Katherine Jackson Sues AEG Over Michael's Death

9/16/2010 10:17 AM PDT BY TMZ STAFF

Kathrine Jackson believes the death of her son Michael Jackson could have been prevented ... if it wasn't for the "negligent" actions of the doctor who was hired to keep him healthy.

During a recent interview, Katherine was asked if MJ's death was avoidable, to which she responded, "It could have been prevented because he had hired a doctor to watch over him. The doctor was negligent."

As we previously reported, Katherine Jackson and Michael Jackson's children are suing AEG Live -- claiming the company breached its agreement to provide physical care for Michael Jackson -- and that AEG was negligent in their hiring of Dr. Conrad Murray as MJ's physician.

In the suit, Katherine claims AEG's contract with Michael "created a legal duty for AEG to act reasonably toward the physical well-being of Michael Jackson."

In the document, Katherine also blames AEG for hiring Dr. Murray without  a proper background check -- claiming, "AEG did not provide a doctor who was truly looking out for Jackson's well-being and did not provide equipment."

The suit also alleges AEG caused emotional distress to Michael's son Prince because he witnessed Michael suffering and dying, and "he was put in a position as bystander to these tragic events."

Kenny Ortega, who produced the planned London concerts for Michael, is also named as a defendant.

The attorney who filed the suit, Brian J. Panish, released a statement saying, "The purpose of this lawsuit is to prove to the world the truth about what happened to Michael Jackson, once and for all."

Guess Whose Darling Daughter

Can you guess which Hollywood heavy hitter was spotted out to lunch with his adorable daughter?

Pauly D Lets His Hair Down

Pauly D is in the next issue of GQ -- but his infamous blowout hair 'do isn't!

The "Jersey Shore" boys got a sporty makeover for the October issue -- and were forced to ditch their Ed Hardy pants, jewelry and hair-gel for the shoot.

See more -- and get workout tips from from Pauly, the Situation, Ronnie and Vinny -- when the issue drops September 21.

Heidi & Spencer -- Kiss & Make-Up

This photo pretty much proves Heidi Montag and Spencer Pratt aren't getting divorced ... and may also make you lose your breakfast.

The gruesome twosome just happened to be photographed while kissing on Heidi's 24th birthday in Santa Barbara yesterday -- while Montag proudly displayed her wedding ring.

A toast to the happy couple?

The Guys from Ace of Base: 'Memba Them?

In the '90s, Swedish pop group Ace of Base (Jonas Berggren, Linn Berggren, Jenny Berggren and Ulf Ekberg) became famous with hits like "Don't Turn Around," "The Sign" and "All That She Wants." Guess what they look like now!

Teri Hatcher Completes Triathlon

Teri Hatcher suited up and hopped into the water yesterday for the 2010 Nautica Malibu Triathlon.

Hatcher, who previously posted swimsuit photos of herself on her Facebook to promote the event, competed in the swimming portion of the event.

Her teammates included "Modern Family" star Julie Bowen and Disney head honcho Bob Iger.

Hatcher took part in the event to raise money for the L.A. Children's Hospital.

The Situation -- He Shore Found a Nice Apartment

When The Situation decided to go apartment hunting in Los Angeles, he picked out a place with the most guido-sounding name he could find -- The Palazzo. Ay-oh!

But in all seriousness ... The Palazzo is a giant, swanky apartment community the size of a small city that happens to be located right near the CBS lot where "Dancing with the Stars" shoots. We're told he had his eyes on a unit that ran more than $5k per month ... but no sweat off his brow --  "DWTS" picks up the tab.

And the best part -- he doesn't have to share a bathroom with Angelina!

What's the Big Frigin' Difference?!

Listen up gumshoes -- sleuth through these tricky pics and see if you can spot the subtle differences!

**HINT -- There are THREE differences in the above photograph!**

Reynolds Talks Marriage, Shows Abs

Ryan Reynolds shows off his tattoo and toned abs in the new issue of GQ -- where he admits his marriage to Scarlett Johansson is "the best part" of his life.

Though Ryan rarely talks about Scarlett or his personal life, he tells the mag the couple will start a family "a few years down the road" -- and that they're not currently adopting a baby from Ghana, as tabloids have reported.

Check out more pics from the shoot above -- and the full issue when it drops September 21.

Are you people nuts??? This was a 50 year old man who made BAD decisions and people think it is OK to sue for that? Sure, the doctor should be held accountable for doing something that illegal but MJ was the one who pushed and pushed. He was an addict and his careless behavior led to his own death. It would have happened sooner or later. His own family even said they tried and tried to get him help but he wouldn't listen. So, why are they suing? These are obviously money-hungry, fame mongering individuals. Jermaine is CONSTANTLY on Larry King singing MJ songs like he IS MJ and now this law-suit??? Cmon...just let it go!! Move on!!

Im sorry but i know thisis your opinion and everything but that dosent mean you have to be rude. I dont think you would like it if someone said that about you. And FYI there was never any proof that MJ raped his children. And besides dont you think they would have said something by now?

Why do we have a view and read about all those stupid

things entertainers do.

I can not beleive these people comments this man was one of the greatest people on earth and done so much to touch people lives he so much touch my life not only as a entertainer but as a wonderful human-being i don't think the music industry has been the same since we lost the most famous person on earth. All i can say is my heart goes out to his mother and his children becaues i know she is only doing what she feel is right for her son, his kids, and herself so she can have some closure it's hard being on the outside looking in and not knowing what happen to the man she gave birth to,raised, and loved. I know she is not doing it for the money i think she is doing this to have peace for her self and her grand-children and i know one day god will give her and his children that. Mrs. Jackson I think you have more guts and more heart than anyone in your family for standing up for your son and i know that's why he love and appreciated you so much we need more mothers like you.
May god bless he is so misssed.

Michael Jackson was the greatest entertainer in the world as well as the greatest activist known to wo/mankind in the ranks of Mother Theresa, Gandhi and many leaders that have walked the earth before him. The problem is not that the world lost a voice for humanity, but that the world is not ready to recognize the greed behind corporate America. In order to recognize why we lose over and over again when it comes to building peaceful relations, healthy environments and love for each other is because we have been silenced from the organizations that run us. Michael was a puppet and AEG didn't give a damn about him that is the truth and unless people stop worrying about who Michael preferred to have sex with and begin to think of corporate responsibility and government responsibility for the health and well-being of its employees (we the people), we will all continue to be broken at the hands of these corporation's we are enslaved to. There is a lesson to be learned here and an awakening that must be had for any of this to really matter. Look at what we do to our role models. When no one has done any wrong in their own lives is when you have the right to judge and until you all get together as one, life for everyone rich and poor will be a miserable existence. R.I.P MJ we love you!

Regardless of what he did or didn't do for the world, the bottom line is Michael Jackson was an addict. In interviews, he said that he had a serious case of insomnia and had been battling that for an extended period of time. I know from experience that a serious lack of sleep leads to desperation. In his case, it lead to medications--medications that were addictive. At the point that his physician saw that he was addicted to the medications, he should have taken steps as a professional to seek some intervention. Instead, he just went along with it. He completely overestimated his ability to control the situation and should have admitted he could no longer handle Michael's addiction. Ethically, he chose money over doing the right thing. I also think that Katherine and the whole family should take responsibility, too, as they admitted that they knew he had a problem and did not take the drastic steps necessary to get him help. They let him do whatever he wanted, and if anyone knows anything about dealing with an addict, it's all about getting more drugs, alcohol, medication, etc. Michael was not capable of making his own decisions, because he was an addict. The adults in his life should have recognized this and intervened. No one wants to take the blame, because that would be a horrible thing to live with. They all want to blame each other, but ultimately, they are all responsible for his death!
