Don't Blame Me

for Gruesome Car Crash

Jamal MashburnRetired NBA superstar Jamal Mashburn has been accused of causing a nasty car accident that left two people badly injured ... but Mash says the other driver shouldn't have been DRIVING WHILE USING A CELL PHONE!!!

The ESPN commentator has been sued in Florida over an accident that occurred back in February ... and one of the alleged victims claims she was physically scarred and disfigured  as a result.

But Mashburn is fighting back -- and in court docs obtained by TMZ, he denies responsibility and points the finger at his accusers ... who he says were NOT following common safety rules of the road.

In the docs, Mashburn claims both people were NOT wearing seatbelts at the time of the crash ... and alleges the driver was using a cell phone.

Mashburn also claims the alleged victims are LYING about the extent of their injuries ... insisting they were not permanently injured, scarred or disfigured.

The alleged victims are seeking more than $15k. Calls to Mashburn have not been returned.

I am a claims adjuster who handles claims in Florida. Injured persons are ALWAYS over inflating their claims. In Florida, you have to have a permanent impairment, i.e., Permanent Impairment Rating from a physician, scarring, etc...to make a claim against the alleged at-fault party. The reason the suit is for $15,000 is that is the "starting point" (for most attorneys; however, some will state a prayer in their lawsuit for higher amount just to start) to get the matter heard at a certain level of court. Rest assured, they will try to take his insurer and him for much, much more money. Don't ever have an accident in Florida. It is very litigious and Plaintiff friendly there. Good luck to Mashbum!

Well, here in Florida, it ain't illegal to talk on the cell phone while driving......at least I don't think so. I have passed many a cop, on the road, while blabbing away on the cell. I think texting and driving is illegal though..

If I had to guess, I wouldn't put my $$ on a spoiled ex sports "star" to tell the truth. Whatever they do wrong, it's always someone else's fault. But the extent of injuries can be determined and investigation of the accident should determine what happened. 15K doesn't sound like much.

If the police or lawyers find that one of the drivers was, in fact using a cell phone while driving (all they have to do is check the records) then I side with him. These idiots who talk/text while driving are not paying attention ever and then act like it's everyone else's fault when they run stop signs or red lights and get hit or hit someone else.

Subpoena the phone records and see if there was an active call @ the time of the accident. Nice and easy.

Mash is'nt some nba diva he's worked hard after retiring by making very succesful buisness endeavors he should'nt pony up any cash to these people who are obviously trying to sponge off of him shhhhhhhhessssh
