Don't Worry, Matilda Will Be "Taken Care Of"

Heath LedgerHeath Ledger's family was quick to speak out today to quash any ideas that his daughter, Matilda Rose, would not be provided for after his death.

Heath's dad, Kim, released a statement that said, "Matilda is our absolute priority and Michelle is an integral part of our family ... They will be taken care of and that's how Heath would want it to be."

Details of Ledger's will were made public today and it didn't specify anything for his ex-fianceé, Michelle Williams, or their daughter -- that's because it was drawn up back in 2003.

By (American) law, I believe the child would be entitled to support until the minor reached the age of 18. The actual amount of the support would be determined by the executor of the will. That's why biological kids of deceased entertainers are often in the news when they're omitted from a will. (James Brown's last offspring).

According to New York law, Matilda will be provided for regardless of Kim Ledger's intentions.

Est. Powers & Trusts § 5-3.2
(2) If the testator has no child living when he executes his last will, the after-born child succeeds to the portion of such testator's estate as would have passed to such child had the testator died intestate.

(b) The term "after-born child" shall mean a child of the testator born during the testator's lifetime or in gestation at the time of the testator's death and born thereafter.

Est. Powers & Trusts § 4-1.1. Descent and distribution of a decedent's estate.

The property of a decedent not disposed of by will shall be distributed as provided in this section. In computing said distribution, debts, administration expenses and reasonable funeral expenses shall be deducted but all estate taxes shall be disregarded, except that nothing contained herein relieves a distributee from contributing to all such taxes the amounts apportioned against him or her under 2-1.8. Distribution shall then be as follows:

What ax to Heath's unclews have to grin in this battle? What is the old family feud and how large was the estate over which Heath's father and his brothers were fighting?
