Crazy New Legal Papers in Britney Case

In a bizarre twist, a lawyer in NYC has filed legal papers in Federal court, asking that Britney's conservatorship case be taken away from L.A. County Superior Court.

In the documents obtained by TMZ, attorney Jon Eardley claims Britney's rights have been snatched away from her and she has been cut off from life as she knows it.

Eardley claims, "It is doubtful that Ms. Spears can receive equal protection and a fair trial or hearing in the custody proceedings because of the intense media scrutiny of what would normally be private aspects of a person's life." It appears Eardley wants an injunction issued in federal court, asking the judge for the power to protect Brit in the custody case as well.

The documents allege "the deprivation of her civil liberties by the conservator is so severe as to interfere with the effectiveness of the scheduled medications that are covered by the Food, Drug and Cosmetics Act." This appears to be an attempt to get the Federal court to accept jurisdiction.

It is unclear on whose behalf Eardley is acting. We're told Sam Lutfi and his spokesman, Michael Sands, have something to do with the filing, though the exact nature of their involvement is unclear.

78. I'm for her civil rights. I understand that she is ill but that is permitted under the laws of the US. I think that what is happening to her is beyond belief and has more to do with her money than her welfare.

85. Even if these legal papers are legit--they aren't going to ever succeed--they have no legal grounds. Osama needs to give up---he has lost all control and access to the money. Get a job, Lufti.

86. Duh!! This reads like someone that has been in law school maybe a month. It makes no sense. Brittney has no legal right to hire a lawyer, so it was not her. If they want her kept out of the spot light, that is exactly what the conservator is doing. Brittney is the most famous person ever? THis is crazy! There is NO standing regarding pharmeceutical drugs on an out patient basis and not being able to talk on the phone! AND yes on an outpatient basis on meds a person is to be controlled initially in an even tempered environment. Sam wants money, he wants another 15 minutes - what he doesnt seem to understand is those 15 minutes are not going to be good! Your done Sam - get over and move on to some other needy person you can take money from and drug.
I would love to see the courts face when they read this hysterical!!! And that X17 mentioned it was Sam Lufti and his publicist (since when does a low life nothing need a publicist?) who dropped this off at court. Come on the guy has a restraining order against him and 3 others!
Maybe this will be what the Spears need to get the court to approve her leaving California so her parents can take her home away from the crazy paps and Sam's reach. The court needs to put a warrant out for him.

A person with a mental illness or a person who cannot take care of themselves (as in Britney's case) needs a conservator, this has nothing to do with her civil rights, they have not been violated.They were established for her own prottection, as if these hangers on would tsya out, her parents can try to help her or get her the help she needs. Nobody knows whats going on in that house, they dont know if her therapist is going there, as far as we know, there has been no confirmed mentall illsnness, byt if she were on drugs, the same rules would apply because its more than onvious to anybody that her behaviour is not normal.

90. Her civil rights ARE NOT being violated. She is mentally ill, has been diagnosed as such and the courts felt that it was appropriate to appoint her father and attorney as conservators. If you have never had, or been around someone who has had a complete manic meltdown you have no idea how horrible it is. You only see a portion of it in Britney's case, the reality, I can guarantee you, is 100 times worse. If her parents hadn't stepped in she'd probably be dead by now. They are protecting her and getting her down from the manic meltdown and they have to maintain control over her money, transportation, contacts etc in order to do that!
