The judge who will determine Lindsay Lohan's fate in the probation and grand theft cases will be the middleman in plea negotiations today between Lindsay and the prosecutor ... and sources connected with the case tell TMZ ... the judge thinks Lindsay should do time.
Lindsay will appear today before Judge Keith L. Schwartz, and sources connected with the case tell TMZ that during the hearing prosecutor Danette Meyers will present Lindsay's lawyer, Shawn Holley, with a formal offer to plea bargain the case.
Sources tell us Meyers has already told Holley any deal will include significant jail time ... but Lindsay steadfastly refuses to accept a plea that involves time behind bars.
Sources connected with the case tell us Judge Schwartz will propose that Lindsay accept jail time for the probation violation and three years felony probation for the grand theft case. But here's the BIG problem with that -- if Lindsay gets in trouble during the probationary period, she'll go to state prison.
We're told Holley has not seen the surveillance video yet, but Meyers will present her with her very own CD tomorrow -- before the hearing.
If Lindsay doesn't accept a plea, the judge will set a date for a preliminary hearing.
UPDATE: Sources close to Lindsay tell TMZ, as of early this morning, Lindsay insists she's innocent and is ready to go to trial to clear her name.

Totally if she agrees to felony probation with a suspended prison sentence they may as well just sentence her to prison.
No one can she stay out of trouble with those conditions or even work.
Shawn should just take it to trial and win. Only 1 juror finding her not guilty is enough for a mistrial. If 1 or more finds her not guilty then wants to retry a case over a stupid ****ing necklace.
Danette Meyers is a DISGRACE and just using this case to become the new Los Angeles District Attorney.

If I were someone in the trouble Lindsay is facing, I'd be laying so low before the hearing, that I'd be unseen. Lindsay not seeing what is wrong with even coming near a Hollywood hangout in the days leading up to this hearing tells me she has not learned her lesson.
She has no one but herself to blame for finding herself in this situation. Anyone giving her excuses are what is enabling her to continue with the behaviors that keep her in the courtroom and ultimately, jail/prison.
Lindsay is an adult. Time to treat her as such.
Since when does the criminal get to decide whether or not she has to go to jail?

I disagree. She's had far too many breaks. Time to be treated as an adult and held responsible for violating her probation.
Lindsay Lohan should go to jail, period.
For the numerous probation violations and the felony grand theft.
It's appropriate.
It's like the Lohan family knew this article was going to be released before it was released...

Work? LOL... most people who are at work don't break any laws that would violate probation. Kidding me?
Lots of people stay out of trouble outside of work, too. Of course, we're talking about Lindsay here. She's 24 and has a bad-girl/rebel image going on. Because of that, should Lindsay, or any other rebellious defendant, NOT be requested to adhere to probation conditions? I mean.. trying to put it into English here.. because she WILL fail means she shouldn't be on it? Is that even logical in your world?
It is designed to get people like Lindsay to WAKE THE EFF UP and change their ways, OR PAY with state time. Her options are just so limited... I knew you were hoping for the probation to end, but the fact is, it actually would be in Lind's best interest for it to continue. Not YOUR best interest.. duly noted.. you a$ $clowns want her dead.
