D.A.'s Offer: Six Months in Jail for Lindsay

Sources connected with the Lindsay Lohan case tell TMZ ... the offer Deputy D.A. Danette Meyers made to Lindsay's lawyer in chambers was SIX MONTHS in jail.


Judge Keith Schwartz said in open court he had a feeling Shawn Holley would pass on the D.A.'s offer.  That's because Lindsay will not accept jail time -- at least not now.

But here's why we're almost positive Lindsay will eventually cop a plea.  She is going to jail no matter what.

The judge ruled Lindsay's preliminary hearing and probation violation case will be heard at the same time.  At the end of the preliminary hearing, if the judge feels it's more likely than not that she stole the necklace, Lindsay will be thrown in jail immediately while she awaits trial on the grand theft case.

So even if Lindsay is ultimately found not guilty at trial, she'll still be in jail for the probation violation.

Short story ... it's likely Holley will plead guilty or no contest on behalf of her client, and then hope the judge gives Lindsay less than 6 months.

Jail time is so ridiclous! These adults are going to turn this girl into a prison inmate! She made a mistake plain and simple. Don't we have enough problems in this world than all these people picking on her. I don't know who the jeweler is but I wouldn't buy anything off her. She is a bueatiful talented girl and when these people are done she will be different. They will rape her in prison and mistreat her.


You're right, Marson, only the unbeautiful and talentless belong in prison. Absolutely! That's what our legal system revolves around - imprisoning those who are average, not those who are entitled.


She might as well Od and be done with it rather than go to prison. These people are pushing her toward that. SHAME on them!

Actually, hopefully she'll be kept AWAY from drugs and have LESS of a chance of ODing than out in the real world.

But, whatever. She gets what she deserves - time locked up.

Well, Ginny, she must NOT have had compelling evidence about her innocence. It's a given that Shawn handed everything relevant over to the judge, including anything to prove her innocence. And the judge reviewed it and this was his finding.

I hope we're now not going to claim that the judge is crooked or unfair?

Wow Danette Meyers is fugly no wonder why she has a hardon for Lohan. But really I think Lohan needs to take a year off from the media and get her act together. At same time if she serves time Lohan can use her super les powers to rule the jail or vise versa.

Breaking Probation means that if you have a tail light out on your car IT IS ILLEGAL therefore they can jail you. When on Probation you ARE guilty til proven innocent. The everyday person on the street would have been doing 3 years by now...and never would have gotten out of the jewelry store with a necklace around their neck to start with. She isn't going to get talks and hollywood walks.

Eventually, and it is sad, this woman, but still a child morally and emotionally, will probably die from overuse of drugs. We've seen it before and all the indications are here for this to happen again.

She's heading down this path and there is no one around her who really cares about her, or they wouldn't be talking about themselves ( you hear me). She needs to be taken away from the limelight for years, away from her family and anyone else, who is only famous because of her. That family should be damned.

And, yes, she is an adult, and will suffer the consequences as an adult, but is morally and emotionally a damaged child.

PLEASE stop coverage of L. Lohan, she is nobody, what ever celeb. status she had was short lived and your coverage of her has far exceeded her 15 minutes of fame. Enough already, no one cares about her, we don't want to hear her name or see her face

They have the whole thing on videotape, and after the trial we will all be able to see for ourselves exactly what Lindsay did.

The necklace also had a yellow diamond, it wasn't just a chain by itself.

Winnona Rider also thought she was such a big star she could go shoplifting and nobody would prosecute -- it ended Winnona Rider's career.

Well, SCH has 2 weeks to get Lindsay to do the best thing for her - plea deal. She won't win a trial by jury. She just is delusional as usual, but her attorney doesn't live and work by that theory.

She will talk Lindsay into having some sense before the 10th. She will plead guilty or no contest. 6 months with the reduction for overcrowding and good behavior is alot less than what she could end up with, and Shawn knows it.

Don't statr gambling on your life right now Linds, you are not nearly as loved as you think you are. And there's too many regular folks out there that want to see you finally pay for your antics.

People keep saying things like this but I don't see it. Once you take away all the things people think she did and look at just what she has been convicted of I dont think the average person would be doing 3 years.

If Lindsay is looking at 48 days in jail, i think that she will take it to trial. I think it is going to be a difficult case to prove to a jury. People have posted that the ADA has to get 10 out of 12 jurors to vote guilty. I think that Holley looks better and is smoother in court than ADA Myers. If it goes to trial I would say 75 percent chance Lindsay is found not guilty. Lindsay defense is that she had no intent to steal, simply forgot that she had it on......NOT GUILTY!!!

is that in cali.i know in NYS you have to report any contact with PD to your PO and its up to him to determine if its a just violation.alot of states are diff.some will arrest you just for being in the wrong place IE a club/bar and there is an issue there not involving you.but you can get violated.part of her probation should deff include,from the start,not being in any place that serves alcohol period.if you are on probation in NYS for an alcohol related offense that is common.

I feel horrible for this young woman, given the parents she has. The 'mother' standing in the court window fixing her hair before going outside, yep, got that on camera and then her nut job father taking the mic and promoting himself. SHAMELESS! Beautiful outfit but too low cut for a court room. Maybe she was paid by the designers? None of that makes any difference. Lindsey needs to cut them loose. I am a mother Lindsey if you ever need to vent. I will tell you the truth in a loving motherly way . I would also be there for you the entire time you are going through this. I have a son just a bit older than you and sure, he made a few bad choices growing up, I stood by him and was there for him, but never once, if he were in the wrong never did I make excuses for him or lie to him so that he could justify his misgivings. By doing so, he turned out a wonderful young man .Responsibility Lindsey, take it, deal with it and get on with your life. ALos, tell your parents you no longer want them to enable you, you want the truth from them, period. The judge this morning gave good advice, if you can read between the lines. Find that sober coach and psychologist quickly. You have a wonder life ahead of you if you start being honest and true to yourself. I wish you the best of luck and hope that in the end of all of this, you have learned and are able to move on and experience all of the wonderful things life has to offer . To all of the people leaving the nasty comments, what if this were your child? Food for thought.

@MichiganSnow - your heart is in the right place, but we gave up caring about this whiny little troll a long time ago. She has long since used up her sympathy card. If it were my child, she'd know what time it is and this nonsense would've been over a long time ago.
