JoJo: Hyde's Resident Jailbait

JoJo: Click to watchShe's only 15 and already hitting the clubs famous for the likes of Paris Hilton and Lindsay Lohan.

Though a sign over the entrance clearly says, "21 & OVER WITH ID," teen pop tart Joanna "JoJo" Levesque was spotted coming out the Hollywood hot spot last night.

While she could get some older men into trouble, the club gets off scott free from any wrongdoing - their liquor license allows all ages to enter since they're considered a restaurant.

TMZ is also told JoJo had a trusty adult chaperone with her -- her mother.

4. What is it with underage Hollywood stars that they all need to do things they're not supposed to do??? And why did the doorman let her in in the first place??? It's easy to see that she's not 21. Let's just hope JoJo is not going to turn into Lindsay Lohan...

6. Hyde was actually only granted a 'Type 48' Liquor License by the ABC (Alcoholic Beverage Control) according to public records. Hence their sign out front that clearly reads "21 and over with ID" i.e., that means no one may be legally admitted inside who is underage (21). Here is the California Code on liquor licensing:

Liquor License
When people think of nightclub permits, this is the one they usually think of. The Liquor license is issued by the State of California Department of Alcoholic Beverage Control (the ABC.) Liquor licenses are transferable, and they can be issued to either an individual or a company. Sometimes there is a quota of how many liquor licenses can be issued in a particular area, so it is often easier to buy an existing liquor license from someone and transfer it, than it is to get a new one. This can be expensive (on the order of $50k), but is doable, since there is a thriving industry of ``liquor license brokers'' who specialize in moving these around.

There are several types of liquor licenses, but the two most interesting ones are the ABC Type 48 license (the ``bar'' license), and the type 47 license (the ``restaurant'' license.)

The bar license allows you to serve hard liquor on premises until 2:00 AM, in a facility that only admits entry to people who are 21 years of age and older.

The restaurant license is like the bar license, but lets you serve alcohol in a facility that admits minors. (You can't serve minors, of course, but they can be in the room.) So if you attend an 18-and-over nightclub in California, and they have a bar, then that nightclub is technically a restaurant.

The restaurant license is much easier to get than the bar license, provided you are actually a restaurant. There is a rather complicated definition of what constitutes being a restaurant: Basically it comes down to: you need to have a fully equipped kitchen, you need to serve a variety of full meals during normal meal hours (if you are open.) The ABC documents also go on to say:

``Incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales is not compliance.''

``The Department will presume that a licensee is operating as a bona fide eating place if the gross sales of food prepared and sold to guests on the premises exceeds the gross sales of alcoholic beverages. `Prepared' means any processing preliminary to the final serving of food. Note: Some licensees have a `conditional' license that requires food sales to be 50% or more of the total gross sales.''

This venue clearly does not meet or exceed the criteria necessary in order for it to be considered a 'restaurant' permitted to serve hard liquor to their patrons under California law. They are knowingly and willingly allowing underage patrons (Lohan, etc.) admittance and should have their liquor license either revoked or suspended before one of these air-head celebrities ends up killing someone.

9. If she's being chaperoned by a parent (not that this would help Lindsay Lohan, but bear with me), isn't being served alcohol, and doesn't behave in an inappropriate manner, exactly why is this newsworthy?

Obviously your stock in trade is to blow things up into "news" that really don't make a difference to anyone, but have you ever considered that the reason half these girls end up with no self-respect is because you begin eviscerating them as soon as they're old enough to crawl? How is a 15 year old going to maintain perspective?

Recording an album and being attractive are not just cause to be raked over the coals by a bunch of overtired people with video cameras and a web page.

10. I'm more worried about people like DJ Maverick who would actually post a verbal attack against an adolescent than I am about a fifteen year old in a night club. She's fifteen, for god's sake! Fifteen! How can you possibly hold such a vicious grudge against a fifteen year old? Who is your next victim? Dakota Fanning? Personally, I think Anna Nicole Smith and her baby-of-many-fathers has it together better than anyone who would verbally attack a fifteen year old.

12. Wow... Some of you people (Leonard and Nick especially) really need to find something else to fixate on. Who cares if some girl is in a bar? (apparently with her mother) I've been in Hyde numerous times, and believe me, the stuff that goes on inside is absolutely tame in comparison to what goes on at private parties in the Hills. And by the way, Hyde does serve food (it's actually not that bad -- not as good as North's old menu, but not horrible either.)

I have also been to Hyde on several occasions in the past and the Asian influenced appetizers and other light, late night fare that they offer at the bar clearly does not meet the legal requirements established by the ABC under Claifornia Code for a Type 47 (restaurant + bar) liquor license holder (read the standards I previously posted). The place is so small anyways that it could never support full food service under any conditions while operating as a night club/lounge. Secondly, they [Hyde] are in obvious violation of the law and blatantly flaunt this in everyone's face by continuing to allow underage patrons to enter the premises at their 'own discretion'. Hyde is so on its way to being history soon anyways, by the time the ABC catches up with them ther will already be a new venure there. Also, the law now places shared liability upon restaurant/bar and club owners directly for allowing anyone (even those who are of legal drinking age) to leave the property intoxicated without arranging for alternate + safe transportation Lohan isn't exactly known for her driving skills is she? Hilton was recently arrested for DUI. This is clearly a public safety issue and Hyde needs to be shut down before one of these morons like Hilton or Lohan runs someone over when leaving that place.

It is against the law for any club to let anyone under 16 in, if caught they risk losing their business but if it were say some kind of private party then yes it will be fine to have people under 16 their.

I really think it was a private party due to me not wanting to think someone would be so stupid enough to let someone under 16 into a club and risk losing their business and her mom being their.
