Lawyer Claims Britney Held Hostage!

Britney SpearsThe lawyer who derailed the Britney Spears conservatorship case tells TMZ Britney herself called him and asked him to take the reins. The question: Will a judge be buyin' what he's sellin'?

Attorney John Eardley filed papers in federal court last Thursday, alleging the California courts have railroaded Britney by imposing a conservatorship. Eardley tells us Britney called him, but he would not disclose the circumstances surrounding the alleged call or what she said. We do know that Michael Sands, who used to be the spokesperson for K-daddy's lawyer, Mark Vincent Kaplan, is now the mouthpiece for Eardley. And Sands also reps Sam Lutfi, who is now restrained from all things Britney.

So, are Lutfi and Sands behind the whole magilla with Eardley? Smells like it.

Eardley tells TMZ Britney didn't sign a retainer agreement because she is being "held hostage" in her own home. Ironically, a half hour before he told us this, we looked out our office windows and saw Britney driving through West Hollywood on a shopping spree.

Just by filing the Federal papers, Eardley has paralyzed the California courts from issuing more orders in the conservatorship case unless and until the Federal judge tells Eardley to take a hike.

Osama promised to make trouble, to bury Britney and piss on her grave, something like that. So, if he loses control, as he has, then he might as well stir up all the crap he can get away with, as he seems to be doing. He hasn't much to lose, except his freedom if he is convicted of crimes. His reputation is shot, his professional validity, if there ever was any, doesn't exist anymore in the eyes of anyone with any sense. He has nothing to lose but to do as much harm as he can.

Britney and Daddy are out having dinner. She appears to be really dressed up, nice dress, makeup, good hair. Dad's dressed nicely, too. It's good for her to be seen out in normal, respectable activities. Daddy knows what he's doing. Lufti's a fool if he thinks anything he did with Britney looks okay.

what you might have meant to say was...    

By writing: "Just by filing the Federal papers, Eardley has paralyzed the California courts from issuing more orders in the conservatorship case UNLESS AND UNTIL the Federal judge tells Eardley to take a hike." (Emphasis Added)

You are presupposing that you have foreknowledge pertaining to the decision of a judge on the federal court, and that such knowledge indicates, that you know the court will tell Eardley, to "take a hike."

You would have been better served, if you wrote "unless and if", or even just "unless."

As to your readers, they might be better served, if you considered utlilizing the occassional, wait for it, wait for it,...comma!

A stunning development in the Britney Spears conservatorship battle has left lawyers and legal experts scratching their heads all over Los Angeles.

It appears that the case, which involves a small army of lawyers, is now stalled until an unusual (to say the least) dispute can be resolved. What it boils down to is this: are Britney Spears’ civil rights being violated by the conservatorship which has been engineered by her parents?

But at the same time, nothing else can happen until the federal court decides whether or not to accept jurisdiction over the case. “Access” has learned that research attorneys in Superior Court are looking into this matter.

Presumably so are attorneys for Jamie Spears (who “Access” has been unable to reach them for comment), who would want the case to stay in Superior Court.

It would be highly unusual for the federal court to take over a case like this. But it could happen.

If Britney's conservatorship violates her civil rights, then all conservatorships violate the civil rights of the person they presume to protect. Therefore, no conservatorships can be set up and all existing ones are null and void.

Even if it were true that Britney had contacted this lawyer (how did she get his name?), she has been deemed by the court to be unable to hire her own attorney at this moment because of mental incapacitation.

Most people who are forced to be in a psych ward, in rehab, in prison, under guardianship will declare that they do not need such protection, treatment, or help, that nothing is wrong with them. Mentally ill people do not usually recognize that they are impaired. I know this from taking care of a relative with a mental illness. He claims that he is totally normal and sometimes strongly resists any attempt to help him with tasks that we know he must have help for. He constantly states and seems to believe that his judgments and actions are that of a normal person when they are indeed not.

I am sure that the courts are experienced enough to recognize this as standard behavior for those who are put under forced guardianship or conservatorship. If Britney's behavior had shown that she was capable of looking out for her own best interests, and was not judged to be impaired by medical professionals, none of this would have taken place.

I have stood up for Jamie for along time, but taking her out clubbing tonight, I don't think I can defend him anymore. He's paraded her in front of the paps every day this week, and sending her on a concert tour is nuts. The paps are part of what has sent Brit crazy...he should be taking her away from them, instead he has one visit almost every night (Adnan) has her held hostage inside a place that has 24 hour/day stalkerazzi outside, and claims she is so seriously ill that she can't look after herself, yet thinks she's well enough to be paraded up and down melrose day after day? WTF?? Sorry Jamie, don't support you anymore.. I think u r just in it for the money and fame, and hope Eckhardt puts you in your place.

I have seen the way the press and pappaza treat these stars. The snakes that hide behind the freedom of speach and press and it sickens me. I do not think for one second that brittany was hostage. I do believe that she needs help but for her to be able to do that. All of the greedy and lying pigs need to leave her alone. There are more things in this world right now that any real journalist and photographers and even show hosts should spend as much energy if not more to the horrible atrosidies in the world and more importantly in our country. I'm sure in your little TMZ area there are children going to bed hungry and having to sleep in a car. How many times do yoou reach out and help those people in need.I also agree with some of the people around brit are trying to do what's best for her and not for a second do i think it is her parents. They were pimping Brit at 16 and not only pimp but destroy their other daughter who is 16. Am I the only parent in the world that sees where the problem lays. All the parents see when they look at their daughters is $$$$$$ just like pimps. Thank You for letting me add a comment here, please think about what you are doing to help Brit instead of becoming the other pimp on the 2nd block over only seeing $$$$.

MARY: What a rubbish! Britney has just lost 60 miilon and you talk about her family using her to make money of her. She would never have become this famous and rich without her parents. They where the ones who made the right financial decisions and hired the right people to make Britneys money grow when she still was underage.

If anyone is right to take care of her finances now it should be her family EVEN if that might include they are getting payed for it. The thought does not bother me for a second. I rather see they get it then a svine like Sam Lufty or the other gentlemen that surround him.

As for Britney being hostage. If she was, the police would be there in a minute and investigate which is what they do. Sam Lufty held Britney hostage by controlling her mind and mental state with pills.

It would be wonderful if the federal jurisdiction reacts soon because no serious judge who analyses the situation will rule in any other way as the state court has done.

Britneys parents had a bad reputation in the media and public eye before all this started. Now they win the publics and medias respect more and more the longer the conservatorship is in place. I am glad for them. I pray for them and Britney that they grow togeather instead of apart now.

F all of this. There is nothing these miscreants can do to impede her return to society. Tell Sam that, yes. when she remembers she is going to expose more of what he did. The detectives are talking to her, If he is smart, he will pray this never hits court. The legal beagles i talked to said this bootleg litagation isn't worth the paper it is printed on.
