The Situation Accused of Artwork Heist

It's no "Thomas Crown Affair" -- but The Situation has been accused of jacking a painting of himself via the Internet ... and the artist behind the image is ballistic.

The artist -- Celeste Gillis -- tells TMZ she contacted The Situation on Facebook last month to tell him she immortalized him on canvas -- and he could either have it for a price ... or credit her art website on his FB page.

Gillis claims The Sitch posted the moob-tacular image on his FB page without doing either (above) ... along with the adding-insult-to-injury caption, "THE MAN THE MYTH THE LEGEND."

Gillis tells TMZ she never asked the Sitch to take down the pic ... because she didn't think he would understand copyright laws. 

No comment from his people.

DD, clearly you don't understand how this website works. People with cameras stand around all day waiting to get a shot of certain celebrities. Then they sell those pictures to websites like TMZ or magazines like People for a lot of money. TMZ and People then make a lot of money off of those pictures, either through advertising on their websites, t.v. show deals, or magazine sales. Sure, sometimes those celebrities call the paps and tell them where they are and other times not so much. I'm pretty sure when Heath Ledger died his ghost didn't call all the entertainment shows and asked them to get a pic of his body being put into an ambulance in a body bag.

Besides, there's no reason to be so angry and start yelling it's just tmz. Get a life.

Actually Shepard Fairey didn't have the right to use that image, that's why he got in so much trouble. He lied and said he used another image by AP that he cropped and changed and made completely different, however, it turned out that he used an image that was almost exactly the same, he just made it blue and red. He admitted he was wrong.

@51 Elisha u didn't see how lissalissa attacked me I was responding in the manner she replied to me...U should read the comments I was responding to before writing to me..I'm not the one that talked about TMZ because someone called me an idiot because TMZ doesn't get sued for putting up celeb info. I know how it works. When people call me idiot an whatever else then I will respond because that must be normal communication to them.

I suggest people arguing about copyright law take a few courses or study the law. She can't sell his image for profit without his knowledge. That is why she asked for advertising for her site instead mainly because she knew that. She doesn't say she is selling his image. She says she "usually asks ??? from clients." He was not her client. If he was a nice guy, he would pay her for her time painting it so she can't sell it to any other goofball who actually wants to pay for it. If he is a douche, he would offer her any price he wanted so she can't sell it. But who would buy that hideous painting anyway.

If she was dumb enough to upload it onto the internet anywhere, in any form, without a watermark promoting her site that would not be removed until the transaction was satisfactory to her, she's an idiot. Further proof she's an idiot can be seen by her message to him when she ho-hummed around about what she wanted in exchange for the painting and included "it's up to you really".
If you were dumb enough to do the above, and then claim you didn't even ask him to take it down because you didn't think he would be smart enough to understand copyright laws, YOU'RE AN IDIOT.

You people are moronic. Clearly she just wanted acknowledgement for the posting of her artwork. It doesn't say that she wanted to sue him for copyright.. The interviewer probably asked if she planned to prosecute and she joked in her response. That's what it looks like from the little information provided at least.

The fact that he said he was interested but asked if she was giving it for free or asking for money just sums up the kind of self involved ******* he is. Now she's figured out away to get the acknowledgement on her own. Good job.

Elisha she posted it on his wall then begged for money when he liked it. Its not like it was watermarker OR sent saying DO NOT DISRBUTE, anyone looking at facebook has it since it was on his wall (ALONG WITH ON HER SITE). So is she going to sue all of us for looking at it?

If you are the owner and post in in a public forum for public consumption you can not then go back and say its wrong. All the guy did was take the picture and put it in an album after THE "artist" (I use this term lightly) realized none of the cast was going to send her pathetic ass money. Then she forwarded this story to tmz. In an attempt to sell some of these garbage 60 posters which cost 3$ to make.

Its an amateurs attempt at some fame since their art is lacking severely. They will get a few hits cause of this and fade back into "no one gives a sh*ts'ville".
