Did David Cook Rip-Off "Eleanor Rigby"?

David Cook was on fire with his rendition of the Beatles classic "Eleanor Rigby" on "Idol" last night -- but a Seattle band claims he swiped the arrangement from them.


The band DOXOLOGY recorded their version of the track a year and a half ago, putting it up on iTunes and on the band's MySpace page. The band's manager tells TMZ the song is what they're best known for and have played it at nearly 200 shows.

"Idol" tells TMZ the contestants pick their song and present their ideas for the arrangement to the show's musical department and work with them on it.

152. David Cooks version is SO MUCH BETTER THAN DOXOLOGY'S AND THE GIMME GIMME...he's totally nailing it...and I wouldn't mind watching him nail it again...he's a true born rocker. He has "it"...don't be haters...just b/c he's killing it!!

154. I most definitely agree with Fanito Bandito. These Doxology guys are just pissed because he covered it much better. How the hell can you be angry that someone else's cover of the same song sounds "similar" to YOUR cover of the song. It's Lennon and McCartney's song to begin with, and DC's version sounded nothing like that Doxology crap, it was much much better and had a lot more feeling behind it. Everyone tries to get their 15 minutes of fame I guess.

158. David Hernandez' girly eyebrow-arching, femmy faces finally caught up with him. Sleezy old men may think that faux cheesy "International Male" catalog model pose of his is sexy, but no one else does. I was so happy to see him go cause he didn't think it was gonna be him. And Hrernandez, if you're listening, you're over-tweezing your eyebrow BTW and you look ridiculous.

159. The lead singer of Doxology sings “Eleanor Rigby” well. I’m not denying that. But as a producer, engineer, and mixer who uses his ears every day to hear talent, I think that David Cook rocks it better. I feel that if you’re going to do a rock cover of a song that was not meant to be ‘rocked’ to begin with, then you should go all out. In my opinion, Doxology’s version would have benefited with a tougher vocal. Luke McPherson sings the chorus well, but the music is hard and rocking, and his voice seems too delicate for the track. The style of the vocals does not compliment in the music. Again, this is all just my personal preference. For the genre of the arrangement (which is rock), David Cook does a better job because the way he sang it compliments the music.

I’m not denying the fact that Doxology should get credit for the arrangement – I totally agree - so long as David Cook referenced it. But to say that they have “no intention of suing” is a completely pointless and ridiculous statement. As I mentioned in my previous post (#128), they have no right to sue because they aren’t the rightful owners of the song (and you can’t own an arrangement). We must also remember that in order to actually go through with a lawsuit, there has to be some sort of monetary damage – they can’t just get money for free. As of now, there is no monetary damage – David Cook hasn’t released the arrangement on any album, nor has he profited from the song at all. The fact that Doxology said they won’t sue either means (1) they failed to realize that an arrangement cannot be copywritten, or (2) they said it in hopes that it would serve as a means of intimidation towards American Idol and David Cook.

I’m not saying that Doxology is doing this for publicity. I’m just saying that they need to be a little bit more grateful, and less antagonistic, because the truth is that they ARE receiving more publicity from this. Wanna know how I found out about Doxology? Well, I did a search for “David Cook Eleanor Rigby” on Google, and this TMZ link came up, which ultimately led me to Doxology’s MySpace, a band I’d never heard of before tonight. Think about how many others there are around the world who have also visited their MySpace in the same manner.

Lastly, I sure hope that Doxology licensed the song before recording it and paid for a compulsory license, or else by posting this response to David Cook’s performance, they’ve dug themselves into a hole because it would only be a matter of time before the copyright owners found out.

160. Doxology "borrowed" the song from The Beatles themselves and believe me, The Beatles rarely give permission to anyone to use their material. So they're at fault as well. The only ones who can bitch are Ringo and Paul and sadly they allow a talent show such as AI to exploit their songs in horrific covers

162. There's no question that he does like to pick songs that were already covered by faster bands. Like the song Hello by Me First and The GImme Gimmes. and before that he did Happy Togeather that sounded closer to the Simple Plan version than the original

163. FYI, McCartney does NOT own the rights to any Beatles songs. Sony does, and I think Michael Jackson might still own partial shares in them. Jackson bought the rights to them a long time ago, but he sold some to Sony.

164. Who does this American Idol dork think he is anyway? He has the stupidest looking hairdo I have ever seen for a guy that young. It is obvious his hairline is receding and he tries to cover it up by combing his hair forward like that. It looks so obvious - he should do his hair normally. If his hair is receding, suck it up and be a man about it. As a woman, there's nothing more UNattractive that a guy who tries to hide the fact he is losing his hair. I used to date a guy who was going bald, and he just admitted it and shaved his his whole head. That kind of confidence is WAY more attractive that some wussy guy who tries to hide it.

165. you know I think this whole thing about cook ripping off the version of this song from a recent band is really dumb. I do agree that the bands manager is being smart about making a big deal about it because it is getting them media attention. You know I have never heard of this band, and from what I hear really dont want to. I like cook, as one muscian to another we have been stealing, or borowing music from other people for years, were do you think music came from. What he did was alright. I didnt even know anyone else had covered the song before. The beatles are the main people here who needs to be recognised and they did. So come on this whole ordeal is just stupid.
