TMZ has learned ... Lindsay Lohan's lawyer, Shawn Chapman Holley, has just filed legal papers appealing Judge Elden Fox's ruling that Lindsay should be held without bail.

Lindsay Lohan Jail Appeal
Holley claims the judge must grant bail in such a case -- and is asking Judge Patricia Schnegg, Assistant Supervising Judge for the L.A. County Criminal Courts, to vacate Fox's ruling.

Unless the ruling is overturned, Lindsay could spend the next month in jail ... waiting for the next hearing.

Every she goes to jail, everyone on her team, friends, family are all OUTRAGED that she is in jail. There are mentions of people acting improperly, etc.

It doesn't matter that she didn't kill someone - she broke the law and gets chance after chance to straighten herself out and it's not working and guess what - she has YET to spend the amount of time in jail that she has been sentenced to, or that anyone else would do that wasn't a celebrity.

LET HER STAY THERE. F**K this is stupid.

I am no laywer, Harvey is. But IF a person is granted bail, with a probation like she "was" but breaks her probation, then the judge is allowed to send her to jail for the time she was sentenced and maybe more for breaking her probation...

AAAwww...now lindsey will not be able to snort more coke tonight and party it up on a friday night, poor baby!! she mocks the judicial system and has no respect for it, she gets away scott-free and doesnt care. By failing those tests, she spat in the judges face and if she wanted to get clean, she would. My brother was a alcoholic for 25 years and was homeless sleeping in parks and about 4 years ago he had an a awakening and decided he needed help and now he has a job and his own 1 bedroom apartment, and our entire family thought he was going to die under a bridge, and he wasnt a celebrity with millions of dollars....he did it, why cant lindsey? screw her!!

People are forgetting, ignoring, or didn't know that when the judge agreed to let her out of her rehab/jail sentences early, it was on the condition that she not fail or miss a drug test or she would be "put back in jail".

The legal system has been made to look like a joke because of this 'woman'. Judge Revel was 100% correct in the way she did things and they STILL undermined her and had her taken off of the case. Lindsay said she was ready to face the judge and ready to take the consequences for her actions (as if we ever thought she would). Now they are undermining another judge by trying to get HIS decisions reversed. I hope to F**K she spends the next month in jail. It'll look good on her. But I am not going to hold my breath.

This from the attorney that helped get OJ Simpson off after he slaughtered TWO people! Honestly, she's a dismal human being. Some attorneys use their skill to help people or sort out a difficulty. This one helps her client do drugs endlessly and murder innocent people. Shame on her!

Don't know why everyone's slamming Lindsay's lawyer - she's just doing her job, which is representing her client. In her heart of hearts, I'm sure Chapman would prefer to leave Lindsay in the clink for a month, but her job is carry out her client's orders, so there ya go.

Let's just hope the judge's ruling isn't appealed. Lindsay needs a clear message sent.
