The Document that Sealed Paris' Fate

TMZ has obtained the official document ordering Paris Hilton back to an L.A. City jail to serve the 45-day sentence imposed last month -- "with appropriate credit."

Paris Hilton is in jail not for driving on a suspended license, but for violation of probation. She's 26 years old and needs to be responsible for her actions. There are hundreds of people in jail for probation violation and she should be no exception. She will serve no more than 30 days on a 45 day sentence, and with overcrowding and credit for time served, she will serve substancially less. She needs to grow up and be an adult about this. Don't do the crime...

Forty-five days is unfair. There was a prior agreement for Paris to serve 23 days and that is what she should serve. Also, what is the point of sending her back to the same jail? Paris should be sent to a different facility, one where the sheriff and the staff treat all inmates the same.

its not fair that paris gets punished for something we all do and we dont recieve any punishment except community service that judge needs to lighten up and he didnt have any say over what the sheriff did so i hope the appeals court overturn his wrongful decision

Here is California Penal code 1203.016(e) that Judge Sauter cited.

The court may recommend or refer a person to the correctional
administrator for consideration for placement in the home detention
program. The recommendation or referral of the court shall be given
great weight in the determination of acceptance or denial. At the
time of sentencing or at any time that the court deems it necessary,
the court may restrict or deny the defendant's participation in a
home detention program.

Look, I'm no fan of Paris, but her celebrity status really has influenced the courts here. Most people would have only served 5 of a 45 day sentence. The judge is now using her as an example and making sure his ego stays in tact.
