcho Jay Sures, "Now that the authorities have concluded their thorough investigation, I have no further comment other than to say that our thoughts and prayers are with the friends and families of those who lost loved ones in this awful tragedy. Our hearts go out to them."

Kevin O'Leary Back in the Shark Tank ... After Fatal Boat Crash

Kevin O'Leary is back in front of the cameras after his fatal boating accident ... shooting new episodes of "Shark Tank."

O'Leary was spotted Monday at LAX ... our 'Tank' sources tell us he's resumed a normal shooting schedule and it's business as usual. O'Leary appeared to be flying solo at the airport. Our sources say no one on the set referenced the tragedy on the Canadian lake, which left 2 people dead ... at least nothing was talked about out in the open.

Meanwhile, Canadian law enforcement officials continue their investigation into the crash. We're told cops have been speaking with witnesses -- including those on the boat that was hit -- to determine what happened. A resident on the lake tells us ... last week police took several witnesses to the spot they were at when Kevin's boat crashed into another vessel carrying 8 people.

The investigation comes down to one issue ... did the boat Kevin's wife hit have its navigation lights on? If they were on, it was probably the wife's fault. If they were off, probably not.

We're told the boat that was hit was only 2 weeks old and had state-of-the-art technology that produced all sorts of data. That data almost certainly would tell investigators whether the lights were on.

O'Leary insists the other boat did not have its lights running. Sources tell us Kevin has obtained video -- which we believe to be from his dock -- that captures the area where the crash occurred. Problem is ... it was so far away, it's not clear to the naked eye.

We're told he's hired a company that specializes in video enhancement to determine if the other boat had its lights on.

Barbara Corcoran has found herself in an envious position -- she has too many beachfront properties in New York ... so she's looking for somebody to take one off her hands.

Of course, Barbara's Saltaire home is located in a seasonal hot spot south of Long Island, so instead of selling and leaving the summer life behind ... she just went and bought another one ... right next door.

We're told Barbara bought her new summer spot for $3.3 mil ... so consider it an upgrade. As you can see, it looks more than fit for a 'Shark' like her.

Kevin O'Leary Boat Crash Victim ... Education Fund For Her Kids

There's a $20k education fund to help the children of the woman killed in the fatal Kevin O'Leary boat crash, and the campaign was set up by the son of the other victim killed in the incident.

Alex Poltash, whose father Gary died in the tragedy, is the man behind the GoFundMe for Suzana Brito's three children -- 12-year-old Liam, 11-year-old Ruby and 9-year-old Cash. Alex says the money is going into an education fund for the kids, and it's a way to carry on his dad's legacy.

The way Alex sees it ... his father was a true believer in the power of education, and the crowdfunding effort is an appropriate way to honor his pops, who was friends with Suzana.

We broke the story ... Kevin's boat was involved in a fatal crash last month on Lake Joseph in Ontario, Canada. Two people were killed and 3 others were injured.

Multiple sources with knowledge tell us, police are looking at whether the boat that was hit had its navigation lights on. Kevin insists they were not on, but we're told people on the other boat insist the lights were on, Kevin's boat was going too fast and the driver -- Kevin's wife -- wasn't paying proper attention.

Suzana, a 48-year-old single mother, died in the hospital after suffering horrific injuries in the wreck.

9:00 AM PT -- 8/28 -- The woman who was critically injured in the accident has died, according to Ontario Police. 48-year-old Susanne Brito passed away on Tuesday as a result of her horrific injuries.

Police also revealed the other fatality was Gary Poltash, a 64-year-old man from Florida. Three other passengers were injured, but treated and released from a hospital.

8:04 AM PT -- 8/28 -- Sources connected to Kevin tell TMZ, the "Shark Tank" star says there is video that captures the area of the lake where the collision occurred, and he is looking to get the video enhanced to prove the navigation lights on the other boat were NOT on. Kevin believes this will exonerate his wife and him. However, sources connected to the other boat owner insist the navigation lights on that boat WERE on at the time of the collision.

8:10 PM PT -- O'Leary tells TMZ, "Late Saturday night I was a passenger in a boat that had a tragic collision with another craft that had no navigation lights on and then fled the scene of the accident. I am fully cooperating with authorities."

He goes on ... "Out of respect for the families who have lost loved ones and to fully support the ongoing investigation, I feel it is inappropriate to make further comments at this time. My thoughts are with all the families affected."

A rep for O'Leary tells TMZ Kevin's wife was driving the boat at the time of the crash, and she was administered a DUI test that night and passed. He also says a third person was in Kevin's boat and was injured -- she went to the hospital, received stitches and left.

O'Leary's rep wanted to clarify ... it was the other boat that fled the scene. As we reported below, a source connected to the owner of that other boat said it was Kevin's boat that fled.

Kevin O'Leary's boat was involved in a crash in Ontario, Canada that left one man dead, and a woman critically injured ... TMZ has learned.

The accident happened on Lake Joseph late Saturday, around 11:30 PM when a smaller boat -- owned by O'Leary -- rammed into a larger boat ... going directly over its bow and striking a male passenger in the head, killing him instantly.

A source connected to the owner of the larger boat tells TMZ ... they told police after impact there was enough light to ID the people on O'Leary's boat -- and the owner said it was O'Leary and his wife. We cannot confirm it was Kevin and his wife.

However, we've spoken to Kevin about the accident and he said he was following police protocol and would not comment. As for what the protocol is ... we're told cops will not release any names involved in the accident unless criminal charges are filed.

We're told O'Leary's boat immediately left the scene of the accident -- but it was towed to the marina on Monday by a salvage boat with police onboard ... who've seized it for forensic testing.

Multiple sources tell us a critical element of this investigation is whether the larger boat had its lights on ... so people on O'Leary's boat could see it at the time of impact.

Kevin appears to have at least 2 boats on the lake. While it's unclear which was in the wreck, a witness described it as a wakeboarding boat. Kevin's posted a pic of his "BatBoat" and bragged about using it for "surfing" on the lake.

Our source says there were a total of 8 people on the larger craft. The fatality is reportedly a 64-year-old man from Florida ... while the injured woman is a 48-year-old Canadian citizen. She is reportedly on a ventilator with significant brain damage.

Cops haven't said if alcohol was involved.

Kevin and his wife have a lake house in the area, and they've posted several photos from the home, and on the lake.

He wrote of the property on Instagram, "I call this the “Wedge” it’s a natural phenomenon of nature located where our lake house home is situated! Just beautiful!"

The "Shark Tank" star and Dallas Mavericks owner hit up The Happiest Place on Earth Wednesday and took a break from milling around with the summertime masses to chow on some popcorn and down some bottled agua.

Mark was there with his wife, Tiffany, and their 3 kids -- Alexis, Alyssa and Jake. The Cuban fam was joined by some friends as they hit up the Indiana Jones Adventure and the all-new Star Wars: Galaxy's Edge.

Looks like the billionaire's in fully vacay mode. Just a couple of days ago, he went on a fishing trip with his son.

BTW ... the Cubans looove them some Mickey. They were also at Disneyland and California Adventure Park less than a month ago.

God, we hope Mark can afford that Disneyland Annual Pass!

Robert Herjavec is expanding his real estate portfolio ... TMZ has learned the "Shark Tank" star just picked up a beautiful, massive pad outside L.A. and in Kim Kardashian's backyard.

Sources familiar with the deal tell TMZ ... Robert just snatched up a recently renovated home in Hidden Hills. We're told he paid close to the asking price of $15.5 million.

The place is pretty sick ... the estate sits on 1.7 acres and the 13,000-square-foot home has a whopping 7 bedrooms and 9 baths -- plenty of space for Robert and his wife, 'DWTS' alum Kym Johnson and their 1-year-old twins.

It's also loaded with tons of lavish amenities ... we're talking pool, tennis court, playground, gym and a home theater. The sweeping property also features trails for hiking and riding horses -- and a guest house ... y'know, for the in-law visits.

Kevin O’Leary firmly believes Nike fully manufactured the controversy surrounding the Betsy Ross Flag shoe and Colin Kaepernick ... and he says it's brilliant.

We got the "Shark Tank" investor leaving the "Squawk Box" show Wednesday morning in NYC and had to ask him about the heat Nike's catching for recalling its special Betsy Ross Flag Air Max 1 USA sneakers.

Kevin says that while Nike made a mistake getting the Betsy Ross flag involved to begin with ... the shoe giant knew exactly what it was doing when it yanked the shoes -- creating a firestorm of free marketing. 

As you know, Kap felt the 13-star flag design prominently featured on the heel was offensive because it's been co-opted by several white nationalist groups. Nike felt Colin made a valid point and pulled the plug on the shoes. 

Kevin says Nike's gotten good at this ... just look at what happened when the Swoosh signed Kaepernick as a spokesman. Nike's stock rose, sales also jumped -- controversy validated.

The "Shark Tank" star's Hollywood Hills house was burglarized ... according to law enforcement sources. We're told a thief or thieves hit his pad last weekend, busting in through a window and making off with more than $100k worth of jewelry, cash and some other items.

Our sources say Herjavec's security alarm was not activated at the time of the break-in, so cops weren't called to his place until he got home and discovered it. We're told it's unclear if this heist is connected to other burglaries in the area.

Shame, Robert and the rest of his 'Shark' pals didn't strike a deal with the inventor of Ring (which used to be called DoorBot) when he was on the show. One of those would've come in handy.

CFL's 'Poop' Johnson Tapped By Butt Wipe Company ... From 'Shark Tank'

Who better to promote butt wipes than a guy named Cory "Poop" Johnson?!

That's what the guys at Dude Wipes thought -- and reached out to the Canadian Football League player to help push their personal hygiene line.

Of course, Poop -- a defensive lineman for the Toronto Argonauts -- got his legendary nickname after a famous interview during his college days at Kentucky, where he admitted he poops like 5 times a day.

"I try to poop, like, 5 times a day, 3 times a day. It’s hard to keep weight when you’ve got so much going out," Johnson said at the time.

We're told the Dude Wipes guys sent Poop a bunch of free products -- you can see the pics -- and the assumption is they'd like to have some sort of business relationship moving forward.

It's not a bad investment for Dude Wipes -- the 26-year-old is a pretty solid player with the potential to make the jump to the NFL if he balls out in Canada.

And, now that he doesn't have to worry about how to keep his booty hole clean, he can spend more time crapping all over quarterbacks.

Kevin O'Leary does NOT agree with Colin Kaepernick's kneeling -- but he DOES respect a good financial haul ... which is why he's praising CK for settling with the NFL.

"I think the outcome was good for him," the "Shark Tank" star told us on his way out of Craig's.

"He was not the best QB in NFL history, but he monetized the situation in a good way. And, I appreciate that as an entrepreneur."

The terms of Colin's settlement are confidential -- but some NFL reporters are saying CK walked away with close to $100 MILLION for agreeing to end his collusion case.

Kevin says Colin has turned himself into a brand -- which is REALLY hard for pro athletes to do.

But, when it comes to Colin's chances of making an NFL roster, Mr. Wonderful says there's "not a chance in hell" he ever makes it back to the league.

"He will never play in the NFL ever. Not in this lifetime and not in 10 lifetimes."

As for Colin, he has yet to speak about the settlement -- but took a photo with his legal team the day after his announcement ... and judging by the smile on his face, he sure seems like a guy who thinks he won.
