Lohan to Sue Jewelry Store Over Surveillance Tape

Lindsay Lohan is preparing to sue Kamofie & Company jewelry store -- claiming they had no right  to cash in  from the sale of the infamous surveillance tape ... because Lindsay never gave them the right to use her image for profit ... TMZ has learned.

Sources connected to the surveillance video tell TMZ ... Kamofie sold the rights to distribute the tape to the Associated Press for at least $40k. The AP has since struck a deal with "Entertainment Tonight" in which the show got exclusive rights to air the tape for one week.

We're told Lohan met with her lawyers today ... no word on when she plans to file the lawsuit.

UPDATE: A rep for Kamofie tells us, "We regret to hear there is trepidation by Miss Lohan in connection with the video. "

The statement continues, "We hope that everyone understands that this is beyond our control, the flood of the requests to see this video were simply too overwhelming.  It was truly necessary to put it out."

So they sold the tape...it's looks bad for them, true..but doesn't change a darn thing simply because even if lindsay went to that shop and left with the necklace accidentally. She didn't do the right thing after the fact! Instead of returning it..the fool wears it in public where she knows her picture is going to be taken! She doesn't try to return anything until it's reported that the cops have obtained a search warrant and they are headed to her house! Then instead of trying to have it returned to the store like a person with a brain, She send it straight to the police! It should be noted that not at any point in the tape is she seen signing anything! She didn't fill out any kind of do***ents for that necklace.
She has a history of stealing things...and what she did has hurt the store immensely. No way they made enough to counteract that. Lindsay stole a necklace and it's been widely reported that they may be ripping people off by inflating their prices...There is no way another Celeb is going to go shop with them! Noone with money is going to go...I don't feel to badly for them...but they didn't break the law..Lindsay did!

Lindsay is the only one who broke the law! One Thing I'd like to know though...Why, Would she visit that place days in a row and NEVER buy anything? Then after she gets that necklace she doesn't go back at all.....We've all seen the tape by now. That store in tiny, there's very little to see...yet she stayed for 45min on the day she walked out with the necklace! When she wore it out after the fact..she wore it turned the wrong way..perhaps a pathetic attempt to keep it from being recognized. I guess she thought because she hadn't heard from the store that she was in the clear! ...Then after everything begins to blow up this "innocent" person sends flowers to the people as an apology? Who does that if they are innocent? THE TAPE SELL MEANS NOTHING! Lindsay screwed herself!

i agree with you # 16 maybe they turn the store into a block buster video store. Lindsays lawyer shoul check the stores financial records and see if they have missed some lease payments then look at some of their irs records. then lets see who goes to jail

I just don't get this attitude. OK, she's pretty...and?

Should we just forgive anyone who's above average in physical appearance? Is that your criteria for meting out justice? Pretty faces get to walk?

You must either be a lovestruck school boy or someone who feels their looks are well above par to champion that kind of logic.

IMO, Lindsay's looked better in the past and while I agree she looks pretty in that picture, I went to school with girls who were prettier. They just weren't as talented to my knowledge.

This proves nothing other than that Lindsay might know the tricks of the shoplifting trade. She still walked out with a necklace she didn't pay for and didn't return it within 24 hours like an honest person who made an honest mistake would.

You're assuming there was a verbal agreement when there's no proof of one just because you can't hear what they're saying? The owner said there was no such agreement. Her credibility might be in question but taken at face value it still exceeds that of Lindsay. NO business person is going to loan out a $2500 necklace solely on the word of a celebrity. Their insurance carriers would go into cardiac arrest. They're going to get a signed receipt, a contract, a credit card...something...some form of collateral or legally binding do***ent to secure the loan in case of loss or damage before they willingly and knowingly allow the piece to leave the premises. No one's going to loan out jewelry to the First Lady -much less Miss Lohan - without it.

If she walked out of the store with property that didn't belong to her and without proven consent of the owner, it's theft. Intent is implied by the act itself and the length of the duration the item was in Lindsay's possession.

That said, Lindsay could have a case against the owner for sale of the video. Although consent to be filmed is considered to be implied by entering the store, it is a limited consent given for purposes of security only and does not entitle the owner of the video to use its content for profit. That's a huge legal no-no.

Lindsay is actually smart to sue over the release of the tape. Selling the video provides a reason to question the motives of Kamofie & Co. It seems they will profit greatly from the publicity from the tape as well as the case itself. I do not believe this girl is dumb enough to steal a necklace when she is constantly in the public eye. Maybe if she pulls a Brittney and shaves her head on camera people will be more compassionate and leave her alone.

# Some of you posters are completely missing point of the story. The surveillance tape has no audio. Therefore, you have no idea what was said to Lindsay, in regards to the necklace. Secondly, Lindsay stayed in the store (while wearing the necklace) talking to the owner for over 30 minutes. Not quite the thing an alleged thief would do, now is it? Kamofie profits from the sale of the surveillance tape; "without receiving," Lindsay's authorization, Kamofie intentions in this manner are suspicious, and if I was a juror I would find Lindsay innocent. And for the record, I am not a Lindsay fan! I think the Kamofie store is in contempt and should have charges filed for selling something in evidence.

I do not believe Lindsay intentionally "stole" the necklace. It would not matter to me if she had no hair and weighed 550 pounds. She would still be innocent. I'm providing pretty photos because so many people here see her as unattractive based on the intense hatred they harbor. That's delusional. The pretty photos are proof positive of the delusional state of the average Lindsay hater.

i dont hate lindsay but i feel beeter she is so far away. be honest would you trust her with your belongings. i dont like a thief or a liar. if the store owner is out to make so much money what about the blohan clan sue tabloids. interviews. the video is aloud to be shown. do you ever watch cops on tv or any other court tv thing. i guess she is trying to be protected again. she has a history of steeling and this is no diff. how come the necklace is turned backwards
