Lawyer Claims Britney Held Hostage!

2/17/2008 3:10 AM PST BY TMZ STAFF

Britney SpearsThe lawyer who derailed the Britney Spears conservatorship case tells TMZ Britney herself called him and asked him to take the reins. The question: Will a judge be buyin' what he's sellin'?

Attorney John Eardley filed papers in federal court last Thursday, alleging the California courts have railroaded Britney by imposing a conservatorship. Eardley tells us Britney called him, but he would not disclose the circumstances surrounding the alleged call or what she said. We do know that Michael Sands, who used to be the spokesperson for K-daddy's lawyer, Mark Vincent Kaplan, is now the mouthpiece for Eardley. And Sands also reps Sam Lutfi, who is now restrained from all things Britney.

So, are Lutfi and Sands behind the whole magilla with Eardley? Smells like it.

Eardley tells TMZ Britney didn't sign a retainer agreement because she is being "held hostage" in her own home. Ironically, a half hour before he told us this, we looked out our office windows and saw Britney driving through West Hollywood on a shopping spree.

Just by filing the Federal papers, Eardley has paralyzed the California courts from issuing more orders in the conservatorship case unless and until the Federal judge tells Eardley to take a hike.

You shouldn't mess with proverbs and mind control. It's just not good karma, or nice. :)

Ex says Britney doesn’t want her kids
Dan Steinberg / AP
Judging from her behavior during her custody hearings, it doesn't seem like Britney Spears wanted to keep her kids. Now, her first husband, Jason Alexander, tells In Touch that "she doesn't want to be a full-time mom."

While courts decide how to handle representation for Britney Spears in her ongoing custody battle for little Sean Preston and Jayden James, Britney’s first husband claims she doesn’t even want the kids back.

Jason Alexander, who shared 55 hours of wedded bliss with Brit back in 2004, spoke to In Touch about his ex and her visitation-only goals.

“She wants to see them, but she doesn't want to be a full-time mom,” Jason told the magazine. “She said it doesn't matter if she doesn't get them back full time, and that she can always have other kids later on.”

SHE SUPPOSEDLY CALLED HIM AND TOLD HIM THIS. HE DID SAY SHE IS NOT RIGHT. SHE SOUNDED BETTER THAN SHE DID SEVERAL WEEKS BEFORE WHEN SHE CALLED HIM, BUT HE CAN TELL SHE IS NOT RIGHT

It's "reins" not "reigns" unless this is some sort of subliminal message.

Lawyers, managers, low life leaches...they all want a piece of Brit's $$$$ and it is disgusting!

Good luck Spears family. And, a huge high fives to Jamie, Brit's dad for taking the reigns and trying to help his daughter.

And, of course Slimey Sam Lutfi is a part of this scheme too. When is the LAPD going to arrest his sorry @ss???

TMZ needs to get a life! Who care about Britney's legal messes? This could go one a long time! She is a messed up, washed up has-been who had more than her 15 min. in the spotlight. Her silly life is dull and boring. I don't think anyone wants to hear about it anymore. TMZ find something interesting to report!

I think the LAPD needs to expand their Lufti investigation from more than just ground up drugs in her food....and then there is this new snuggly relationship with Lufti and Sands. I'd be surprised if it isn't a threesome with K-Fed in the middle.
Brit sure has been doing a lot better since Sam has been banished.
She must realize by now that he was messing her up big time.

truth about conservatorship

I don't know why people think her parents and brother are being paid for their time. I have seen no indication of this. Let's look at this from a real world, non-Hollywood angle. If you have a child who has a developmental disability like autism or Down's, when they are 18 you go to the court and have a conservatorship put in place as they are not mentally capable of handling their own affairs. The same goes for someone with schizophrenia or bipolar. Some of these conservatorships can even go so far as allow the conservators to administer medications. In Britney's case, the conservatorship does not give control of medical issues to Mr. Spears so he would not be administering medications. Conservatorships are also put in place by the children of elderly parents who are rendered disabled by Alzheimer's, dementia, etc. None of those children are being paid by anyone either. Britney's brother and another trustee have control of her finances but basically to make sure bills are paid and she can't enter into any contracts while the conservatorship is in place. Obviously they are letting her spend some money since she went shopping with her mother.

I don't know that I've ever heard of a celebrity's parents going to court for a conservatorship and forcing help on their child and there are plenty that could have used it. Heck, there are some that might still be alive today if they had been forced to get help. I say her parents, while certainly practicing tough love, are doing what millions of other people across this country do when their families need them to. They are not benefitting from it in any way. In fact, I'm sure it hurts them terribly that they are having to not only watch their daughter go through this but to do so in the public eye.

I think they did violate her rights. If she wasn't a super rich pop star, and wasn't hounded every minute of her life, she would be fine. Although Sam Lutfi looks like a thug.
