Laws vary by state. California's laws have changed recently requiring you to have at least an M2 license and to wear a helmet. In the case of a 50cc Honda Ruckus, i'd say you need both the license and a helmet. But in the case of Shia, I guess all he needs is money to drive that thing.

That looks more like a scooter, I don't know about Cali, but a lot of states have different laws governing scooters.

send the pics to the DA, they'll take care of him, a license is required for scooters in CA and he is clearly breaking the law

Since you posted the photos online, Shia can now face legal charges. TMZ should be helping their celebs and not hurting them, Celebs put food on ur table and cash in ur pocket. In most places you do not need a valid drivers license to operate a scooter, and if you do require licensing it's only a learners permit that is required. As for the not being cool on a scooter, what other legal option does the guy have, atleast he's found a way to get around on his own instead of wasting money having someone drive him around everywhere.
