Lawyer Claims Britney Held Hostage!

2/17/2008 3:10 AM PST BY TMZ STAFF

Britney SpearsThe lawyer who derailed the Britney Spears conservatorship case tells TMZ Britney herself called him and asked him to take the reins. The question: Will a judge be buyin' what he's sellin'?

Attorney John Eardley filed papers in federal court last Thursday, alleging the California courts have railroaded Britney by imposing a conservatorship. Eardley tells us Britney called him, but he would not disclose the circumstances surrounding the alleged call or what she said. We do know that Michael Sands, who used to be the spokesperson for K-daddy's lawyer, Mark Vincent Kaplan, is now the mouthpiece for Eardley. And Sands also reps Sam Lutfi, who is now restrained from all things Britney.

So, are Lutfi and Sands behind the whole magilla with Eardley? Smells like it.

Eardley tells TMZ Britney didn't sign a retainer agreement because she is being "held hostage" in her own home. Ironically, a half hour before he told us this, we looked out our office windows and saw Britney driving through West Hollywood on a shopping spree.

Just by filing the Federal papers, Eardley has paralyzed the California courts from issuing more orders in the conservatorship case unless and until the Federal judge tells Eardley to take a hike.

Didn't we just see a pic of her & daddy Spears at dinner with her cell in her hands?! wouldn't that indicate that she's NOT cut off from communication?!

Perhaps you can't get an answer to your question because no one understands it. I mean, where did you get the idea that an family law attorney is the "mouthpiece" for some lawyer in Washington DC/NY that crawled out of the woodwork for his 15 minutes of notoriety? Your question makes absolutely no sense.

The whole story is reported on "E" online....

I wondered why so many paparazi were waiting when her car pulled up in front of the stores (same thing about the Social Club Saturday evening)..... after reading the E story it became crystal clear, Britney arranged a meeting with Allie and Allie (or Britney) tipped off photographers.

Time to take away here cell phone, too.... JMHO

276. Hmmmmmm,,,, well about 2 hours before she went out with Pops, X17 is claiming she did this:

X17online can report exclusively that Britney spoke with attorney Jon Eardley last night and told him she wants him to help her get "her life back."

Around 6:00 pm PT Saturday evening, the two spoke about the job Eardley would do for Britney -- he asked what "latitude" she would give him in defending her.

Britney responded: I want my life back; I want to be able to drive my car; I want to be able to live in my house by myself. I want to say who is going to be my security guard. I want to see who I want to see at any time and make it happen.

Interesting since Sam is behind the hiring of Eardly and Sam is the one who is tight with X-17, not hard to figure where this story came from.... but, if it is true, Daddy Spears needs to cut off Brit's phone service for now..... has she even seen a shrnk yet? Is she even trying to do anything to get well so she can see her babies again?

Case Should Be Solved In No Time

Isn't it funny how all things lead back to KFed...what a surprise. I hope this federal judge orders whatever the f**k this guy's name is to pay for all court costs including the Jamie Spears fees, in return for wasting the courts time and resources. And I'm surpirsed this lawyer doesn't what the term "conservatorship" means and WHY it's given.

Standards are badly needed.

Britney wasn't even capable of communication with the law firm she hired for her custody dispute, let alone mentally rational enough to show up in court for her kids. That's why they filed to dump her as a client. Why should she bother to start another no-show/no communication case? It's going to be hard for Eardley to defend the 'rights' for freedom of a client who doesn't EVER show up because she's so free, she's decided to go to Starbucks , shopping, dancing or gas station surfing instead. If she IS cut off from the internet, that's too bad because if she doesn't trust her parents, she could trust her fans on here. I'm impressed with everyone here today. I think that anyone who sees Lufti out in a club again (Paris) should immediately call the authorities so Osama can be SERVED. I'm also wondering if this lawsuit is a distracting snowblind while he arranges to leave the country with the alleged missing 50 or 60 million. Something is up here, and bears continued investigation. The net is tightening, but the financials have to be fine tooth combed before charges can be filed.

I did read all the postings, and still don't see any connection between Kaplan and Eardley. Kaplan is an attorney for K-Fed, with a practice limited to domestic relations law. Eardley is an opportunistic vulture, obviously connected to Sands and Lufti. No connection whatever between divorce counsel for K-Fed and purported civil rights attorney for Britney. Perhaps you should draw the lines -- explain how you see a connection.

Totally agree with you Rappy (1.04pm)!!
And while x17 maintain that Britney is screaming out for help and how she can survive without Sands/Eardley/Sam, OK took a better approach and focused on some more positive gossip: apparently from another "source close to Britney" a lawyer called Phillips may be being taken on!
"Stacy Phillips of the law firm Phillips, Lerner, Lauzon & Jamra. Phillips is no stranger to high-profile cases, having represented Bobby Brown, baseball legend Darryl Strawberry, and the ex-spouses of Axl Rose, Tori Spelling and Jean-Claude Van Damme, among many others in her 24 years of family law practice.
The Ivy League legal eagle — she has degrees from both Dartmouth and Columbia — is one of the most feared divorce and custody attorneys in the country and has recently written the book, Divorce: It's All About Control How To Win the Emotional, Psychological and Legal Wars. Ironically, Divorce received a certificate of commendation from the Mayor of Los Angeles, Antonio Villaraigosa, whose soon-to-be-ex-wife Corina is represented by.... that's right — Phillips!"

Oooh I soooooooo hope it's true - she sounds like someone who could taken on KPlan: "Divorce: It's All About Control How To Win the Emotional, Psychological and Legal Wars." Exactly what the Britters needs!!

Interesting...thanks for the update, seems TMZ is napping the last couple of days; she needs a strong lawyer on many levels, not the least of is getting rid of Trope and Trope and someone strong enough to take Britney, herself, in hand as well as the custody issues.with K-Fed.

britaculous and Rappy: Stacy Phillips would be an excellent representative for Britney (assuming Brit decides to cooperate with counsel this time around -- she's got to understand that you cannot simply turn the matter over to the lawyers, the client has to be a participant). Ms. Phillips' credentials from Martindale Hubbell:

I wouldn't believe a word coming from x17. That site is Sam's mouthpiece.
