"Pregnant Man" Thomas Beatie is PISSED after a judge refused to grant him a divorce from his estranged wife -- and tells TMZ he's willing to take the fight all the way to the Supreme Court.

Beatie, a transgender male, is appealing a decision handed down Friday ... when a judge in AZ denied his divorce from Nancy Beatie -- on the grounds the marriage was NEVER legal since Beatie couldn't prove he was a man during their nuptials ... and the state doesn't recognize same-sex marriage.

Beatie tells TMZ he's not giving up the fight, his attorneys are already drafting up the appeal -- and he'll go the Supreme Court if that's what it takes.

He explains, "This is personal. This ruling is an attack on my person, my identity, and my family. It's sad and embarrassing that Judge Gerlach is more focused on wanting to delegitimize my children than legitimize my family."

Beatie continues, "The judge is obviously uncomfortable with me. He has a problem with me having a legal male identity and using my internal organs to start a family."

You'll recall ... the judge made it clear from the beginning​, he had issues with the validity of Beatie's marriage based on the fact that while married he bore the couple's 3 children ... something no man could do. 

But Beatie is adamant, the issue is MUCH bigger than his divorce ... "This is not Beatie versus Beatie. This is the State of AZ versus transgender people, human reproductive rights, and fairness under the law."

FYI -- Beatie was born a woman, but began a sex change in 1997. He married Nancy in 2003 in Hawaii. He filed for divorce in April 2012, claiming Nancy was abusive. Allegations she denied.

Months before he filed for divorce ... the Pregnant Man was attacked by his wife ... who also manhandled their daughter and smashed the family computer ... and he captured it all on tape.

In the footage, expected to be filed as evidence in their bitter divorce battle, Thomas Beatie enters a kids' playroom in his Arizona home ... to find his wife Nancy passed out on the floor.

When Nancy wakes up ... she flies into a rage -- picking up her daughter in a sleeper-hold and dragging her into the next room. 

Nancy then inexplicably directs her ire towards Thomas -- attacking him with various household objects ... including the couple's laptop.

Moments later, Nancy takes the computer into the backyard ... smashes it on the ground and tosses it into the pool while Thomas and the kids tearfully plead for her to stop.

TMZ broke the story ... Thomas filed for divorce in February -- claiming Nancy is a violent alcoholic and a danger to their children. Sources close to Thomas tell us he started filming Nancy to show her how she acts when she's intoxicated.

The couple is due back in court on Wednesday to hash out custody and child support arrangements.

We reached out to Nancy for comment -- so far, no response.

We broke the story ... Nancy's husband -- transgender man Thomas Beatie -- recently filed for divorce, claiming Nancy is a violent alcoholic. A judge then issued a restraining order against Nancy and limited her time with their 3 kids to just 6 hours per week.

Nancy now tells TMZ ... since being tossed from the house, she's been forced to mooch off friends and at times sleep in her car because she can't afford even the cheapest hotel.

"I'm house sitting right now, cleaning it for another two days ... but I don't know where I'll go after that."

Nancy says she's out of options ... and has resorted to pawning anything she can because she has no other way to make money.

"I have some junk gold that I grabbed when I had to leave ... broken rings and bracelets not worth much but it's a start."

Nancy says she vows to challenge the custody arrangement in the hopes of spending more time with her kids ... "When I have to leave them, I have to hold back tears."

The next hearing for the case is set for May 7 ... where a judge is expected to rule on child support, spousal support and custody.
