Victim's Mom Sues in Deadly Desert Race Disaster

The mother of a man killed when an off-road driver plowed into a crowd of spectators at the California 200 desert race is suing the man behind the wheel -- claiming the tragedy could have been avoided with proper safety measures.

Andrew Therrien

In a lawsuit filed today in L.A. County Superior Court, Doris Levinson claims her son Andrew Therrien was watching the race with his 3-year-old daughter back in August when driver Brett Sloppy lost control of his 5,000 pound truck and barreled towards the crowd.

Levinson claims ... as the truck approached Andrew and his daughter, Andrew managed to shove the little girl out of harms way -- but he wasn't so lucky ... and died from the injuries he sustained from impact. Seven other people also died in the crash.


Levinson claims Sloppy and the company behind the race -- MDR Productions -- were negligent, careless and reckless ... because they failed to take proper safety precautions.

Levinson claims Andrew's daughter sustained "severe emotional distress and mental suffering" due to the incident.

Levinson is suing on behalf of her granddaughter and her son's estate -- she's asking for unspecified damages.

We are all very sorry for all of the lives that were lost in this ACCIDENT, but there is no way that Brett was at fault. All of the deserts are "enter at your own risk." I know one of the people that was killed in the crash as well as a few that were injured, and none of the injured blame him. This will never fly in court.

I must admit I agree with Dash. "Dumb ass white folks". It's not racist, it's true, and I'm white. There are certain things we have to accept in the demise of fellow humans. There are ways, when the person dies, you could say oops white guy, oops, black guy, and so on. As for this stellar, genius, if you stand on the side of a dirt road, watch trucks race by, bouncing up and down, and one flies off that road, and lands on you, you are not allowed to be surprised by this outcome. Famous redneck last word, "Hold my beer, and watch this".

Who takes their child to a barrier less race track? I feel sorry for his family's loss but that's the risk one takes going to one of these events. I would try to minimize the risk by keeping my distance from the track or enough distance to react and run away from the rogue vehicles path.

I was just at the desert with Sloppy on Thanksgiving. He is a good dude. Suing is not going to bring her son back, thinks like that happen when you ignore the rules for safety....

If grandma wins, (I'm assuming he has no wife or mom wouldn't be the one to sue), the little girls mom should sue grandma for her daughters life being put in danger and the emotional trauma she is suffering from seeing this whole thing.

THE FACT OF THE MATTER IS THAT THIS WAS AN ACCIDENT AND BY NO MEANS COULD HAVE BEEN PREVENTED OR PREDICTED BY THE DRIVER AND/OR THE SPECTATORS. THIS RACE HAS RAN FOR YEARS AND MORE AND MORE SPECTATORS HAVE FOUND THEIR WAY TO THIS SPOT TO WATCH. WE AS RACERS AND CREWS HAVE ASKED THE PROMOTER FOR BARRIERS AND FENCING. WE HAVE EVEN ASSEMBLED VOLUNTEERS IN YEARS' PAST TO PUT UP SNOW FENCING AND TRY TO HOLD BACK PEOPLE AND PROTECT THEM, BUT EVEN STILL, PEOPLE HAVE CHOSEN TO IGNORE THOSE BARRIERS AND DISRESPECTED THE VOLUNTEERS WHO ASK THEM TO STAND BACK. THERE IS NO WAY THAT A CROWD OF THAT SIZE CAN BE CONTROLLED BY A SMALL NUMBER OF CONCERNED PEOPLE. THE POINT IS, PEOPLE WILL MAKE THEIR OWN DECISIONS. RACERS AND ATENDEES OF THIS RACE, HAVE FOR YEARS BEEN CONCERNED WITH AND WONDERED WHAT COULD HAPPEN IF THIS TYPE OF INCIDENT WAS TO OCCUR. DOES IT STOP US FROM GOING TO THE RACE OR RACING IN IT? NO, BECAUSE WE FOLLOW OUR OWN CONSCIOUS RULES AND TAKE PRECAUTION IN THE SAFETY OF OURSELVES AND OUR FRIENDS. AND THAT IS EXACTLY WHAT BRETT DID AND HAS DONE EVERY YEAR HE'S RACED AND WATCHED THIS RACE. THERE WAS NO WAY IN THE SCREENPLAY OF THE UNIVERSE THAT THIS COULD HAVE BEEN STOPPED. BRETT COULD NOT HAVE PREDICTED IT, AND WHEN IT OCCURED, COULD NOT HAVE CHANGED THE OUTCOME. IT WAS A SPLIT SECOND IN TIME. AND UNFORTUNATELY, ONE THAT WILL HAUNT HIM, HIS FAMILY, HIS FRIENDS, AND THOSE OF THE DECEASED AS WELL, FOR ETERNITY. But on to the reason everyone is posting on here, get you facts straight all of you outsiders!!!! Read prior comments before you post because if you did you would know the story correctly. DORI IS SUEING THE PROMOTERS! THERE SHOULD HAVE BEEN BARRIERS BECAUSE AT THOSE RACES THERE ARE ONLY ALOUD TO BE PEOPLE AT A CERTAIN PART OF THE TRACT!!! Y'ALL ARE IGNORANT AND DON'T KNOW ****!!! And Dori is not sueing so she can get money it is on behalf of Andrews daughter, it will all go to her. And the guy who out he is a racer you are an nimrod, if you know Brett you would know he isn't getting sued by Dori, The promoters are, get you **** staight, and ANDREW is a male not a female dumb ass!!!

I can understand where a mother can hurt for losing her child, but come on.. to sue the driver for her son dying at this race. I was there and it was my friends truck. Everyone in that pass (including myself) was standing to close for their own good, if the crowd was back even 50 ft noone would have been killed. People stand close for the thrill, any person with common sence should know they are putting their OWN lives at risk, standing that close to the track. This kid had his THREE year old child with him standing that close. If anything go after MDR for not enforcing crowd control, or supplying barriers. The driver is going thru enough already with this ACCIDENT, yet alone being blamed for other peoples stupidity of standing to close to a track with 5000 pound trucks flying by at high speeds, give him a break. Accidents happen.

I understand this mother is sad over her loss but her son should have known better than to stand that close to the track. Especially with a 3 year old little girl!!! Thats bad parenting if you ask me!! I dont think this driver deserves to be sued! Crashes happen all the time. People need to use their brains and not stand two feet away from a track, when trucks are flying by! That is pretty dumb if you ask me! Sue the company, not that poor driver who proably feels terrible enough as it is. DOnt you think that poor driver is going through alot himself?? You think he intentionally tried to kill those people! This mom needs to wake up!!! This is just an excuse for her to get some money!!

1. there are no spectator tickets
2. there was cation tape and marker stating to stay back.
3. The course is 50 mile long no way to put barriers around the whole way.
4. "Plowed" makes it sound like he flew way off the course. His front bumper was still on the course.
5. MDR can not force people to move. BLM can
6. He (and everyone else there) should have been somewhere else
7. He should not put himself in the position that he had to save his daughter.
