Anna to be Buried in the Bahamas

2/28/2007 6:21 PM PST BY TMZ STAFF

A Florida appeals court ruled today and uphold the previous decision ofJudge Larry Seidlin giving custody of the body of Anna Nicole Smith to baby Dannielynn's court-appointed advocate, Richard Milstein. This paves the way for Smith to be buried in the Bahamas next to her son, Daniel.

Justices Barry Stone, Mark Polen and George Shahood of the Fourth District Court of Appeals heard arguments on Wednesday from lawyers representing Virgie Arthur, Howard K. Stern and Dannielynn Smith. Arthur, Smith's mom, wanted the body to be buried in Texas, while the others wanted the body to be buried in the Bahamas.

"It was a fatal mistake for all of them to go to the Bahamas in the first place. "

It really was. I wish I could rewind time and stop them from going. It is all just so tragic.

Lisa( I pray for you dannielynn)

well it sounds to me like someone on howards side is paying these jugdges attorneys off!!!!!! like his parents who have been supporting him for the last 15 years.

that's okay howard she will be buried in the bahamas temporially, because when the truth comes out that you are not dannielynn's father she and daniel will be brought back to the United states period.

anna told everyone vergie, howard, larry and ford shelley she wanted to be buried in california next to maryilynn monroe while she was alive, that was her true intent people.

now do the dna on the baby and find out for yourself that howard stole the baby from larry, he will have no rights to anything but a jail cell then.

If the appellate court issued a "per curiam affirmed" order, then the order is not appellable to the Florida Supreme Court.

Also, means that Seidlin's decision entitled to no precedential weight for future cases. In oral argument questioning, the appellate court was clearly concerned about many of Seidlin's legal rulings, especially the appointment of a guardian ad litem (representative for the baby for the purposes of this case only) where the baby does not reside in Florida.

Good result.

Good! Now Virgie cannot get the $$$$$! She needs to brush up and respect Anna's wishes.

Virgie is now a Momma Dearest.

RIP, Anna and Daniel.

Keep the will as a trustee, Howard who worked very hard to reach the U.S. Supreme Court. Don't let Larry and Virgie rip Howard, the trustee.

Good Day,

I believe this is far from over. I can almost guaruntee you Ms. Arthur will appeal this as high as she can go or till she gets her way. And if anyone thinks it will end with Anna being burried, I also think you are sadly mistaken. Regardless of which man is found to be the father of Danny, I will be surprised if Vergie does not sue for grandparent visitation rights or even custody herself! $

The mother cannot appeal....that is what the "Petition of Writ of Cert" is...

Certiorari

Certiorari is a Latin word meaning "to be informed of, or to be made certain in regard to". It is also the name given to certain appellate proceedings for re-examination of actions of a trial court, or inferior appeals court. The U.S. Supreme Court still uses the term certiorari in the context of appeals.

Petition for Writ of Certiorari. (informally called "Cert Petition.") A document which a losing party files with the Supreme Court asking the Supreme Court to review the decision of a lower court. It includes a list of the parties, a statement of the facts of the case, the legal questions presented for review, and arguments as to why the Court should grant the writ.

Writ of Certiorari. A decision by the Supreme Court to hear an appeal from a lower court.

Cert. Denied. The abbreviation used in legal citations to indicate that the Supreme Court denied a Petition for Writ of Certiorari in the case being cited.

Someone with a legal claim files a lawsuit in a trial court, such as a U.S. District Court, which receives evidence, and decides the facts and law. Someone who is dissatisfied with a legal decision of the trial court can appeal. In the federal system, this appeal usually would be to the U.S. Court of Appeals, which is required to consider and rule on all properly presented appeals. The highest federal court in the U.S. is the Supreme Court. Someone who is dissatisfied with the ruling of the Court of Appeals can request the U.S. Supreme Court to review the decision of the Court of Appeals. This request is named a Petition for Writ of Certiorari. The Supreme Court can refuse to take the case. In fact, the Court receives thousands of "Cert Petitions" per year, and denies all but about one hundred. If the Court accepts the case, it grants a Writ of Certiorari.

"Review on writ of certiorari is not a matter of right, but a judicial discretion. A petition for writ of certiorari will be granted only for compelling reasons." Rule 10, Rules of the U.S. Supreme Court.

The U.S. Supreme Court's certiorari process is covered in Rules 10-16, Rules of the U.S. Supreme Court.

The effect of denial of certiorari by the U.S. Supreme Court is often debated. The decision of the Court of Appeals is unaffected. However, the decision does not necessarily reflect agreement with the decision of the lower court.

Go KY: I think you misunderstood that post. The 3 men he was talking about are the current judges that just ruled against the next-of-kin (bad law, imho, but I'm not a judge) in the Appeals Court. The post went on to mention all of the additional players that were against Anna's mama.

#31 - You are dazed and confused...step away from the keyboard. "Those three judges are jewish"....Seidlin is the only judge. Stern and MIlstein are attorneys. Whew, good thing you are not deciding any portion of this..you can't even interpret the information correctly.

This is all in favor of Stern. Now the body goes to the Bahamas HKS will use the excuse Dannilynne is better off with him in the Bahamas so she can be near her dead mother and dead brother. I emphasize DEAD.

Larry and Virgie, fight for that child with every ounce of might you have left in you. Stay strong. Dannilynne was not protected by Millstein, rather he sided with Stern. I fear there will be a big funeral fag style funeral...all supported by Millstein, ET and The Insider....

This is sick.!
