Elijah McClain's Mom They're Covering Up His Murder ... I Want Life in Prison for Cops Who Killed Him

Elijah McClain's mother firmly believes cops killed her son and the City of Aurora, CO covered it up, and though she desperately wants justice ... she's not getting her hopes up.

Sheneen McClain tells us she feels helpless and hopeless -- even despite a reopened investigation into her son's death -- because she thinks cops have already gotten away with murdering Elijah with the help of an "elaborate cover-up" ... and she can never get him back.

As we reported ... Colorado Gov. Jared Polis has appointed a special prosecutor to look into McClain's death, but Sheneen's not impressed. She suggests it's all for show, and calls it "just another song and dance" in hopes the story will go away.

The good news ... Elijah's story is not going away -- at least with the general public. In fact, the renewed interest in his case led to 3 million people signing a petition calling for his death to be investigated ... and it certainly seems to have influenced the Governor's decision.

Polis said, "Elijah McClain should be alive today, and we owe it to his family to take this step and elevate the pursuit of justice in his name to a statewide concern."

Though McClain's family attorney, Mari Newman, pointed out that, "It shouldn't take a petition signed by millions to hold police accountable when they kill an innocent black man" ... Sheneen did say she's happy Elijah's story is spreading.

What would really make her feel better though ... is justice for her son. She tells us what she wants is the cops involved in his death to get sentenced to life in prison ... and for anyone else who played a part to be held accountable and punished.

Sheneen sounds like she believes it will be an uphill battle though ... and it's hard to blame her. The D.A. initially decided not to charge the officers, saying their actions were "legally" justified.

He added ... "While the officers no doubt used force in this incident, based on the evidence and the law applicable at the time of Mr. McClain's death, the prosecution cannot disprove the officers' reasonable belief in the necessity to use force."

Still, Elijah's mom -- and at least 3 million other people -- are holding out hope that justice will be served.

Elijah McClain Death Colorado Gov. Reopens Case ... Special Prosecutor Now Investigating

Colorado authorities are taking a second crack at investigating the death of Elijah McClain, who died last year after being stopped by police, and put into a chokehold.

Governor Jared Polis appointed a special prosecutor Thursday to reopen the inquiry into Elijah's death and potentially prosecute the cops who were involved.

As you've probably read ... Elijah died back in August 2019 after police stopped him on a street in suburban Denver. His story has gone viral this week, and become a rallying cry for protests against police brutality and systemic racism.

Mari Newman -- the attorney for Elijah's family -- tells TMZ ... "It shouldn't take a petition signed by millions to hold police accountable when they kill an innocent black man."

The Governor is putting state Attorney General Phil Weiser on the case and Polis says, "Elijah McClain should be alive today, and we owe it to his family to take this step and elevate the pursuit of justice in his name to a statewide concern."

Polis says he was moved to act in part because of Elijah's mother, who described her son as a "responsible and curious child ... who could inspire the darkest soul."

Aurora PD officers stopped Elijah on August 24, 2019, while responding to a call about a suspicious person walking the streets wearing a ski mask and waving his arms. His family says he commonly wore the mask to keep warm ... due to his anemia.

Cops say Elijah refused to stop walking down the street and resisted when police confronted him and attempted to place him in custody. One of the cops placed Elijah in a chokehold.

Body-camera footage of the incident shows Elijah telling the cops, "Let go of me. I am an introvert. Please respect the boundaries that I am speaking." His words are now popping up on social media posts demanding justice.

Cops reportedly kept Elijah on the ground for 15 minutes, and then paramedics gave him a sedative. Elijah suffered cardiac arrest on the way to a hospital and was declared brain dead on Aug. 27 -- and he was taken off life support a few days later.

YouTube Star Jenna Marbles Apologizes for Past Vids, Quits Channel ... 'I Want to Hold Myself Accountable'

Jenna Marbles -- one of YouTube's original vloggers with more than 3 billion views -- has apologized for past content and announced she's quitting her channel.

Jenna posted an 11-minute video to her more than 20 million subscribers on her YouTube channel and offered a tearful apology for content that included impersonating Nicki Minaj in blackface, rapping a racist song and slut-shaming.

One of the hot topics Jenna talked about is the amount of videos she has switched to private over the years. Jenna said, "I get it. We're at a time where we are purging ourselves of anything and everything toxic ... I've definitely done things in the past that weren't great. I'm not completely unproblematic. I've tried my best to grow up."

UNBELIEVABLY SORRY

More specifically ... Jenna apologized for a 2011 video she posted showing herself in blackface. She said she never meant to do blackface and admits it was wrong after hearing from people who found her skit offensive. She says she learned from it and never repeated it.

Jenna said, "I'm unbelievably sorry ... I wish it wasn’t part of my past.” As for the racist rap song and the slut-shaming, Jenna said, "It doesn't need to exist. I shouldn’t have ever said that. I’m embarrassed that I ever made that, period."

She says, "for now I just can't exist on this channel," and added ... "I want to hold myself accountable, and it’s painful to do it. I’m ashamed of things I’ve done and said in my past. But, it’s important."

Jenna's posted thousands of hours of content in her decade-long run ... including hilarious drunk makeup tutorial vids. She's literally one of social media's first celebs ... and became the first social media star with a wax figure at Madame Tussauds in NYC.

Alabama, Nick Saban Powerful Black Lives Matter Vid 'We Can't Be Silent'

Pretty amazing video from the Alabama football team -- with Nick Saban teaming up with his players to deliver a powerful "Black Lives Matter" message.

The video was written by Bama's offensive tackle Alex Leatherwood -- and features players like QB Mac Jones, Emil Ekiyor and Evan Neal.

"We are a team. Black, white brown," the players say in the video. "Together we are a family. We are brothers."

"On the field we are relentless. We are strong. We are conquerors. But we are human beings first."

"And in this moment in history, we can’t be silent. We must speak up for our brothers and sisters, for our sons and daughters."

The idea to share the message came after the players met with Stephen A. Smith and Condoleezza Rice ... who inspired the team to use their platform for good, according to al.com.

The message continued ... "When we see our families, our neighbors, our classmates subjected to violence, we recognize the fear in their eyes."

Sacramento 'Karen' Knocked Out After Calling Woman N*****

The woman who took the beating claims she did not initially use the n-word, and merely said, "excuse me" when the Black woman came in and stood right behind her. She claims the Black woman got pissed and called her a "white cracker bitch" before throwing items at her, which you can see in the video.

She admits repeating the n-word when the Black woman challenged her to do so. Again, that plays out in the video, and we gotta say ... not the smartest approach on her part. She says she reported all of this to police, but there's no activity in the case. No one's been arrested or charged.

11:21 AM PT -- According to the Sacramento Sheriff's Dept. ... deputies responded to a call of 2 females fighting at a 7-Eleven on June 22. When they arrived, the woman who got beaten up was being treated by medical workers for minor injuries, but the other woman had left.

We're told the injured woman told deputies it was a mutual fight and took responsibility for her part in it ... and said she didn't want to file a complaint. However, the next day she contacted cops and decided to file a report.

The Sheriff's Office says so far no suspect has been identified, charged or arrested ... despite the black woman's husband claiming on social media she was arrested for assault.

A "Karen" in Sacramento got her ass handed to her when she stupidly accepted a challenge to call a black woman the n-word ... and it's all on video.

The heated exchange unfolded this week at a convenience store in California's capital, where a middle-aged white woman started arguing with the black woman   ... and it quickly turned racial and violent.

It's unclear what started the confrontation ... the white woman insisted she'd only said "excuse me" -- but the black woman heard something different, so tempers were already high. Then, "Karen" dropped the n-word.

The black woman promised to beat the hell outta the white woman if she used the slur again and, for some reason, "Karen" took her up on the dare and said it ... loud and clear. That's when the punches flew ... haymaker after haymaker putting the racist woman down on her ass.

On social media, the black woman's husband is claiming she was arrested for assault. We haven't been able to confirm that yet.

7:10 AM PT -- Cooper-Jones joined "TMZ Live" and had a strong message she wanted to deliver to Breonna's mom saying, "I know it has to be very uncomfortable to know that your child was taken away and no one went to jail as of yet."

And, her message to Tamika is "don't give up" on seeking justice. The Arbery family attorney, Lee Merritt, also said, even though there hasn't been video that's emerged in Breonna's case there's hope for justice because "we've seen cases take off because of public pressure."

The Ahmaud Arbery murder case is moving at lightning speed ... seemingly light-years faster than the Breonna Taylor case ... and TMZ's learned both of their mothers will join forces in their fight for justice.

Lee Merritt -- attorney for Ahmaud's mother, Wanda Cooper-Jones -- tells us ... Ahmaud's mom is all set for a face-to-face with Breonna's mother, Tamika Palmer, Thursday in Louisville. It will be their first face-to-face meeting.

Wanda, who flew from Georgia to Louisville Wednesday night, is in for a busy day ... we're told after her sit-down with Tamika, she's scheduled to meet with lawmakers and local activists to fight for justice for Breonna.

Merritt will accompany Wanda as they lobby to have the Louisville police officers involved in Breonna's death arrested and charged. They will also lobby for federal intervention ... the feds could charge a civil rights violation ... something they did in the Rodney King case to secure convictions.

One item at the top of the agenda -- the Justice Act, which was just introduced in the State Senate and calls for police reform, transparency and accountability. Merritt tells us the bill doesn't go far enough to help Breonna's family get justice.

As we reported ... the 3 individuals charged in Ahmaud's murder -- Travis McMichael, Gregory McMichael and William "Roddie" Bryan -- were indicted by a grand jury Wednesday, and are each facing 1 count of malice murder, 4 counts felony murder, 2 counts aggravated assault, 1 count false imprisonment and 1 count criminal attempt to commit false imprisonment.

Meanwhile, the cops involved in Breonna's death have yet to be arrested. As you know, Breonna was shot 8 times after cops entered her home in the middle of the night looking for someone else. They also lied and said in the police report she was not injured.

Ahmaud Arbery Murder Case Three Suspects Officially Indicted ... Each Facing 9 Counts

3:14 PM PT -- Crump says Wednesday's indictments confirm what Ahmaud's father has been saying for months -- "that this was a lynching."

"This is a significant step on the road to justice and while nothing will bring back Ahmaud's life, it is important that a Grand jury recognized his life had value and was wrongly and ruthlessly ended. We expect a trial will lead to the successful prosecution and sentences that reflect the heinous nature of this crime."

2:06 PM PT -- Lee Merritt, the attorney for Ahmaud's mom, Wanda, tells TMZ, "The family of Ahmaud Arbery is determined to see these men prosecuted, convicted and appropriately sentenced for the brutal hate crime that took Ahmaud’s life over four months ago.‬“

Ben Crump, the family's other attorney, calls the indictment "Monumental" in getting justice for Ahmaud.

Travis McMichael, Gregory McMichael and William "Roddie" Bryan have each been indicted by a grand jury for the murder of Ahmaud Arbery.

The Cobb County D.A., Joyette Holmes, announced the indictment to reporters Wednesday in front of the Glynn County Courthouse in Brunswick, GA. Although the defendants had been arrested for murder, the grand jury handed up the indictment ... formally charging them with the crimes.

Each defendant is facing 1 count of malice murder, 4 counts felony murder, 2 counts aggravated assault, 1 count false imprisonment and 1 count criminal attempt to commit false imprisonment.

In Georgia, murder charges typically go before a grand jury for indictment.

The 3 defendants have remained in custody since their arrests last month, and last appeared in court in early June for probable cause hearing ... where a judge concluded there is enough evidence to move forward with the case.

As we reported ... during that hearing, a Georgia Bureau of Investigation detective took the stand and testified he found NO evidence Ahmaud ever took anything from the construction site he walked through before he was shot and killed.

Remember, the elder McMichael, Gregory, had claimed he thought Arbery matched the description of a burglary suspect. Travis fired the fatal shots on February 23, during a struggle with Ahmaud ... that came after all 3 men chased him down.

IN COLD BLOOD

Travis and Gregory were arrested and charged with murder May 8, and a judge ordered them held without bail. Bryan, who recorded the incident, was arrested 14 days later and slapped with charges of felony murder and criminal attempt to commit false imprisonment.

Authorities allege Bryan had no right to stop or confine Arbery and Bryan was working with the McMichaels by repeatedly using his vehicle to trap Arbery.

The GBI detective who testified in the preliminary hearing also said Bryan told cops he heard Travis refer to Arbery as a "f***ing n****r" right after he shot him.

Dallas Cowboys safety Ha Ha Clinton-Dix lost his mind when he scootered up onto 2 bears in his driveway this week ... and the hilarious encounter was all caught on surveillance video!!!

The footage -- captured Monday night around 8:45 PM -- shows the 27-year-old joy riding when a couple of beasts strolled by.

Seems a mama bear and her cub were sniffing around ... and when an oblivious Clinton-Dix cruised near them on his scooter -- hilarity ensued.

The 6'1", 211-pound defensive back (who used to play for the Chicago Bears, funny enough!) threw his ride, stopped on a dime and turned and bolted off!!!

"I play D # gotta be ready to go," Clinton-Dix said of the incident. "A lil high on my flip turn but the drive was there. I ain’t know how many was over there."

Of course, several NFL studs clowned Ha Ha over the interaction ... including Stefon Diggs who wrote, "Boy tried to ghost ride the scooter into him."

Fortunately for Ha Ha ... the Bears were so frightened by him, they took off as well -- and no animals or NFL players were hurt.

Madison, WI Cops Violent Arrest of Bat Wielding Protester ... Candidate for De-escalation?

Protesting inside a restaurant with a megaphone and a baseball bat got a black man arrested in a scene that looked eerily similar to George Floyd ... but this time police were way more patient and mindful.

The bust went down Tuesday in Madison, Wisconsin where a swarm of officers descended upon the guy who'd been using his megaphone to, as they put it, disrupt the peace. He also had a baseball bat on his shoulders as he yelled at customers and restaurant staffers from point-blank range.

It took as many as 5 officers to detain 28-year-old Devonere Johnson ... who was resisting arrest. It took several cops tugging at Johnson during the struggle before they ended up with 4 officers on his back and legs. Important to note, none of them were on Johnson's neck ... though he did complain he couldn't breathe before they hoisted him off the ground.

Vigilant bystanders -- including the outspoken man recording the scene -- demanded officers release him, as they claimed he'd done nothing wrong besides using his voice to exercise his First Amendment rights.

The cops weren't having it though, and eventually carried Johnson by his legs and torso and tossed him like a sack of potatoes into a patrol unit. Somehow, Johnson, who was now handcuffed, managed to escape out of the cop car ... before they pounced on him again.

Again, the bystander with the camera didn't give up, and continued pleading with several officers to let Johnson go free. They didn't and he was officially busted for disorderly conduct while armed, resisting arrest and attempted escape.

The cops add that 2 officers suffered minor injuries during the arrest, and Johnson had bruises on his arms and legs.

The question ... was there a more peaceful way to handle the situation? He had not physically harmed anyone and, according to police, was walking away from the restaurant when they arrived. Yes, customers did seem to feel threatened, so if ya gotta arrest him was this a prime case for de-escalating before manhandling? In fairness to cops, it's possible they did attempt to do that before the video started.

BTW, the scene was still bizarre even AFTER the arrest ... watch what happened when someone tried to get all Biblical.

Strange days, indeed.

Jimmy Kimmel I'm Sorry for Karl Malone Impression And Other 'Embarrassing' Blackface Sketches

Jimmy Kimmel's issued a delayed apology for his infamous Karl Malone impression -- along with others -- in which he used blackface and insensitive racial language ... calling them "embarrassing" and "thoughtless moments."

The late-night talk show host has come under fire recently for his past sketches -- specifically, one in which he wore blackface and a bald cap to portray the former NBA star.

Kimmel says ... "I have long been reluctant to address this, as I knew doing so would be celebrated as a victory by those who equate apologies with weakness and cheer for leaders who use prejudice to divide us. That delay was a mistake."

He's now apologizing to those he hurt or offended by "the makeup I wore or the words I spoke."

Kimmel goes on to explain he began doing his Malone impression for LA's KROQ radio in the mid-90s, and it continued on TV on "The Man Show." He says ... "I never considered that this might be seen as anything other than an imitation of a fellow human being," and that he's done impressions of several celebs, including Snoop Dogg and Oprah.

He says ... "In each case, I thought of them as impersonations of celebrities and nothing more. Looking back, many of these sketches are embarrassing, and it is frustrating that these thoughtless moments have become a weapon used by some to diminish my criticisms of social and other injustices."

Kimmel says he believes he's evolved and matured over the past 20-plus years and he's going to continue speaking out, adding ... "I won’t be bullied into silence by those who feign outrage to advance their oppressive and genuinely racist agendas."

He concludes by saying his current summer vacation has been planned for more than a year and is not related to his current racism controversy.

As we reported ... Kimmel's backlash comes shortly after another late-night host, Jimmy Fallon, faced his own backlash for a blackface sketch he did in 2000, in which he played Chris Rock.

Rayshard Brooks Atlanta Funeral MLK's Daughter Gives Powerful Speech

12:16 PM PT -- Another profound speech was just given by Ebenezer Baptist's own minister, Raphael Warnock, who said what happened to Rayshard Brooks was just a small piece of a much larger issue in America ... namely, mass incarceration, which he likened to modern-day slavery.

The reverend gave a powerful eulogy for Rayshard, in which he invoked the story of Moses telling Pharaoh to let his people go, and how African-Americans are in a similar situation now. Warnock then said police brutality is not the end all be all -- he said the criminal justice system at large was the beast that needed to be fed ... and police killings were simply a byproduct to that end -- the feeding of the machine, if you will.

Warnock then got to Rayshard's situation itself, noting that the possible reason he might've tried running before getting shot was because he himself was on probation ... and figured making a run for it would be better than falling right back into the system he'd just escaped.

The reverend began by saying Rayshard did not have to be killed, and that the officers could have simply let him go home. She went on to point other historic dates in history that also fall on June 12 -- the day Rayshard was killed -- and then connected the dots personally ... saying she, too, knew the pain of losing a father to racial violence.

She went on to say that MLK himself said the Brooks family's struggle was, in fact, everyone in the community's struggle ... and that his word of "No justice, no peace" still rings true even today -- even in the city of Atlanta, which she said is considered a black Mecca.

Reverend Bernice then said it clearly ... the next step to healing this nation is NOT more diversity or inclusion, it is acknowledging directly that Black Lives Matter -- and that a revolution of values is absolutely essential to make things right going forward.

Bernice said that the demonstrations happening should not and will not cease until true equity is reached, and true reform takes place. She also called for reparations and an end to voter suppression -- ending by saying righteousness will prevail one way or another.

Rayshard Brooks is being laid to rest with a home going ceremony in one of Atlanta's most historic churches ... and TMZ is streaming the service live.

The procession is getting underway Tuesday morning at the Ebenezer Baptist Church, where Dr. Martin Luther King, Jr. once served as co-pastor for years. Rayshard's casket actually arrived at the church on Monday for a public viewing ahead of Tuesday's funeral service.

His golden casket was brought in by pallbearers wearing "Here 2 Serve" t-shirts. During the viewing, his casket was open, and his widow, Tomika Miller, reached out to touch her husband at one point.

As for Tuesday's ceremony, it's meant to be a more private affair with some noteworthy speakers ... including MLK's daughter, Rev. Bernice A. King, as well as Rev. Raphael G. Warnock -- the senior pastor at Ebenezer Baptist, who's supposed to deliver the eulogy.

On Friday, June 12, Rayshard was approached by two APD officers after he was found asleep in his car and partially blocking the line at Wendy's drive-thru. After a lot of cordial back-and-forth interaction, for about 30 minutes, the cops tried to handcuff Rayshard place him under arrest.

When Rayshard resisted, a struggle ensued, and he broke free with one of the officers' tasers ... which he pointed back at them as they gave chase. Officer Garrett Rolfe then opened fire and struck Rayshard twice in the back. He also allegedly kicked him after he was down.

Rayshard later died from his injuries -- and the Wendy's where and the officers tussled was burned to the ground the next day as intense protests sprung up in Atlanta.

The Fulton County D.A. announced murder charges against Officer Rolfe. His partner, Devin Brosnan, faces less severe charges ... aggravated assault, specifically. Both men have since turned themselves in for booking. Brosnan, for his part, has denied wrongdoing.

If Rolfe is convicted, the death penalty would be on the table for sentencing.

Bubba Wallace Speaks to FBI in Noose Probe ... 'Offended' By Hoax Theories

Bubba Wallace confirms he has already been interviewed by the FBI as part of its investigation into the noose incident ... and he's blasting people who think it was all a hoax.

The NASCAR driver appeared on "The View" on Tuesday -- one day after an inspiring performance at Talladega -- and was asked how he felt about theories the noose was "staged" by NASCAR to garner more support for the Confederate flag ban.

"It offends me that people would go to those measures but again, I'm not shocked," Wallace said.

"People are entitled to their own opinions to make them feel good and help them sleep at night."

Bubba says law enforcement is all over the case -- "I can now say I've talked to the FBI ... never thought that would happen!"

As we previously reported, Al Sharpton is concerned investigators are dragging their feet ... and he's demanding answers ASAP.

As for the emotional displays of solidarity at Talladega on Monday -- when all of the competing drivers rallied behind Bubba's car -- Wallace says he was truly moved by the support.

"Every time I watch that video I get emotional and get chills," Wallace said.

Wallace says they may hate each other on the track, but off the track, the drivers and crews are like a family ... and he's proud to be a part of the NASCAR team.

Al Sharpton Demands Answers In NASCAR Noose Probe ... Or Else!!!

Al Sharpton wants SWIFT justice in the NASCAR noose investigation -- and if they don't produce answers quickly, he's ready to take action.

"If we don't hear something soon, NASCAR can expect a visit from me -- and I won't be coming to drive a car," Sharpton tells TMZ Sports.

Al is really upset ... he's pissed that somebody put a noose in Bubba Wallace's garage at Talladega Superspeedway in Alabama on Sunday -- and he's also pissed cops haven't identified the culprit publicly yet.

Long story short, Sharpton believes the investigation needs to be a top priority with NASCAR and law enforcement because "people need to know they will be held accountable."

As we previously reported, NASCAR says it's working with authorities -- and the FBI is now involved.

The big question ... shouldn't there be surveillance video of a suspect?? Why hasn't video been released yet?

Sharpton also says the noose isn't just a symbol of hate -- it's a threat of violence and should be treated as such.

"A rope represents a threat to human life and that person ought to be found out and dealt with by the authorities," Sharpton says.

"To hang a noose, which is a symbol of lynching and killing somebody because of the color their skin, shows real hatred and real bigotry."

"And by doing it they confirmed the very reason why we're marching all over the country. Rather than a condemnation, it's a confirmation of why we need to keep marching."

Sharpton says he and his National Action Network plan on contacting law enforcement to check up on their investigation. He's also planning on getting in touch with Wallace to provide any assistance he may need.

Crazy Video Swimmer Catches Shark with Bare Hands ... Anything for the 'Gram, Eh???

A swimmer in Delaware clearly thinks Chuck Norris has got nothin' on him, because he tried subduing a shark with his bare hands ... apparently all for what could have easily been a fatal photo op.

The scene unfolded over the weekend at Henlopen State Park Beach. You see the swimmer dragging the shark in shallow water, and then, as people on the shore stand in shock, the swimmer opens the foreboding mouth of the shark. It's pretty clear ... the mouth trick was for the cameras.

Unclear what the swimmer did with the shark, but in Delaware fishermen/women are required to return them to the waters.

Either way ... aside from being dangerous, it's not a great idea to play with these creatures and scare them for the sake of Instagram.
