TMZ has obtained the will of Anna Nicole Smith, aka Vickie Lynn Marshall. The will is dated July 30, 2001 and was drafted prior to Dannielynn's birth and Daniel's death, and therefore indicates that Anna only had a son.
The will entrusts all of Anna's property and names Howard K. Stern as executor.
There were two witnesses to the will's signing, one of which was Kimberly Walther, Anna's former assistant.

61. If you will read the will closer, it lists "other descendants" in the will - I believe that excludes Mommie Dearest.
62. All this just gets WEIRDER and WEIRDER! I think that deciding between the two "evils" (slimy Howard K. Stern or old harlot Vergie Arthur) is like picking between a rock and a hard place.
I'll be willing to bet this will is bogus; COME ON did anyone think that Stern WOULDN'T come up with one? I bet the woman died intestate (no will) and the state is going to have to seize control (much as the current judge Seidlin is trying to do now) and delve thru the whole mess.
This is one of those issues that will be in the courts for years and in the end the lawyers will end up with any $$$ that will ever come of it.

63. And where is the deed to the house they said they owned there? They were not legal residents in the Bahamas because Howie cannot PROVE , with physical evidence, that he or Anna owned/own property there. He is an American fleeing justice in another country, enabled by a 'bad apple' government official.

These sleazeball lawyers claim $$ as "costs" "expenses" etc etc
One of the most common reasons that lawyers lose their licenses is stealing $$ from estates, and that's just the ones they catch!

65. I agree with you Mary Thomas How is that Hatten woman anyway she looks at least 46. If you asked me she looks like she had one to many drugs in her life.

66. One of Anna's witnesses was an attorney whose license was suspended for failing to represent his client in a prudent manner. This was early in his career. I don't know what he is doing now.
Khavarian stipulated that he performed incompetently, failed to inform a client of significant developments, improperly withdrew from employment and misrepresented facts, an act of moral turpitude.
In 1995, a year after he was admitted to the bar, Khavarian represented a woman who wanted to pursue a personal injury claim after unsuccessfully filing one on her own. Khavarian refiled the claim but it was again rejected. By the time he filed the case in superior court, the six-month statute of limitations had run. He did not tell the client.
Although the client responded to interrogatories, Khavarian never served the responses. When the defense filed a motion to compel and a motion for summary judgment, Khavarian agreed to dismiss the case with prejudice. He did this without the client’s knowledge, authorization or consent.
After filing the dismissal, Khavarian intended to withdraw from representing the woman, but he did not inform the client of this. She tried to reach him by telephone from August 1996 to January 1998.
Most attempts were not successful. When she did reach him, he would assure her the case was still pending. In early 1998, he stopped returning her calls altogether. The client went to his office and learned he had moved without informing her of his new address. She then learned from the opposing party that the case had been dismissed in 1996.
In mitigation, Khavarian has no prior record of discipline, but it was noted that the misconduct happened early in his legal career.

68. KRISTEN: We have read the will. It clearly states no future children will be entitled to her estate. This will was drafted in 2001..Danielynn was a future child not yet conceived. What's so difficult to understand about that? Did YOU read the will?

69. I want to comment on the post that was Comment # 15 about the baby Dannielynn. I am not a lawyer, but, it looks like the Baby could be provided for by the Executor of the will. There is wording that the Executor could make a decision on a future heir and I believe that the new baby could easily be presented as such.Take time to read the Will and I am sure you will find the page I am talking about. This Will was worded in a manner that noone besides who she specifically mentions could contest. But, the wording leaves an open window , where the Baby Dannielynn could become an heir if the Executor pursues that avenue. JMO
I believe Howard Stern is getting a bad rap. Go read the article about he had already made contacts with Dubais prior to Anna's death , to get her there for purpose of no drug available for rehab. I have dealt with 2 adult children for many years that were heavily drug addicted. It is impossible to 100% control their actions and intent to do drugs. I would hate to think I could be accused of murdering my children if they had died because of their own abuse. I warned them everyday that they were endangering their lives. None of my love, help or intervention accomplished 1 thing . They are now clean , but, only by their own decision and ( help from my prayers to God ). Just as Anna Nicole they were on drugs for more than 10 years and they were in and out of Drug Programs on a continous basis. I believe Howard Stern was her caretaker and he worked for free since 1996. He took her case on Inheritance from the Marshall husband, when noone else would represent her. Also consider this, except for her Event Glamour pics and her appearance at those times. Most of her pics with Howard Stern she looks and dressed like a LADY not a Playboy type image. I think the Autopsy might show that her physical condition was very weak after the birth of a baby and all of the people still Suing, Arguing and pulling at her drained her strenghth and combined with her abusing drugs was what brought on a condition that killed her.
Remember the night before she died she had gotten very drunk in the Hotel Bar and also she had a 105 Tempurature for several days before dying. That high of a fever indicates some Physical health issue.
Sorry if too long, but, I feel everyone should look at a lot of factors before blaming someone of Foul Play. Thanks Ali

A descendant is a child of a mother or father. In this case 'Mommie Dearest' could not possibly be a decendant of ANS, however ANS is one of several descendants of Vergie.
So Vergie is excluded as a beneficiary as a descendant, but theoretically it could be argued that Vergie [as a blood relative and mother] could act as legal custodian and guardian of Dannielynn, a minor child if it can be conclusive established Dannielynn's mitrochondrial markers are the the markers ANS and Vergie share.
On another note - that Khavarian really is a piece of work.

I think they should look into Trimspa..It used to be made with ephedra which is now banned in the United States..it has ingredients in it that do not interact with MAOI drugs..and also has an ingredient that can cause toxicity with perscription drugs..it is called Naringin..Hoodia which is another ingredient in Trimspa is damaging to the liver..I think that she could of died because of Trimspa interacting with the prescription drugs she was taking..I think Trimspa is a bunch of crap and not a safe diet aid
