Howard K. Stern, 2 Docs: We're Not Guilty!

5/13/2009 1:55 PM PDT BY TMZ STAFF

Howard K. Stern and two doctors, Khristine Eroshevich and Sandeep Kapoor, just pled not guilty to a pile of charges in the Anna Nicole Smith drug case.

The dynamic trio have each been charged with 6 felonies -- after a massive investigation that led prosecutors to charge that they funneled drugs to Smith in the years leading up to her death.

All three defendants had no problem with giving the D.A. handwriting samples that cops could use in determining who signed what prescriptions.

After learning of the death of MJ it reminded me of the Anna Nicole case. If any good can come from this latest untimely death let's hope that Calif. Attorney General Jerry Brown will put MJ'S Doctor in his sights as well.

These doctors who get away with murder must be stopped ! IMO

Murder is defined as the the unlawful premeditated killing of a human being by another human being. Or to kill intentionally and with premeditation. Just thought I'd let you know.

Where's Swims

Wow. The Howie supporters are fierce and dellusional.

1. There is an investigation into MJ.
2. The investigation into ANS was botched, and last I heard reopened.
3. Investigators are poker players. They don't discuss what they know until everyone antis up and it's time to call the bluff.
4. JB won't need to get involved in MJ, because the LAPD are doing their job. If we see him it will merely be to give credit where credit is due. And much like VA the Jackson family isn't hiding the fact that MJ had an addiction problem.
5. A doctor who leaves his practice for one patient is like an attorney who has no practice for one client.
6. CA knows it has a job to do for the entire country wherein Dr's and Lawyers who lose site of their responsibility to "cave" in to celebrity have committed serious breach of their oaths.

An oath is a solemn promise which these people have broken.

As for HKS and his quest for Marshall money. I doubt it will ever happen. The TX probate case was heard for six months by a jury and no money was awarded to ANS because the will left the money to decedents son. Anna was awarded a little money in a CA bancrupcy court with no jury in a relatively short decision prior to the TX probate verdict. It would be a heavy hit for a court to upheave a jury that had proper jurisdcition. The probate court is the "specialty" court as opposed to a Federal Court or any court in another state. HKS knows he won't win. That's why he needed Anna's money which he now has. I'd use the Latin Term, which swims can fill ya all in on. It's a kind of sacred things regarding one court respecting another court's ruling. Why don't you tell them about it Swims.

As for HKS, I hear the sound of slamming metal and sleep deprivation. It's going to come to an end altough I bet Swims will banter on forever.

I see posts appearing that had vanished and duplications of posts. LOL.

I've had just about enough of the Michael Jackson speculations and the bug-eyed media pretending to be sorrowful about his death and blathering on and on with idle speculation straight off the UK tabloid The Sun picked up by every sensationalistic screaming headling quoting from 'a friend of the family' or 'a source close to the investigation' or a 'source close to the family' and on and on.

Rumors are perception and perception morphs into the 'truth' while the truth stays hidden forever. Which came first, the chicken or the egg? Did JB put the fear of G-d into Californians, i.e. the family insisting there was a drug addiction when they weren't even there when it happened. How about the exculpatory rumors? He had chest pains the morning after a late-night dance session at Staples? Some say he had a vigorous workout--some say he was 'lethargic' (tired).

Why was a cardiologist hired by the promoter? Why doesn't the coroner's office put a STOP to all the speculation?

Having a massive heart attack at 50 is NOT as unusual as some people think. Some people have them at 20 with no sign of previous heart disease. How many people have arrythmia? ANSWER: MANY.

What does the death of Michael Jackson have to do with Anna Nicole Smith? NOTHING! The drug charges in the criminal case against HKS and the doctors are not about her death--the case is not about her death, yet the blabbermouths insist it is? Speculation, anyone? One pundit, an MD insisted that emaciation is a sign of drug addiction! Another repeated it. Anna Nicole was emaciated? MJ was ALWAYS tall and skinny. Who says Dr. Murray injected MJ with Demerol?? The Sun in the UK says so, must be true. Let's repeat that one for six weeks.

I believe MJ died of a massive heart attack and may have had some heart disease--clogged arteries, a deficient or leaking valve (perhaps mild) and a chronic arrythmia.

All the rest of the gossip that reigns in the bored media with nothing else to talk about on a 24/7 'news' cycle (cable) is a bunch of crap.

Swim:

I meant to tell you I saw one psychiatrist, forgot his name, who has written a book about healing the 'brain' of an addict and he talked about pain management programs and successful new drugs that all doctors do not know about, can't recall the name of it. He also said addicts CAN be treated and the right treatment has a high success rate. I know you mentioned this aspect many times, but it never quite registered fully. That psychiatrist did not resonate either because I never saw him again. But his book was mentioned.

Who says these people were all 'addicts' and therefore they are 'bad' people? Who dreamed up this kind of thinking and fed it to the masses? Remember Dorothy Kilgallen? Alcohol is always part of this and somehow alcoholism is omitted from the 'let's tear down drug addicts' and throw them away because they are useless in society? But they contribute more than others, way more--i.e. Michael Jackson.

So the old/new 'enabler' term has been resurrected by JB??? Carol Burnett talked about that many years ago when she wrote an autobiography about growing up in an alcoholic family; so did Suzanne Sommers.

Then it became fashionable to talk about Betty Ford (named after the First Lady) and rehab and blah blah.

The more serious issue is why did Danial die of a morphine overdose? Was he a chronic user? Was he just toying? How'd he get it? Who had access to give it to him? Did he have the balls to smuggle his stash through customs?

Answer this Swims, C'mon. No more legal blather.

180. I havent been able to listen to the arguments yet but from the points of the non-suiting of the probate claims and therefore possibility of not being under their decision is very pertinent. As well, I liked the fact about Pierce's interference being ignored by Texas as a good sign (reminds me of the Judge ignoring McC's collusion & fraud!).

From the summary I do believe this will soon be over and I pray in ANS's favor; respect finally awarded to her as a widow & against those who tore her down during the long fight. She will reap the rewards from up above as she smiles down and still be able to care for her daughter and those she loved even after death.

It didn't happen until the end of oral arguments, but Brunstad was finally cornered by a Judge and asked if the claim of tortuous interference had ever been put before the TX Probate Jury - and it was NOT. This despite the fact that the Probate Judge wrote a decision implying that it had been heard and decided.

I found it interesting that the Appeals Panel had not read the Probate transcript. Apparently that is standard operating procedure. The Panel was only going by the final written decision of the Probate Judge as a full and correct reflection of the testimony, jury questions and their answers.

I agree it's interesting how the TX Probate Judge and the 280th Judge both have no problem ignoring misdeeds of their fellow Texans before the bar. After the Bankruptcy decision, it's fascinating how the Probate court then found against ANS's claim of tortuous interference by Pierce without having heard testimony on the issue or asking the jury to render a decision on the matter.

I know what you mean. Average people feel empowered to toss around terms like addiction, enabling, rehab, etc. without understanding what any of it is.

Society's general disgust with 'addicts' is played upon by the 'talking heads' who proceed to spew contradictory notions of treatment versus not able to be cured, the addict demands drugs but then is under the influence and susceptible to being used and abused by others because of the drugs, everyone around an addict is responsible for the addict's actions or the addict is responsible for themselves, people should have forced treatment but it's not legally possible to force treatment, and so on.

As we saw with the ANS saga, media tends to go with the least knowledgeable people to garner headlines. Experts cannot be relied upon to provide inflammatory headlines. Even worse, some in the media feel they are experts themselves and don't need to become educated.

I should point out that free speech is a right endowed by the Creator, not a privilege granted by government.

Daniel's Inquest, led by Coroner William Campbell, concluded that an accidental ingestion of Methadone and Zoloft and Lexapro caused a fatal arrhythmia and death.

Bahamian Pathologist Dr. Raju (did official autopsy) testified that Zoloft and Methadone particularly have a rare but known potential fatal interaction. This confirmed the findings of Daniel's private autopsy conducted by Dr. Wecht. Chief Superintendent and Forensic Scientist McCartney of the Royal Bahamas Police (RBP) force testified to the slow but sure accu_mulative effect of methadone over eight or more hours of repeated dosing, possibly beginning before Daniel left CA. Mr. Campbell agreed with the combined testimonies of Dr. Raju and Chief Superintendent McCartney as did the Inquest Jurors ultimately.

As a further note, a toxicologist (non-Physician) from the Miami-Dade ME's Office, Dr. Lee Hern testified that by looking at the blood levels only, he felt methadone alone caused his death and that the large amount indicated an 'intentional' ingestion. O'Q's guy, Clark, yelled aloud "BINGO" when Dr. Hern gave his unique testimony.

The RBP's operating theory was described as presuming Daniel brought his own methadone from CA. No proof was uncovered in CA after investigation, nor any in The Bahamas to definitively point to a source of the methadone.

THANK YOU

A very accurate description of what happened in the Bahamas inquest of DWS.
The toxicologist (is like a technician?) Who paid to have him go there? O’Q?
LOL Just was wondering if DC had given much thought to the word he yelled out (by the way; how unprofessional was that?) in the Court. I mean if I knew what was going to be stated I might have picked a better word(s)! ;)
Like, ‘There you go!’ or ‘That’s what I’m talking about!’ Well, you get the picture.

It was stated how much Daniel did not like to fly. I do not know about the reactions Methadone does to a person. If it gives them a sense of ‘la la land’ or a calming effect then I can very well see DWS taking it on his own as bless his heart had already had trouble with medicines prior to that in CA.

Interesting how in the fourth line of that other comment they used the word, “blather” then in the very next line say, “so educated”. Oh well, there you go.

JB is up for media attention -- he is running for Governor, he is all over the news in a variety of issues that will get him on TV. Very simple to search on the net to find that one out, I have read many articles in the last six months.

By the way, someone does need to “bash” that poster as every time they sign that moniker and state the word “drowning” isn’t that exactly what they are doing to another poster? What they can dish it out but cannot take it?

I would also state it is not so much about respect for HKS as it is about the lies and the injustice of certain lawyers and book authors as what makes most stand up and say, wait a minute! You cannot state on the air with millions of viewers that a man committed a crime.

I would like to add to that and say that the Creator also bestowed on us the capacity to use his gifts wisely and responsibly, and not merely to dredge up as an excuse when we want to say something nasty, unfounded and insulting about someone.

Perhaps the media feeding frenzy learned it's lesson with the ANS story --they have begun winding down with the MJ story. Seems even the children were not exempt from all the gossip and racial conversations, although that is mostly the tabloids and gossip internet. The MSM knows better and is not about to be led down that path of the ANS story. Could it be because MJ was an internationally known and loved figure and could it be that his millions of fans have never cared what media whores said about MJ? Could it be that he really had a loving and caring closely knit large extended family that can and will care for his children?

Having said that, I still believe that there is the single common denominator regarding the ANS story and MJ story--it is TRASHING them 24/7.after they have passed away as much as they did when they were alive. Of course, they cannot defend themselves when they are gone. So their kids get trashed routinely along with the celebrity.

The 'audience' determines the degree of trashing--no audience and the feeding frenzy dies down.

Everyone I know, whether a MJ fan or not, is sickened by the degree of the media feeding frenzy after his death.

The three-judge panel seemed about to head down that old path of getting reversed yet again, their usual pattern. and their having to repeatedly be told the facts and have the law explained to them reminded me of the Snoring Judge. I think one judge did actually mention the SCOTUS decision! I don't think the wording of Judge Ginsberg's reading of the unanimous decision was more remembered than while listening to those three judges get stuck on some point and take up all of Richland's time explaining it ad nauseum. Oh, how I recall the words of the SCOTUS decision!

BTW what happened to all the noteworthy objections to the RT motion that was granted? Has the Snoring Judge REFUSED YET AGAIN to hear a defendant? Has she formally DENIED all of these objections that were filed? I still think Diana Marshall filed the most eloquent of all doc uments, but that was regarding the Motion to Compel which IS being heard.

I suppose those are rhetorical questions--of course the judge has ignored all objections, or do they come into play AFTER the RT motion is granted?

Michael is not bio father of those children. Debbie was hired to produce a children/ RENT-A-WOMB, but MJ WASN'T THEIR FATHER. God knows who is.... Debbie had a contract with MJ, AND SHE GOT HER MONEY.
Similar situation was with Anna Nicole and Larry Birkhead. He was there to produce a child and vanish. Problem started when he became greedy and wanted more money and potential Marshall millions.
John Nazarian, PI was very clear when he talked about sperm donors and rich women, he meant Birkhead.
